ALCOHOL PLAYS ROLE IN CAR CRASHES AND MOTORCYCLE ACCIDENTS AROUND BAY AREA

All across the Bay Area this holiday season, there have been numerous car and motorcycle accidents that resulted in death, or serious injury.   • There was a fatal collision in Saratoga on Highway 85 on Sunday, December 28, 2008. The crash involved approximately three vehicles and there was one fatality involved in the crash. Several others may have also sustained injuries, but officials are unclear on what caused the accident.
  • Two vehicles collided in San Mateo County and sent one car over a cliff on Sunday, December 28, 2008. After the collision, one car dove off of Devil’s Slide, which is south of Pacifica on Highway 1. Five people were injured in the crash. Officials arrested one person on drunk driving charges after it was determined that alcohol was a factor in the car crash.
  • On Saturday, December 27, 2008, a motorcyclist who had been involved in a crash the previous day died at the hospital. The motorcyclist was 53 year old Bobby Walker, who was riding his Harley Davidson on Highway 80 near American Canyon Road. California Highway Patrol has reported that Mr. Walker had approached stopped traffic at a speed of 65 miles per hour. He lost control of the bike and was ejected from his seat. Officials have also reported that alcohol may be a factor in the incident.

PEDESTRIAN HIT AND KILLED IN HAYWARD, CALIFORNIA

The increase of traffic and visitors in the Bay Area pose dangers by way of additional cars, trucks and bikes on the roadways. In the early hours of Wednesday, December 17, 2008, a pedestrian was hit and killed on Interstate 880 in Hayward. The accident occurred near the off ramp to eastbound Highway 92. Authorities interviewed the driver of the Honda and determined that he was not at fault for the accident.

LIVERMORE LABS WORKERS POSSIBLY EXPOSED TO TOXIC METAL DUST: CALL AN ATTORNEY

BURNS CAUSE HIGH INCIDENCE OF DEATH IN CHILDREN— SAN FRANCISCO BURN INJURY ATTORNEYS (Part 1 of 2)

Burns can be caused by common, everyday duties, such as cooking, lighting the fireplace or even bathing. They can also result in different degrees of burns that require treatment ranging from running the burned area under cold water to visiting an emergency room for proper treatment. Burns are defined as being a first, second or third degree burn. First degree burns are the least serious types of burns in which the most outer layer of skin is burned. The signs are if the skin is red and swollen, but the outer layer has not been burned completely through. Second degree burns occur when the outer layer is burned through and the second layer is burned as well. These burns cause blistering, swelling, pain and redness.

Children can also be easily scalded by bathwater, especially for slightly older children who are able to reach the hot water knob and turn it on their own. Burns result in hospitalization of over 40,000 children each year, and over 1000 deaths. To prevent such injuries in the bath tub, it is recommended that the thermostat on the hot water heater be turned down to 120 degrees Fahrenheit, to prevent the possibility altogether.

The Mayo Clinic suggests that for minor burns (first and second degree burns) which are no larger than three inches in diameter, one should cool the burn by holding it under cold water, or immersing it in water for at least five minutes. Then, the burn should be loosely covered with sterile gauze bandage, as it will keep air off the burn and protects the blistered skin. Lastly, an over the counter pain reliever can be used, such as aspirin or ibuprofen. It is not recommended that you use ice, butter, or ointments on the burn.

HIT AND RUN CAR ACCIDENTS ON THE RISE IN BAY AREA

Car crashes resulting in serious injury or death may sometimes be ruled as an “accident” by police and those wrongdoers may escape criminal liability (though often not civil liability); but when those wrongdoers flee the scene of the crash, they will likely face more trouble than if they had just remained at the scene. Gerardo Yambao was killed last week in San Francisco near Lake Merced Boulevard by a hit and run driver. On Wednesday, December 11, 2008, police arrested 32 year old Roger Tsang of San Francisco on suspicion of hit and run. He is being held on suspicion of felony hit and run and vehicular manslaughter.

Another man in Fremont was killed after being hit by a vehicle in Fremont at the intersection of Central Avenue and Southwest Street. The victim was a 73 year old Fremont resident, who was trying to cross the street in his wheelchair around 8:15 p.m. on Friday, December 12, 2008. The driver of the car was not injured in the collision, but the victim was pronounced dead at the scene.

DRUNK DRIVING IN CA KILLS AND INJURES THOUSANDS: HOLIDAYS A DANGEROUS TIME

California Highway Patrol issued their Statewide Integrated Traffic Records System (SWITRS) report for 2006 which included statistics for car accidents involving alcohol. During 2006, there were:

  • 1,420 fatal collisions involving alcohol, and 20,912 injury collisions.

  • 1,597 people were killed in such collisions and 31,099 people were injured.

  • 48.2% of the parties who were killed or injured in alcohol related accidents were determined to have been drinking.

  • 51.8% of the drivers or passengers who were killed were not drinking.

  • The majority of movements preceding the collision were when the vehicle was proceeding straight, followed by when the vehicle ran off the road, and when making a left turn.

  • The majority of drivers in fatal collisions who were under the influence were in the age range of 21 to 24 years old.

  • Those drivers under the influence who were injured in alcohol related collisions were also primarily in the 21 to 24 year age range.

  • Most of the accidents occurred on Saturdays and Sundays between 2:00 and 3:00 a.m.
  • Sadly, an example of the fatality of drunk driving occurred this past week. A man driving his Toyota Highlander the wrong way on Interstate 280 collided with an Acura on Thursday morning, December 11, 2008. The driver of the Toyota only suffered minor cuts and injuries to his head and arm while a passenger in the Acura died at the scene. CHP officials determined that the Toyota driver was under the influence of alcohol at the time of the accident.

Big%20Rig%20Accident.jpg An Oakland resident died in a car crash on Highway 880 on Friday, December 12, 2008 at around 3:30 a.m. The victim was Vu Phan, who was driving a Honda traveling southbound on I-880 near Hayward. Mr. Phan initially rear ended a big rig and was disabled as a result of that accident; the headlights on his car were also blacked out. Very soon after, a UPS truck failed to see the disabled Honda and struck it. After both trucks pulled off to the shoulder, a passerby spotted Mr. Phan’s body on the highway. Officials stated that it was unclear whether Mr. Phan was ejected from the vehicle, or if he had already been standing outside of the vehicle when he was struck.

TRAIN COLLISIONS, CAR WRECKS AND PEDESTRIAN ACCIDENTS INCREASE DURING THE HOLIDAYS IN THE BAY AREA

With the holidays coming up, a large number of people are out and about, whether it’s visiting family, going to holiday parties or finishing up holiday shopping. With this increase of people on the roads, and public transportation, there is a higher chance of accidents occurring. In the last week, there have been numerous accidents in the Bay Area.

  • On Friday, December 5, 2008, Caltrain struck and killed a man near the Hayward Park station around 7:30 a.m. Officials have reported that there was no pedestrian crossing where the man was hit, and there was no reason for him to be there. Caltrain was delayed for approximately an hour and a half, and delays continued on for hours after the fatality.
  • A pedestrian was killed in a hit and run accident on Friday in San Francisco, near Lake Merced. He was identified as San Francisco resident Gerardo Yambao. Police are still investigating the hit and run accident and are searching for a white SUV in connection with the incident.
  • A woman died in a car accident in San Bruno after veering across two lanes and hitting the driver’s side of a SUV. The accident happened around 11:40 p.m. on Friday night on Interstate 380, and the woman was pronounced dead at 1:05 a.m. The driver of the SUV was arrested for driving under the influence of alcohol, but was not believed to be the cause of the accident.

FATAL WORK INJURIES IN CALIFORNIA—CALL A BAY AREA INJURY ATTORNEY NOW

The California Department of Industrial Relations’ Division of Labor Statistics and Research released a report of fatal occupational injuries and illnesses. In total, there were 453 fatal injuries that occurred in the workplace in 2005.

  • Significantly more men than women were fatally injured in the work place—with only 24 women as compared to 429 men.

  • The majority of the fatal workplace injuries occurred in the 35 to 44 year age range, with 113; the second highest numbered occurred in the 45 to 54 age range, with 108 fatalities.

  • 200 of the 453 fatalities occurred to white, non-Hispanic employees, with Hispanic employees following close behind at 187 fatalities.

  • The primary source of fatal accidents involved vehicles, as there were 186 fatalities.

  • Many of these fatalities occurred in the street and highway, and industrial place and premises.

  • The majority of these injuries occurred in transportation and material moving occupations, with 115 deaths.

  • 154 of the deaths resulted because of multiple traumatic injuries.

Wrongful death lawsuits are put in place by the legislature in each state to help protect family members of those who have been wrongfully killed because of someone else’s negligence. This claim is a civil claim, and not a criminal matter (such as murder or manslaughter). MOB TRAMPLE AND KILL WALMART EMPLOYEE ON BLACK FRIDAY IN CALIFORNIA

Black Friday, the day after Thanksgiving, is notorious for large mobs of shoppers looking for good deals. A recent occurrence on November 28, 2008 showed the danger of some workplaces, but was also an unusual incident that may not happen often. Jdimytai Damour, a Wal-Mart employee, was trampled to death early Friday morning as he and other employees prepared to open the doors to anxious shoppers.

Over 200 shoppers rushed the Wal-Mart doors in Long Beach and injured four other shoppers, one of whom was a woman eight months pregnant. The shoppers even took the doors off their hinges as they rushed in to shop. Even as an emergency crew attempted to revive Mr. Damour with CPR, they were still being trampled by shoppers. Mr. Damour’s family stated that Mr. Damour died of a heart attack, and is seeking accountability for the incident.

In Kentucky on November 22, 2008, the Lasitter family settled with Six Flags Kentucky Kingdom for an undisclosed amount. Approximately a year and a half ago, Kaitlyn Lassiter’s feet were severed on one of Kentucky Kingdom’s rides. She was riding on Superman Tower of Power, which lifted the riders off the ground and then dropped them at high speeds, when one of the cables broke and severed her feet. Katilyn’s medical bills have totaled more than $500,000 since the accident; she has undergone four different amputation surgeries. State officials investigated the incident and determined that the incident may have been avoided if the park operators had followed the ride manual’s instructions for detecting if there was deterioration in the cables. Additionally, the officials determined that if the ride operator had pressed the emergency button immediately, Kaitlyn would have been able to escape with only cuts and scrapes.

However, there are several restrictions on who may sue, and on what basis. There are three different categories to determine if the victim has any right to sue the landowner: trespassers, licensees and invitees. A trespasser is someone who enters the land without the express or implied permission of the owner. In many cases, the owner does not owe a duty to the trespasser, and may not need to warn him about different dangers, or to maintain the property in a special way.

Licensees are those people who may be expressly or impliedly invited by the landowner. Contrary to what the name may imply, this category includes friends who are visiting as well as salesmen who are going door-to-door. The landowner in this case is not required to make efforts to make the property safe for the licensees, but must warn the licensee of any dangers on the land that is known to the landowner. For example, Paul the paintbrush salesman would not succeed in a lawsuit against Debbie the houseowner if he tripped and fell in a hole that Debbie did not know about. However, he may be able to recover damages if he fell into a trench that Debbie was digging for a new water pipe, and did not rope the area off, or put a sign to warn him about the trench.

BICYCLISTS AT RISK OF HIT AND RUN ACCIDENTS IN CONTRA COSTA COUNTY

A cyclist riding on McEwan Road near Highway 4 in Contra Costa County was killed on Monday, November 24, 2008 at around 5:20 p.m. California Highway Patrol is still investigating the incident, and believe that a Chevrolet Silverado, or a similar pickup truck or SUV, struck the bicyclist as he was riding on the west shoulder of the road. An off-duty fire captain found the bicyclist and called for help, but the victim died at the scene.

The cyclist was 49 year old Mark Pendleton, and his memorial service was held on Sunday, November 30, 2008. The city of Martinez, among others, has put out a reward of $5,000 for any information on the driver who hit Mr. Pendleton. The total reward in the fund totals $10,000. WOMAN IN BUS DIES IN CRASH WITH TRUCK ON SONOMA HIGHWAY

A passenger in a minibus died after the bus was hit by a flatbed truck carrying a heavy load. The accident occurred on Highway 116 in Sonoma County, south of Santa Rosa. The westbound tractor trailer, which was carrying a cement mixer, turned left in front of the eastbound bus. The bus driver and truck passengers received injuries, some of which were severe. WRONGFUL DEATH SUIT FILED AGAINST SUNNYVALE POLICE

A woman whose husband was shot dead by cops in Sunnyvale last year is suing the police department for wrongful death. The widow alleges that her husband was unarmed when he was killed by two officers from the Sunnyvale Department of Public Safety. The police were attempting to arrest the man when he “aimed his vehicle at the officers.” Both policemen fired shots resulting in the man's death. BIG RIG TRUCK CRASH ON NAPA HIGHWAY CAUSES MULTIPLE INJURIES

A Peterbilt big rig carrying a load of rocks and boulders overturned while taking a turn on Highway 121 in Napa County. As the boulders spilled out of the truck, three cars attempted to avoid the oncoming rubble and crashed. The accident resulted in major and minor injuries to the car drivers. DURAGESIC FENTANYL PATCH DEATH SETTLMENT: JOHNSON & JOHNSON CO'S TO PAY $16.6 MILLION TO VICTIM'S FAMILY

In yet another trial, Johnson & Johnson, the contractors of a patch using the painkiller Fentanyl, has been defeated and found responsible for a deadly overdose. A jury found that a woman suffering from chronic neck pain died as a result of using the “Duragesic” Fentanyl skin patch. The jury awarded the estate of the victim $16.6 million. Alza Corporation, the patch makers, and Janseen Pharmaceutica, the distributors, are the Johnson & Johnson units named in the suit. Fentanyl, a narcotic, is 100 times stronger than morphine. Patches have been recalled after defects and overdose deaths were reported. This trial is Johnson & Johnson's the fourth lawsuit and fourth loss over the Duragesic transdermal skin patch. SLIP, FALL, TRIP HAZARD ON SAN FRANCISCO SIDEWALK

A local newspaper reports that a large crater-like hole exists on a 19th Avenue sidewalk in San Francisco. Per complaints from residents, the paper investigated and found the treacherous opening on a busy stretch of road. The dangerous road hole is located on a busy area of 19th Ave between Mercy High and Winston Drive. The paper reports that in addition to uneven sidewalks, pedestrians must also deal with a gaping hole in the walkway. Apparently, a slab of concrete was once used to cover the crater, but it has since “broken and collapsed inward.” Overgrown bushes in the area have been recently cut back to eliminate that additional danger. While it's not immediately apparent whose responsibility the pothole is, clearly there is a danger to children and adults who use the side walk. Three LA men have been arrested in conjunction with posing as professionals to gain access into homes of seniors and then robbing them. The trip of scam artists allegedly targeted Chinese seniors by dressing up as water company employees. They would enter the homes and distract the residents while going through the place for valuables. CAR AND MOTORCYCLE ACCIDENTS IN THE EAST BAY ON THE RISE

As the holiday season rolls around, the highways and public transportation systems are busy with travelers. Five people were killed in various motorcycle and car accidents in the Bay Area, between Friday, November 21, 2008 and Sunday, November 23, 2008. According to the California Highway Patrol, all of the accidents remain under investigation.

  • A fatal motorcycle accident occurred in Contra Costa County at 11:30 a.m. on Sunday, near the Willow Pass on-ramp on Highway 4.A man was killed as he was traveling eastbound on Interstate 580 and drifted onto the shoulder, then overcorrected to the left and lost control of his car. The accident happened around 3 a.m. on Sunday near Keller Avenue in Oakland.
  • Two people died in a multi-vehicle hit and run on westbound Interstate 80 in Richmond on Saturday at about 3:50 a.m. According to police, the initial crash involved four different cars but the fatalities occurred when the victims of one of those cars exited their car, and were struck by a fifth car that fled the scene.
  • A pedestrian was hit and killed as he ran across Interstate 880 near Hegenberger Road in Oakland at around 11:15 p.m. on Friday.

If the police are able to locate the driver of the fifth car who hit and killed the two people in the multi-vehicle hit and run, then he/she may be liable for both criminal charges and civil lawsuits. Assuming that the driver has insurance (and hopefully he/she does!), then the insurance company would have a duty to defend the driver in a lawsuit, and possibly to pay the injured party if the act is covered by the insurance policy. If the insurance company fails to do so, then it will be acting in bad faith.

INJURED IN AN ACCIDENT AS A RESULT OF NEGLIGENCE? CONTACT A SAN FRANCISCO ATTORNEY

In order for a victim to recover for negligence, he must prove six elements: (1) duty, (2) breach of conduct, (3) breach of duty, (4) cause-in-fact, (5) proximate cause, and (6) damages.

(1) Duty: did the wrongdoer have an obligation to conform to a certain standard of care? If the wrongdoer was the one who caused the incident, then he will likely have a duty.
(2) Standard of Conduct: are there certain things that a reasonable person in the situation would have done, or not done? Under this element, a reasonable person is defined as an average person in a community, who is of average intelligence and common sense.
(3) Breach of Duty: did the wrongdoer do or not do something that the reasonable person would have done or not done? If so, then this element would be met.
(4) Cause-in-Fact: is it more likely than not that but for the wrongdoer’s actions, the victim would not have been injured? This is a crucial step in proving negligence.
(5) Proximate Cause: how closely related is the victim’s harm to the wrongdoer’s actions? If the wrongdoer’s actions are too remote from the victim’s harm, then the court may not allow for the victim to recover any damages.
(6) Damages: can the victim prove that he suffered damages? Damages here can be compensatory, in which money is awarded to the victim for medical expenses, lost wages, or pain and suffering; damages could also be for property damages, among others.
