A woman and man in the van with him were taken to the hospital; the woman is in critical condition but the man only suffered minor injuries. The drunk driver was San Jose resident Gary Westover, and was taken to the hospital with minor injuries. He was later arrested and charged with vehicular manslaughter and driving under the influence.
