SANTA CLARA JURY AWARDS MAN $49 MILLION IN PERSONAL INJURY DAMAGES FOR ACCIDENT ON PACHECO PASS WITH TWO TRUCKS

Jacob is still undergoing rehabilitation for his injures and has significant brain damage. His sister was also awarded money in the settlement for negligent infliction of emotional distress. As part of the settlement, Jacob and his family have agreed not to disclose the name of the fast food establishment.

SPINAL CORD SURGERY MAY LEAD TO MEDICAL MALPRACTICE CASE—CALL OAKLAND LAWYERS (Part 2 of 2)

Medical malpractice cases are lawsuits against doctors who have acted below a certain standard of care and negligently performed in a surgery, or in their regular business routine. A jury in Florida awarded an injured woman, Amanda Slavin, $38 million for injuries that she suffered as a result of a spinal cord surgery. Nanes operated on Slavin for a herniated disc and injected her with a chemical dye during the surgery to locate the leak. However, the instructions for the dye had been discarded by the hospital’s pharmacy management and the doctor did not read that the dye should not have been used in the particular surgery that Slavin underwent.

After the surgery, Slavin was diagnosed with a neurological disability called arachnoiditis and is bedridden because she gets excruciating pains shooting through her entire body. Nanes has been sued by nine other patients since the 1980s. The Department of Health in 2007 fined Nanes $10,000 for failing to practice medicine at the reasonable level that another physician in the same circumstances and same field would perform. The $10,000 fine was the maximum that the state could fine a doctor for each occurrence. The jury assigned Nanes 68 percent of the responsibility, 18 percent to Mount Sinai and 14 percent to the pharmacy management company.

HEAD INJURIES MAY BE CAUSED BY SERIOUS CAR OR TRUCK ACCIDENTS – CALL BAY AREA HEAD INJURY ATTORNEY NOW

There are different types of head trauma that can occur in a variety of settings, the most often of which in car or truck accidents. Other causes include assaults, falls and recreational activities (particularly for children). People can suffer head injuries from an object penetrating their head, or from a blunt force trauma, which means that an object hits the person, or the person hits the object. Both of these have their own dangers: in a penetrating trauma, the person will likely require surgery to remove all of the fragments from their head, and the initial injury may cause death; for blunt head traumas, there is the danger that the person does not recognize that he has been injured because there might not be blood, or pain immediately.

The different types of head traumas are skull fractures, intracranial hemorrhage, and closed head injuries.

  • Skull fractures occur when there is an actual break in the bone around the brain or the other structures inside the skull. There are three categories in skull fractures: linear skull fracture, depressed skull fracture and basilar skull fracture. In a linear skull fracture, the break in the skull usually forms in a straight line and is usually not a dangerous fracture in itself. There is an added danger if the brain is injured in this fracture. Depressed skull fractures usually occur when there is an impact from a blunt object to the head, such as a hammer or bat. Usually there are dents in the skull, which may or may not require surgery, depending on their depth. The last kind of fracture is the basilar skull fracture. This type of fracture involves the bones in the base of the skull, and may affect the sinus cavities.
  • Intracranial hemorrhage may occur in several different ways, but is generally an injury in which there is bleeding within the skull. The bleeding may occur between the brain tissue and the dura mater (the layer of tissue that is between the brain and the skull), or between the dura mater and the skull, or within the brain itself.
  • Closed head injuries indicate injuries that are suffered when there is no penetrating object or dent caused by the impact. This includes a concussion, which is commonly known to many. These closed head injuries can range from minor injuries to potentially fatal ones.

PEDESTRIAN KILLED BY CALTRAIN IN MOUNTAIN VIEW. THIRD SAN MATEO COUNTY CALTRAIN ACCIDENT IN EIGHT DAYS. 13 CALTRAIN DEATHS THIS YEAR.

A third person has been struck by a Caltrain in an 8 day period on the Peninsula. The two other train-related crashes (one killed a truck driver and the other hospitalized a woman with head injuries) have been addressed in previous blogs. In this latest crash, the pedestrian was hit by a Cal train while crossing railroad tracks in Mountain View. He later died. 13 people have died this year in Caltrain crashes. The three recent Caltrain collisions have all occurred in San Mateo County. SAN FRANCISCO PEDESTRIAN, BICYCLE & CAR CRASH DEATHS & INJURIES INCREASE DRAMATICALLY

The most recent SF Collision report, compiled by the San Francisco Municipal Transportation Agency from CHP statistics, shows a disturbingly high rise in traffic-related injuries and deaths. In 2007 pedestrian accidents were up more than 50%, composing more than half of all traffic deaths. Bicycle-related crashes rose over 30%. Vehicle-related deaths are also up over 50%, while injuries from accidents involving motor vehicles are also on the rise. Injuries incurred in road accidents can include brain and spinal injuries, broken limbs, burn injuries, paralysis and laceration. The report also showed that certain SF intersections are particularly dangerous for walkers. Additionally, as previously blogged, Muni buses are posing a growing threat to SF residents with two deaths already this year. With the spike in road injuries and deaths, some city officials point to the increasing number of people choosing alternatives to car travel. Nevertheless the high number of injuries and deaths is alarming for anyone using San Francisco streets. Here are some more 2007 statistics from the report:

# of Non-fatal Pedestrian injuries: 800
# of Non-fatal Bicycling injuries: 450
# of Pedestrian deaths: 32
# of Pedestrian deaths involving Muni buses or streetcars: 8

What else may be to blame for the grim stats? Poor road design and maintenance including a lack of bike lanes, hidden traffic signs, or poorly visible crosswalks may be a factor. Drivers may also be responsible, especially those who disobey the law by speeding, running red lights and stop signs; or those drivers who are not paying enough attention on the road, distracted by cell phones or other things. There is no doubt that both SF pedestrians and drivers need to be cautious and take care on the road. DANGEROUS, RECKLESS & DRUNK DRIVING ON BAY BRIDGE A THREAT TO CITIZENS

A special report by Channel 2 (KTVU) looked into a frightening Bay Area menace: extremely dangerous driving behavior on the Bay Bridge. The Bridge connects San Francisco to the East Bay, and as discussed in an earlier blog, Bay Area Bridges pose a number of hazardous factors to drivers. In their report, the news channel brings up yet another danger: drunk drivers racing and swerving across the San Francisco – Oakland Bay Bridge on the weekends, often while under the influence. Accidents involving high speed impact can have devastating results including brain and spinal cord injuries, paralysis, burn-related injuries, broken arms or legs, and death. According to the CHP, since Jan 2007 nearly 365 people have been arrested for DUI's on the Bridge in early morning hours – from 1am to 6am, and most of these occur on Friday and Saturday mornings. In August a passenger in the back seat of a Mercedes was killed when a Subaru Impreza going over 100 mph smashed into him. The speed limit on the bridge is 50 mph; however, KTVU's investigation spotted many cars traveling at over 80 mph, some more than 90 mph. The driving which threatens law abiding bridge users is reckless, with dangerously high speeds, lack of signaling during lane changes, abrupt lane changes, and frequently influenced by drugs and/or alcohol.
