MAJOR INJURIES AS RESULT OF CAR ACCIDENTS IN SAN FRANCISCO & SAN JOSE
Many car accidents are merely accidents—resulting from an uncontrollable element such as poor road design or weather conditions. However, many other car accidents are caused by the negligence of one or more drivers. Such negligence could range from failing to turn on one’s headlights in a rainstorm, to driving above the speed limit, to consuming alcohol before getting in one’s car. In cases involving a car and a pedestrian, there might be less negligence on the part of the pedestrian than that of the driver. These cases may cause the most damage to the pedestrian, even with a small amount of negligence. In San Francisco and San Jose over the last few days, there have been some significant car accidents involving pedestrians.
On Monday, January 26, 2009, two men were struck by a car near the intersection of Van Ness and Pacific Avenues. They were hit shortly before 2 a.m. by a San Francisco resident. One of the pedestrians stuck was San Jose resident, and he suffered injuries that were life threatening. The other pedestrian suffered minor injuries. The driver attempted to flee the site of the accident, but was stopped a block away by witnesses who detained him until police officers reached the scene. In an unrelated accident on the same night, an 81 year old woman was struck and killed in the Sunset District. She was walking across Santiago Street when she was struck. It is reported that there were no stop signs or traffic lights at that intersection.
On Monday morning in San Jose, a father and son were struck on their way to the boy’s school. They were walking in the crosswalk of Story Road and Adrian Way at approximate 8 a.m. The father and son were crossing a green light when they were struck. They both sustained injuries but are expected to survive. On Friday, January 30, 2009, police arrested the driver of the car, Marvin Martinez, on charges of felony hit and run.
Being involved in an accident is an especially difficult time for the victim and their family. Not only are they worrying about the victim’s condition, but may also be worried about how to cover the medical costs, or how the family will survive financially if the victim was the sole bread winner.
