BURNS CAN BE CREATED BY SEVERAL DIFFERENT FORMS—DO YOU HAVE BURN INJURIES AND WANT TO BE COMPENSATED? CALL SAN JOSE FIRM GREENBERG & RUDMAN LLP FOR FREE CONSULT (Part 2 of 2)

Burn injuries are not only caused by fire, but can be caused by electricity, chemicals, light, radiation or friction. These burns can affect the muscle, bone and nerves, and the injuries may scar the person physically and emotionally. Burns can be classified by different degrees, with first degree burns being the least serious and fourth degree burns being the most serious, and potentially threatening the life of the victim. If you have been injured in a burn accident, then you need to call the attorneys of Greenberg & Rudman LLP now for a free consultation at 1-800-252-9776 (1-800-ALAWPRO).

First degree burns generally only affect the epidermis, and includes redness and slight pain to the area. Second degree burns affect the dermis and may cause blistering of the skin or nerve damage. Third degree burns damage the epidermis and subcutaneous tissue. Third degree burn victims may require skin grafting and may suffer loss of hair shafts. Fourth degree burns include damaged muscles, tendons and ligament tissue and may result in permanent damage to the hypodermis tissue. Many of these injuries are caused by cooking or scalding hot water, but some may be caused by house fires. When there is a fire involved, then doctors would likely treat the victim for smoke inhalation and possibly burn injury to the lungs.

Personal injury lawsuits require some element of negligence or recklessness by the wrongdoer. This kind of negligence can include improper maintenance by a landlord of your fireplace or electrical system. To learn about your rights and whether you have a personal injury case, you should call the experienced attorneys of Greenberg & Rudman LLP for a free consultation. INJURED BY A BURN ACCIDENT? NORTHERN CALIFORNIA ATTORNEYS CAN HELP (Part 2 of 2)

Third degree burns are the most serious type of burn as it involves burning all layers of the skin and may damage tissue permanently, as well as fat, muscle and bone. The burned area can either appear black and charred or white and dry. For these types of burns, it is recommended that you call emergency medical assistance. While waiting for medical assistance, it is recommended that you do not remove burnt clothing, or immerse the burns in cold water. Fourth degree burns affect the muscle, tendon and ligament tissue and will result in grafting, and may often times be fatal.

There are several different ways to receive burns, aside from the usual hot water or stove burns. Burns can be caused by chemicals, electrocution, or radiation. Chemical burns usually occur with chemicals that are strong acids or bases, and can cause damage down to the bone. Electrical burns are caused by electric shock, which includes lightning (although rare); burns caused by electrical shock and the damage caused are not always evident. Radiation burns are caused by extensive exposure to UV lighting, which includes tanning booths, sunlamps, X-rays, and radiation therapy. The most common type of these burns is from over exposure to the sun.

Different dangers are associated with burns which are not always as evident as something like a burn blister. Burns occurring during a fire may cause damage by way of smoke inhalation, or other cardiovascular injuries. There is also a chance of infection or tetanus after the burn. There are several different ways for a person to be burned and injured, and it may be difficult to determine if you are entitled to money in a lawsuit until you speak to a qualified attorney. Call Greenberg & Rudman LLP now to receive a free consultation about your case. Other burn and liability information is available on our website at www.alawpro.com. BURNS CAUSE HIGH INCIDENCE OF DEATH IN CHILDREN— SAN FRANCISCO BURN INJURY ATTORNEYS (Part 1 of 2)

Burns can be caused by common, everyday duties, such as cooking, lighting the fireplace or even bathing. They can also result in different degrees of burns that require treatment ranging from running the burned area under cold water to visiting an emergency room for proper treatment. Burns are defined as being a first, second or third degree burn. First degree burns are the least serious types of burns in which the most outer layer of skin is burned. The signs are if the skin is red and swollen, but the outer layer has not been burned completely through. Second degree burns occur when the outer layer is burned through and the second layer is burned as well. These burns cause blistering, swelling, pain and redness.

Children can also be easily scalded by bathwater, especially for slightly older children who are able to reach the hot water knob and turn it on their own. Burns result in hospitalization of over 40,000 children each year, and over 1000 deaths. To prevent such injuries in the bath tub, it is recommended that the thermostat on the hot water heater be turned down to 120 degrees Fahrenheit, to prevent the possibility altogether.

The Mayo Clinic suggests that for minor burns (first and second degree burns) which are no larger than three inches in diameter, one should cool the burn by holding it under cold water, or immersing it in water for at least five minutes. Then, the burn should be loosely covered with sterile gauze bandage, as it will keep air off the burn and protects the blistered skin. Lastly, an over the counter pain reliever can be used, such as aspirin or ibuprofen. It is not recommended that you use ice, butter, or ointments on the burn.

When an adult, or a child has been severely burned they or their family members should seek legal counsel and learn about their rights. Greenberg & Rudman LLP has experience in representing individuals in burn injuries, among others; call us now at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation. CAR ACCIDENTS AND DROWNINGS CAUSE MOST FATALITIES IN CHILDREN—CALL NORTHERN CALIFORNIA ATTORNEY ABOUT YOUR CASE

The World Health Organization (WHO) and Unicef issued a report on childhood deaths caused by accidents on Tuesday, November 9, 2008. The report stated that accidents kill 830,000 children around the world each year. The most common fatal injuries across the globe are drowning, burns, traffic accidents, falls and poisoning. The report included statistics on poor, middle income and wealthy countries. Although measles or pneumonia are very common causes of death in poor countries for infants, once children learn to walk, accidents rise to the top ten causes of death. Once children reach the teenage years (15 to 19 years old), the leading causes of death include: traffic accidents, drowning, fire, falls and poison.

In the United States, 12,175 children die each year from accidents, more than all diseases combined. Car crashes are the leading cause of death for children, while infants are more likely to die of suffocation and children between one and four more likely die drowning. Twice as many boys died accidentally than girls in the United States. Fatal injuries were the highest for American Indians, equal for blacks and whites and lowest for Asians.

Many of these accidents can be prevented by implementing certain laws such as requiring children to sit in booster seats until they are older or raising the driving age. Oftentimes children need an advocate to help them seek justice in cases of negligence, or recklessness. Greenberg & Rudman LLP can provide that voice for children and their families. Please call us at 1-800-252-9776 (1-800-ALAWPRO) and speak to one of our experienced attorneys about your case. Visit our website www.alawpro.com for more information.

More than ever, conscientious Bay Area citizens are leaving their cars at home and opting to ride their bicycles and walk. What's greenest in this case; however, may not always be safest. A Contra Costa cyclist died in a hit-and-run near Martinez, CA in late November. Traveling by bike near Highway 4 in the early evening, the man was struck by a car and left for dead. Some riders even claim that bicycle lanes pose even more hazards to bike riders, as car often do not follow the laws set for bike lane travel. Needless to say, cyclists must be on alert on all roads at all times.

TWO WRONGFUL DEATH SETTLMENTS REACHED BY SAN FRANCISCO BOARD OF SUPERVISORS FOR VICTIMS OF TAXI CRASH AND NOB HILL FIRE.

In two separate SF incidents, families of men who were killed sued the city for wrongful death. San Fran's Board of Supervisors approved compensation to the families totaling over $1.8 million. The financial settlements are awaiting final approval from the Mayor. While the city of SF admits no liability in either case, $1,695,000 was awarded to the family of a man who died in a taxi cab accident after being treated at SF General, and $150,000 was awarded to the estate of a man who died during a botched fire rescue attempt. To learn more about wrongful death, please see our webpage. If you believe someone close to you has been the victim of a wrongful death in the Bay Area, please call 1-800-ALAWPRO to speak with an attorney for free or visit our website at www.alawpro.com.

In the larger settlement, a Michigan man died a month after he was in a taxi crash in 2006. The lawsuit filed by the victim's family claimed that the man received “misdiagnosis and improper care” from San Francisco General Hospital. He died a month after the accident. The other settled case was filed on behalf of a man who died when he fell from a 4-story Nob Hill apartment building during a fire. The victim fell to his death as a fire fighter was trying to pull him to safety from a rooftop fire escape ledge. His family's lawsuit alleged that the firefighter attempting the rescue behaved inappropriately by acting recklessly, disregarding command structure and ignoring safety protocol. Cases of wrongful death can include medical and/or safety and rescue professional mistakes (as in the above instances), vehicular accidents, work-related incidents, and criminal attacks.

SAN FRANCISCO PEDESTRIAN, BICYCLE & CAR CRASH DEATHS & INJURIES INCREASE DRAMATICALLY

The most recent SF Collision report, compiled by the San Francisco Municipal Transportation Agency from CHP statistics, shows a disturbingly high rise in traffic-related injuries and deaths. In 2007 pedestrian accidents were up more than 50%, composing more than half of all traffic deaths. Bicycle-related crashes rose over 30%. Vehicle-related deaths are also up over 50%, while injuries from accidents involving motor vehicles are also on the rise. Injuries incurred in road accidents can include brain and spinal injuries, broken limbs, burn injuries, paralysis and laceration. The report also showed that certain SF intersections are particularly dangerous for walkers. Additionally, as previously blogged, Muni buses are posing a growing threat to SF residents with two deaths already this year. To learn more about car, motorcycle, bus, bike and pedestrian accidents, please visit our website www.alawpro.com. If you or a loved one has been hurt in a SF road accident, please call 1-800-ALAWPRO to speak with a lawyer for free.

With the spike in road injuries and deaths, some city officials point to the increasing number of people choosing alternatives to car travel. Nevertheless the high number of injuries and deaths is alarming for anyone using San Francisco streets. Here are some more 2007 statistics from the report:

# of Non-fatal Pedestrian injuries: 800
# of Non-fatal Bicycling injuries: 450
# of Pedestrian deaths: 32
# of Pedestrian deaths involving Muni buses or streetcars: 8

What else may be to blame for the grim stats? Poor road design and maintenance including a lack of bike lanes, hidden traffic signs, or poorly visible crosswalks may be a factor. Drivers may also be responsible, especially those who disobey the law by speeding, running red lights and stop signs; or those drivers who are not paying enough attention on the road, distracted by cell phones or other things. There is no doubt that both SF pedestrians and drivers need to be cautious and take care on the road. Following are some of the San Francisco intersections cited as being repeatedly dangerous for walkers, bikers and drivers:

Gough & Market
Market & 6th
Oak St. & Octavia Blvd.
Bayshore Blvd. & Silver Ave.
Mission St. & Silver Ave.
19th Ave. & Junipero Serra Blvd.
19th Ave. & Sloat Blvd.
13th St. & South Van Ness

ARE YOU ENTITLED TO MONEY AS A RESULT OF AN INJURY OR ACCIDENT? CONTACT A BAY AREA LAWYER NOW

If you have been involved in a car accident, or have a personal injury claim such as a slip and fall, then you may be entitled to monetary compensation, or according to the legal term “damages”. The purpose of awarding damages to the injured party is to make him/her whole again, by compensating him/her for his/her injuries caused by the action of the defendant. There are two main categories of damages: compensatory and punitive. Under compensatory damages, there are both pecuniary and non-pecuniary damages. Pecuniary damages may include the cost of repair or replacement of property, medical treatment, or lost wages. Non-pecuniary damages include non-economic harm, such as pain and suffering. Punitive damages are used by the courts to award damages to the plaintiff if the defendant committed the injury maliciously.

For example, if Daniel the Defendant crashed his car into Patty the Plaintiff and broke her leg as a result of the accident, she may be able to sue him for both compensatory and punitive damages. Patty’s compensatory damages might include any damage to her car, any costs for medical treatment that she paid out of pocket, and the wages that she was unable to earn because she was recovering from the broken leg. She may also be able to recover punitive damages if Daniel crashed into her car on purpose, or maliciously wanted to cause her harm.
