A jury in Ventura County, California awarded $7.75 to Maria Arellano and her family on Friday, December 11, 2009 for an elder abuse cause of action. The lawsuit involved a videotape of Arellano being abused by an employee of the Fillmore Convalescent Center, Monica Garcia. Garcia pleaded no contest to simple battery and was attributed with 20% of the lawsuit damages. Arellano was a stroke patient who was unable to communicate her abuse; however, despite the lawsuit, she is still under the care of the same convalescent center. The family was awarded $2.75 million in actual damages and $5 million in punitive damages.

Elderly8.jpg The damages of this case were divided between the center (40%), the owner, Eduard Gonzalez (40%) and Garcia. During the lawsuit, the Arellano family met another stroke victim, Daniel Sanchez, who lived across the hall and who may have also been abused.
