Tort law is a body of law which addresses civil wrongdoings; it is split into intentional torts and negligence, or “accidents”. In tort law, if the wrongdoer is found responsible for causing the damage to the victim, then he will be responsible for paying damages to the victim, but he will not be put into jail or have to suffer other criminal punishments.

For intentional torts, such as assault, battery or false imprisonment, the victim must show that the wrongdoer had intent. Intent is defined as whether the wrongdoer purposely desired, or was substantially certain that the result would occur. For example, if Donald the Defendant purposely pulled a chair out from underneath Grandma Patty the Plaintiff, and the court determined that Donald was substantially certain that Grandma Patty would fall and break her newly replaced hip, then Donald would be liable to pay for Grandma Patty’s damages. However, if Donald did not pull the chair out intentionally, then it may fall under negligence, or an accident.

Assault and battery can be both tort and criminal acts. However, certain acts may only make the wrongdoer responsible for a tort, and not for a crime. For a tortious assault case, the victim would have to show that the wrongdoer intentionally caused him reasonable apprehension of an immediate harmful/offensive act. In order to cause reasonable apprehension, the victim must be aware of what is happening, so if the victim was asleep during the time, then there is no tortious assault. In a tortious battery case, the victim needs to prove that the wrongdoer intentionally caused harmful or offensive contact with his person. With this, the wrongdoer does not even have to make a direct physical connection with the victim. So for instance, if Donald intentionally picked up a rock and threw it at Patty, but did not touch her with his hand, he is still responsible for battery. In battery, the victim does not need to be aware of the act or its harmful nature. Taking the above example, if Donald threw a rock at Patty while she was sleeping, he would be liable for battery, but might not be responsible for assault.

The National Highway Traffic Safety Administration’s (NHTSA) report on rollover accidents shows that SUV involved rollover accidents increased from 22% in 1991 to 37% in 2000. This increase is not necessarily because of design or manufacturing defect, but perhaps because of the SUV’s increasing popularity. In the report, researchers found that SUVs are the only vehicle type in which the number of fatalities resulting from rollover accidents is greater than the number of fatalities resulting from non-rollover crashes. According to a report published by the National Highway Traffic Safety Administration (NHTSA), the increasing popularity of sport utility vehicles (SUV) has contributed to the overall increase of rollover accidents. The study also found that in most of the accidents, the vehicles were either traveling straight forward, or were trying to maneuver a curve. Additionally, more than one-fourth of fatal rollover crash drivers did not attempt any kind of avoidance maneuver.

FATAL SUV AND CAR CRASH ON 880 IN HAYWARD

A man died when he was thrown from his SUV in a crash on I-880 in Hayward. The accident occurred mid-afternoon when a '96 Toyota Corolla veered into the '99 Explorer in an attempt to avoid another vehicle. The driver in the Corolla was uninjured. Duragesic pain patches are used for moderate to severe pain relief, and contain a chemical called fentanyl. The pain patches are manufactured by Janssen Pharmaceutica Inc. and ALZA Corp., both subsidiaries of Johnson & Johnson, and were approved by the United States Food and Drug Administration (FDA) in 1990. In February 2004, manufacturers recalled several batches of Duragesic patches because of the possibility that seal breaks were allowing the drugs to leak from the patch and be directly absorbed into the skin. Then, again in February 2008, manufacturers recalled Duragesic pain patches because of the fear that small cuts in the patch would lead to accidental exposure to the fentanyl chemical. On November 19, 2008, a jury in Chicago, Illinois, awarded the family of Janice DiCosolo $16.6 million dollar in damages. The jury ruled that the woman died because of a fatal dose of fentanyl from her Duragesic patch. This was the fourth trial loss for the manufacturers of Duragesic; the most recent verdict against the companies was in Florida last month in which a jury awarded $13.3 million to Susan Hodgmire’s family. Another federal jury awarded the family of a 28 year old man, who died while wearing the patch, a verdict of $5.5 million.

WOMAN KILLED AT WORK IN SAN FRANCISCO PRINTING PLANT. FAMILY SUING EMPLOYER FOR VIOLATING SAFETY REGULATIONS.

A pregnant woman was crushed and killed by a printing press while working at DPI International in Potrero Hill, San Francisco. Her family is suing the company, alleging that safety devices were not in place to protect the victim. The San Francisco Chronicle reports that a multi-million dollar award has been upheld and granted to a victim who was served tainted food at a Southern California restaurant. BUS ROLLOVER CRASH KILLS 10 IN NORTHERN CALIFORNIA. NO CAL LAWYERS ARE HERE FOR YOU NOW.

A charter bus rolled over on a rural road outside William, CA, north of Sacramento. The bus flipped over and landed with its wheels down in a ditch. Passengers were thrown from the vehicle and crushed inside. Ten people were killed and dozens more injured.

DEADLY THREE-CAR CRASH ON I-680 IN CONCORD, CA. MATTRESSES ON ROAD LIKELY CAUSE.

AC TRANSIT BUS HITS PASSENGER LOADING BICYCLE IN RICHMOND

A woman was preparing to board an AC (Alameda-Contra Costa) Transit District bus when the bus rolled forward and struck her. In two separate SF incidents, families of men who were killed sued the city for wrongful death. San Fran's Board of Supervisors approved compensation to the families totaling over $1.8 million. The financial settlements are awaiting final approval from the Mayor. While the city of SF admits no liability in either case, $1,695,000 was awarded to the family of a man who died in a taxi cab accident after being treated at SF General, and $150,000 was awarded to the estate of a man who died during a botched fire rescue attempt. In the larger settlement, a Michigan man died a month after he was in a taxi crash in 2006. FENTANYL PAIN PATCH DEATH: JOHNSON & JOHNSON TO PAY $13 MILLION TO VICTIM OF DURAGESIC PATCH

In yet another sad and disturbing chapter in the Fentanyl pain patch saga, the husband of a woman who died from a Fentanyl overdose has won his lawsuit against Johnson & Johnson, the distributor of the “Duragesic” patches. Fentanyl is a pain killer which is stronger than morphine, and the Duragesic patches release Fentanyl through the skin. The victim, a mother of five, was suffering from pain after back surgery when she used the patches. The victim's lawyers alleged that the patches were leaky and therefore defective, resulting in the woman's deadly overdose of Fentanyl. SAN FRANCISCO PEDESTRIAN, BICYCLE & CAR CRASH DEATHS & INJURIES INCREASE DRAMATICALLY

The most recent SF Collision report, compiled by the San Francisco Municipal Transportation Agency from CHP statistics, shows a disturbingly high rise in traffic-related injuries and deaths. In 2007 pedestrian accidents were up more than 50%, composing more than half of all traffic deaths. Bicycle-related crashes rose over 30%. Vehicle-related deaths are also up over 50%, while injuries from accidents involving motor vehicles are also on the rise. The report also showed that certain SF intersections are particularly dangerous for walkers. AMTRAK TRAIN CRASH IN RICHMOND KILLS MAN

A 27 year-old man driving a Honda Accord died when his car was hit by an Amtrak train in Richmond, CA. Apparently the driver went around the boom barrier before he was struck. A special report by Channel 2 (KTVU) looked into a frightening Bay Area menace: extremely dangerous driving behavior on the Bay Bridge. Heparin is an anticoagulate used for blood clots and dialysis, and has been the focus of the U.S. Food and Drug Administration (FDA) recalls and several product liability lawsuits. Heparin is manufactured by Baxter Healthcare Corporation and is used principally in medicine. Its purpose is to prevent the formation of clots and help the body naturally break down clots that have already formed. There are serious side effects to heparin, and an overdose of the drug can be fatal.

The controversy on heparin began in December 2007 when a shipment of heparin was recalled by the FDA because of a bacterial growth. Then, in March 2008, there were more recalls of heparin because of a contamination of an imported shipment from China. According to the FDA, there were at least 81 deaths as a result of the contamination, and more than 785 reports of serious injuries. The Administration admitted that it was at fault for the contamination as it failed to inspect the shipments from the plant in China.

Aside from the recalls, Heparin lawsuits were also brought for drug overdoses and mislabeling. One famous lawsuit was brought about by actor Dennis Quaid, when his twelve day old twins were given a dose of heparin that was 1,000 times the recommended dosage for infants. The overdose was a result of mislabeled dosage on the bottle. Approximately six months after the Quaid lawsuit, another set of twins in Texas were accidentally administered an overdose of Heparin. However, in the latter case, the overdose was due to a mixing error rather than a mislabeling error.

TIGER ATTACK VICTIMS SUING SF ZOO FOR NEGLIGENCE

Two men who were attacked by a tiger at San Francisco Zoo last year are suing the Zoo and city officials for negligence. The incident received international attention, and a third man was killed in the Siberian tiger attack. The suit will claim that the animal was not appropriately or safely kept in the park. The men suing the zoo and the city are brothers. They claim the zoo and officials were negligent because the tiger's enclosure was insufficient. CALIFORNIA ELDER ABUSE AND DEPENDENT ADULT CIVIL PROTECTION ACT

Elder abuse can take many forms, including domestic elder abuse, institutional abuse and self-neglect. Domestic elder abuse occurs in the home of the victim or the caregiver, and the abuser most commonly in these situations are a family member, friend or paid caregiver. Institutional abuse occurs in a nursing home or other such assisted living facility. Lastly, there is self neglect in which the elderly person’s own actions endanger his/her life, such as depriving oneself of food and water. However, this last category of self neglect is not a crime. Institutional abuse was the basis of a recent lawsuit filed in Alameda County.

A Northern California resident filed a civil lawsuit against the High Street Care Center for elder abuse on Monday, November 3, 2008. The patient, Grover Brown, suffered from paraplegia and multiple sclerosis. The lawsuit filed on behalf of Mr. Brown alleged that the nursing home neglected to protect him from bed sores, and as a result, it led to such severe infection of his bone and bone marrow that he had to have his coccyx removed. Although Mr. Brown is only 39 years old, he is protected under the California Elder Abuse and Dependent Adult Civil Protection Act. This Act protects the elderly and dependent adults from willful actions of their caretakers.

The new information from SF’s Transit agency is shocking. Pedestrian accidents have nearly doubled in the past year, while bike, car, bus, and passenger crashes are also on the rise. In addition, Muni employees are also being hurt on the job at a higher rate. INJURED IN DRUNK DRIVING ACCIDENT IN DANVILLE, CA?

Drunk driving is suspected in a multi-vehicle accident that occurred mid-day on Interstate 680 in Danville leaving three people injured. The crash included two cars, a flat bed truck and a tow truck. A Subaru Forester and the tow truck were pulled over to the side of the highway when they were struck by a two-axel flatbed truck. The tow truck driver was critically injured during the crash, as he was pulled under his truck by the force of the collision. The accident occurred on southbound Highway 680 and resulted in the brief closing of the entire freeway. In addition to the two truck drivers who were hurt, a third victim, driving an Acura was also hospitalized with minor injuries. In the scam, the travel agent took money for trips, reservations and tour packages to China for senior clients, but while providing a receipt, she never actually booked plane tickets or made reservations or arrangements. CALTRAIN HITS TRUCK IN SAN MATEO, CA, KILLS DRIVER

A pick-up truck parked on railroad tracks was struck by a northbound Caltrain in San Mateo, CA, near the intersection of Ninth and South Railroad Avenues. According to official reports, the railroad crossing arms were down at the crossing and the police are still investigating why the pick-up truck drove around the crossing arms and onto the tracks. The fifty-year old driver of the pick-up truck was pronounced dead at the scene. No one on Caltrain was injured, but the accident delayed train service for several hours. Train accidents may be caused by a variety of factors, ranging from conductor error to track and equipment failure. These types of accidents may cause fatal injuries, burns, spinal and brain injuries, and paralysis.

The accident occurred at 5:30 a.m. on Thursday, October 30, 2008 as the Caltrain approached northbound in San Mateo. The pick-up was straddled across the northbound tracks and was dragged by the train for nearly 200 yards. The Caltrain commute was delayed, as investigators tried to determine why the pick-up truck was parked on the railroad tracks. Caltrains approaching the San Mateo area were instructed to return to San Francisco and San Jose.
