MAJOR INJURIES AS RESULT OF CAR ACCIDENTS IN SAN FRANCISCO & SAN JOSE

The driver attempted to flee the site of the accident, but was stopped a block away by witnesses who detained him until police officers reached the scene. In an unrelated accident on the same night, an 81 year old woman was struck and killed in the Sunset District. She was walking across Santiago Street when she was struck. It is reported that there were no stop signs or traffic lights at that intersection.

On Monday morning in San Jose, a father and son were struck on their way to the boy’s school. They were walking in the crosswalk of Story Road and Adrian Way at approximate 8 a.m. The father and son were crossing a green light when they were struck. They both sustained injuries but are expected to survive. On Friday, January 30, 2009, police arrested the driver of the car, Marvin Martinez, on charges of felony hit and run.

DUI DRIVER ARRESTED AFTER CRASH ON HIGHWAY 101 IN SONOMA COUNTY

The new year has brought about an influx of drunk driving accidents, many of them resulting in serious injury or death. In DUI accidents in which the drunk driver was acting recklessly, the victim, or their family, could potentially recover from the drunk driver for damages that the accident caused. The Centers for Disease Control and Prevention have noted that the major risk factors of death by drowning include: lack of barriers and supervision, age and recreation in natural settings, alcohol use and seizure disorders. In December 2007, there was a federal law called the Virginia Graeme Baker Pool and Spa Safety Act which requires that public swimming pools update the drains in their pools to prevent swimmers from being trapped, injured or disemboweled in the drains. The new law requires these drains to be dome shaped, rather than flat, to decrease the amount of surface area that a swimmer can get sucked into. Although the law was put into effect in 2007, the government allowed a grace period of one year for public pools to comply. The deadline is approaching for these new drains to be installed. Approximately eighty percent of the public pools in the country still have not complied with the regulation.

According to the Centers for Disease Control and Prevention, there were 3,582 fatal unintentional drowning in the United States in 2005. SAN JOSE WOMAN KILLED BY RECKLESS DRIVER

On Thursday, January 15, 2009, a seventy six year old woman, Evelyn Duran, was struck by a big rig truck in San Francisco’s South of Market district. According to official reports, Ms. Duran failed to see a construction worker directing pedestrian traffic around Sixth and Stevenson streets. TRUCK STRIKES SCHOOL BUS IN SONOMA- BAY AREA ACCIDENT ATTORNEY CAN HELP

California Highway Patrol found part of Ms. Surles’ bumper at the scene of the accident, and traced it back to an auto body shop, who traced it back to Ms. Surles. According to official reports, Ms. Surles’ blood alcohol level was 0.19 and 0.20 percent. In addition to the hit and run charge, Ms. Surles was also charged with child endangerment because she had her five year old son in the car with her.

In another unrelated case, Lee David Harbert was sentenced to three years in jail for a hit and run accident which killed Gurdeep Kaur in Moraga approximately four years ago. Mr. Harbert hit Ms. Kaur with such force that her body shattered the windshield, the hood was crumpled and the hood’s ornament was snapped off.

CHILD REVIVED AFTER NEAR DROWNING IN FREMONT, CA

CHILDREN AND MENTALLY INSANE MAY BE LIABLE IN CIVIL LITIGATION IN CALIFORNIA

CALIFORNIA COURT RELEASES PATIENTS FROM PAYING FOR EMERGENCY ROOM DOCTORS NOT COVERED IN INSURANCE PLAN

MOVING TRUCK ACCIDENTS INJURE PASSENGERS IN OAKLAND, CA

MTC REPORT FINDS SAN FRANCISCO BAY AREA ROADS IN FAIR CONDITION- ROAD SAFETY IMPORTANT FACTOR IN ACCIDENTS

The report included an evaluation of approximately 42,000 miles of streets and roads in the Bay Area. The maximum possible score in the pavement condition index (PCI) is 100. The Bay Area rated at 65 in the 2005-2007 time period. Once the PCI reaches 60 points, then the roads and streets begin to deteriorate rapidly. The MTC has reported that roads in the 70-79 point range, which would mean that the pavement is in “good condition”, are less costly to maintain while those with a PCI of about 60 will cost more for rehabilitation or reconstruction.

A breakdown of certain Bay Area roads are as follows: twelve percent were rated “excellent”; twenty three percent were “very good”; twenty percent were “good”; twelve percent were “fair”; ten percent are “at risk of rapid deterioration”; fourteen percent were poor; eight percent failed. The Bay Area’s projected goal is to obtain a PCI of 75 by the year 2035. An approximate $7 billion has been directed to funding the maintenance of local roadways over the time period. The MTC also has reported that the Bay Area will have to double the current level of investment in maintenance of pavement.

CONSTRUCTION WORK PLACE INJURIES AMONG THE HIGHEST IN US AND CALIFORNIA JOBS

DRUNK DRIVING IN BAY AREA INCREASES, MAY RESULT IN WRONGFUL DEATH LAWSUITS

BART SHOOTING LEAVES HAYWARD MAN DEAD (Part 2 of 2)

Although trains themselves may be deadly and play a role in fatalities, there may be other incidents that occur near a train or station that may result in injury or death. The Bay Area Rapid Transit system (BART) faced two different incidents in the past week at the Oakland station and between the Walnut Creek and Lafayette stations.

On Monday, December 29, 2008, a fire broke out on the tracks between the Walnut Creek and Lafayette BART stations. The fire disrupted and slowed the service for the rest of the night. No one was reported to be injured in the incident. A 22 year old victim, Oscar Grant, was shot and killed by a BART officer on Thursday, January 1, 2009. According to official reports, there were two groups of people fighting on the train, and the BART officers were called to break up the fight. There were no weapons recovered at the scene and Mr. Grant was not armed.

CALTRAIN ACCIDENT RESULTS IN ANOTHER DEATH IN MOUNTAIN VIEW (Part 1 of 2)

Train crashes are a common occurrence in the United States, and other incidents involving the train system may also be increasing. A Caltrain, traveling southbound at around 6:15 p.m. on Wednesday night struck a pedestrian just north of Castro Street. Officials have reported that the pedestrian was standing on the tracks and even though the train engineer activated the emergency brakes, he was still unable to stop the train.
