LARGE VEHICLES CAUSE DAMAGE ON ROADWAYS IN SACRAMENTO AND LIVERMORE

Large vehicles like big rigs and trucks are ever present on our roadways, and even though the drivers are specially trained, there are still accidents that can cause a lot of damage. These large trucks and vans may be harder to control in bad weather, and may not be susceptible to a quick change of course in case of an emergency. These vehicles may also hold dangerous cargo, like gasoline or toxic materials that can be extremely dangerous if involved in a crash. Have you or a loved one been injured by a truck or a bus, and want to obtain compensation for your injuries? Then you should contact the lawyers of Greenberg & Rudman LLP for a free consultation of your case at 1-800-252-9776 (1-800-ALAWPRO).

On February 4, 2010, a garbage truck and van were involved in an accident in Sacramento. The collision caused the truck to crash into a child day care center. Both drivers had to be extricated from the vehicles, and the driver of the van died, but no children were harmed. In another unrelated accident on the same day, a driver of a BMW, Beiru Chen, was driving the wrong way on Highway 580 and caused a major collision. Chen was driving the wrong way in the left lane, and lost control of her car. The car crashed into two big rigs, one carrying contaminated soil, and the other diesel fuel. Chen was injured and airlifted to a hospital, but the drivers of the big rigs were not injured.

Livermore.jpg Investigators have indicated that alcohol does not seem to be a factor in the second accident, and are still investigating why Chen was driving the wrong way on the freeway. The highway was blocked for several hours while crews cleaned up the scene. Being involved in a car accident can have detrimental effects on your health, career and family, but you’re not alone in this ordeal. The lawyers of Greenberg & Rudman LLP may be able to help you. We may not be able to undo your injury or bring back a loved one, but we can help you file your lawsuit and possibly obtain compensation for your injuries. Contact us now to get a free consultation with an experienced attorney at 1-800-252-9776 (1-800-ALAWPRO). Or, you can go to www.alawpro.com to read more about truck and bus accidents.

TRUCK HITS AND KILLS BICYCLIST IN REDWOOD CITY; SCHOOL BUS HITS CHILD ON BIKE IN OAKLAND

Driving large vehicles takes special skill and practice because of the dangers that accompany the task. Vehicles like big rig trucks and buses have large blind spots where the driver cannot see other vehicles or people in certain areas. Additionally, these vehicles may turn differently than smaller vehicles and may not be able to stop very quickly or avoid hitting another vehicle. If trucks and buses are involved in personal injury lawsuits because of the negligence of the driver, then the owner of the truck and bus may be liable for the accident, as well as the driver.

In an incident on October 12, 2009, a bicyclist was hit and killed by a dump truck in Redwood City. The incident occurred at 7:51 a.m. in the intersection of Shoreway Road and Holly Street. The woman on the bike tried to pass the dump truck as it turned onto Holly Street but was hit instead. A part of the dump truck rolled over her and killed her. The driver of the truck left the scene of the accident, and when authorities found him, he stated that he did not know that he had hit a person. On October 16, a boy was hit in Oakland by a school bus as he rode his bike to school. The boy suffered injuries to his leg.

Trucks and buses can do incredible damage to the passengers onboard as well as the vehicles or people that they hit. These injuries may range from cuts and scrapes to brain injuries to deaths. Have you or a family member been involved in a car accident with a bus or truck? Then you need to pick up the phone and call the law firm of Greenberg & Rudman LLP at 1-800-252-9776 (1-800-ALAWPRO) for your free and confidential consultation. BUS DRIVER ERROR MAY RESULT IN INSURANCE CLAIMS AND NEGLIGENCE LAWSUITS IN SOLEDAD, CALIFORNIA CRASH

Insurance companies provide drivers with protection in case of accidents in which they injure others, or injure themselves. This is why many states require that drivers have car accident insurance in order to drive legally. Insurance policies may range from the very basic, which would include property damage done to other cars, to the maximum coverage, which would include property damage for the parties involved, as well as potential coverage of physical injuries. People who might be driving vehicles as part of the employment, such as truck drivers, or delivery men, are covered by their employers, whose insurance would be ultimately responsible for mistakes made in the course of employment.

Several weeks ago, there was a tour bus accident that occurred on Interstate 101 on the overpass in Soledad. The bus was carrying thirty four French tourists when the bus hit a guardrail and overturned. The driver of the bus, John Egnew, the tour guide and four tourists were killed in the crash, and many more were hospitalized with injuries. Since the accident occurred, CHP has conducted investigations of the crash and have determined that the crash was a result of driver error because Egnew failed to negotiate a curve, which caused the bus to overturn. In this situation, Egnew’s employer and the owner of the bus company would likely be responsible for any injuries that occurred. Any lawsuits arising from the French tourists would likely be handled through the bus and the driver’s insurance companies.

Soledad.jpg Large insurance companies may be difficult to deal with if you are handling your own case, or are trying to recover without a lawsuit. The best way to deal with insurance companies who are uncooperative is to obtain legal counsel of your own. Have you or a loved one been injured on a bus or in a motor vehicle accident? If so, you need to call the attorneys at Greenberg & Rudman LLP now for a free consultation. Our attorneys can tell you your rights and can give you legal advice on how to proceed. BUS DRIVER OF ACCIDENT HAD PREVIOUS PEDESTRIAN ACCIDENT – CALL SF BAY AREA BUS ACCIDENT INJURY LAWYERS NOW (Part 2 of 2)

After the deadly bus accident on Highway 101 on April 29, 2009, it was discovered that the driver, John Egnew, had been involved in another accident in 2005, also involving a bus that he was driving. Unfortunately, Egnew was one of the victims ejected from the bus and ultimately died from neck and head injuries. The 2005 accident occurred in Las Vegas when Egnew hit Joan Smith and her husband as they were crossing the street. Egnew admitted not seeing them until he hit them; the bus continued to roll on top of Smith and then backed off of her. Smith fell backward on the pavement and sustained brain injuries and a fractured pelvis. The bus was owned by Weeks Enterprises, which also owned the bus that he was driving in the Monterey accident.

After the 2005 accident, Smith and her husband sued Weeks Enterprises for the injuries that she suffered from the bus crash. The lawsuit settled for $750,000. Federal records show that Weeks Enterprises, which owns Orion Pacific, has held a clean record for the last two years. There have been no reported accidents in any of the states and there have not been driver or bus problems. Orion Pacific received an audit of its vehicles in 2006 and received the highest rating possible. The tourists who were onboard have said that they felt there was something wrong with the vehicle, and that it was going too fast. These tourists may bring lawsuits against the owner of the bus and the employer of the driver for their damages. However, their cases will depend on why the accident occurred and whether or not the driver was actually negligent in the accident. If the accident occurred as a result of a wheel malfunction, or some other part of the car, then the tourists may be able to obtain compensation from the manufacturer of the bus, and might not be able to recover from the driver or his employer.

Bus4.jpg In order to fully determine whether or not you have a lawsuit on your hands, it would be best for you to contact an experienced lawyer as soon as possible. The attorneys at Greenberg & Rudman LLP have had over fifty years of experience and represent people who have been seriously injured as well as the families of those who have been killed under wrongful death circumstances. FIVE DEAD IN HIGHWAY 101 BUS CRASH IN MONTEREY, CALIFORNIA (Part 1 of 2)

Bus accidents can cause extreme injuries and pose liability to the owners of the bus. The sheer size of the bus can cause major injuries and even death to the passengers and vehicles around the bus. The owner of the bus could be liable for the injuries, as well as the driver, and his employer. Most buses are operated by metropolitan transit systems, which are owned and operated by the city or county. However, there are also other privately owned buses that are used primarily for tours or trips. In these cases, there might be liability to the company conducting the tour, the driver, and his employer, and the owner of the bus. If you have been injured in a bus accident, you need to call Greenberg & Rudman LLP now at 1-800-252-9776 (1-800-ALAWPRO) for a free and confidential consultation.

On April 29, 2009, five people died and dozens of others were injured on Highway 101 in Monterey in a bus crash. The accident happened on southbound Highway 101 overpass in Soledad. The bus belonged to Orion Pacific and hit a guardrail and overturned. There were three people dead at the scene and two later pronounced dead at local hospitals. The California Highway Patrol has reported that many people were ejected from the bus and landed on the railroad tracks under the overpass. There were approximately thirty six passengers and one driver onboard the bus. The passengers on board were French tourists, whose tour had begun in Los Angeles a few days earlier. That stretch of the highway was closed for the remainder of Tuesday and remained limited in its use until Wednesday.

Monterey2.jpg Bus accidents can be attributed to several different reasons. One of the most common may be driver error, in which the driver fell asleep at the wheel, or was intoxicated or was not trained properly to drive the vehicle. Other reasons may include bad road conditions, weather or problems with the vehicle itself. The attorneys at Greenberg & Rudman LLP specialize in personal injury cases, and have won over $150 million in verdicts and settlements. WOMAN WITH AMPUTATED LEG WINS MILLIONS AGAINST CITY TRANSIT AGENCY—HAVE YOU BEEN INJURED IN A BUS ACCIDENT? CALL BAY AREA LAWYERS (Part 2 of 2)

Bus drivers have a big responsibility because of the large size of their vehicle and because more buses are likely to exist in larger cities with more people, which increases the chance of accidents. Bus drivers must not only pay attention to the road, but are also responsible for occurrences inside of the bus. For example, a fight between passengers on the bus may affect the driver’s ability to maneuver the vehicle safely, and would require the driver to take a certain course of action. Have you been injured in a car accident? Call Greenberg & Rudman LLP now for a free consultation at 1-800-252-9776 (1-800-ALAWPRO).

A woman, Gloria Aguilar, in New York won a jury trial against the New York City Transit for $27.5 million. The lawsuit arose from an accident that occurred in 2005 when a bus ran over Aguilar’s leg and crushed it. Aguilar had to have her leg amputated below the knee after the accident, but two weeks later, there was an infection in her leg and she had to have the rest of it amputated to the groin. Although the jury found that Aguilar was negligent because she did not look both ways before crossing the street, it still attributed full responsibility to New York City Transit. It was also contended that Aguilar was outside of the pedestrian crosswalk when she was struck. The New York City Transit will likely appeal the verdict. The damages that Aguilar received will likely be to take care of her medical condition for the rest of her life, and to compensate for the fact that she has not been able to work since the accident.

Losing a loved one can be incredibly tough. We do not have the power to undo an injury or bring back a loved one, but we can help you seek compensation. We are committed to obtaining compensation for victims injured by the negligence of others. We have obtained over $150 million in verdicts and settlements against large corporations and insurance companies. LOCAL, STATE GOVERNMENT COULD BE RESPONSIBLE FOR SOME BUS ACCIDENTS—CALL SAN FRANCISCO BUS ACCIDENT INJURY LAW FIRM NOW (Part 1 of 2)

Although bus accidents may not happen as frequently as car or motorcycle accidents, they can still do a lot of damage. The size of the bus and the number of passengers that a bus could potentially contain are two factors that could make bus accidents deadly. Bus accidents are also special because many buses are owned and operated by local or state governments, and others are owned and operated by private companies. This means that for victims involved in bus accidents, they could potentially hold the government responsible for their injuries. However, this does depend on the circumstances of each case and who was ultimately responsible for the accident.

In a 2007 report provided by the California Highway Patrol’s Statewide Integrated Traffic Records System, there were approximately thirty-seven fatal bus accidents; five of those accidents were school buses. In about thirteen of the bus accidents, the drivers were at fault. There were also almost 1,800 injury collisions involving buses, and about 400 of those involved school buses. Approximately 36% of the injury accidents occurred because it was the driver’s fault.

TRUCK STRIKES SCHOOL BUS IN SONOMA- BAY AREA ACCIDENT ATTORNEY CAN HELP

Subprime road conditions are often made even worse by winter weather, such as fog, rain and ice. Accidents may occur because of weather, pavement conditions or driver negligence. Based on a memorandum provided by the California Highway Patrol, 106 people in California last year were killed in collisions that occurred in rainy, snowy or foggy weather. The CHP has recommended some of the following tips for safe driving in such weather: reduce your speed, and slow down significantly when you encounter fog; make sure that your windshield wipers are in good condition; make sure that your headlights are on when your windshield wipers are on; be sure that you have emergency supplies in your car at all times.

In Sonoma County on Thursday, January 15, 2009, a Toyota Tundra struck a school bus at the intersection of Llano Road and Highway 116. Fortunately, there were no students aboard the school bus at the time of the collision. The bus driver, Rian Studebaker, failed to stop at a stop sign and overturned when it was struck by the Tundra. In another crash on the same day, Nicole Gibbs crashed her car into a tree near Bohemian Highway near Tyrone Road. She was taken to the hospital and is in stable condition.

School%20Bus2.jpg Victims injured in car accidents should learn about their rights; the best way to efficiently do that is to contact an experienced attorney right away. LOS ALTOS, SANTA CLARA AND DUBLIN AMONG CITIES WITH BEST ROAD CONDITIONS IN NORTHERN CALIFORNIA

There are several different factors that contribute to car, bus and big rig truck accidents. One of these factors is the condition of the road on which the accident occurred. Road design and maintenance is an important part of driver safety, and the government conducts reports from time to time in order to monitor road safety. On Monday, January 5, 2009, the Metropolitan Transportation Commission released a report which stated that Bay Area roads remained in fair condition, similar to their report in 2006. It also reported that the worst pavement conditions were in Sonoma and Marin counties, Suisun City and Rio Vista in Solano County, Orinda, Richmond and El Cerrito.

The best pavement conditions were in Los Altos, Brentwood, Foster City, Santa Clara, Contra Costa County, Gilroy, Dublin, Oakley and the city of Sonoma. San Mateo has increased its PCI average of six percent, which is the most improved among the different Bay Area cities. Foster City’s PCI are consistently in the 80 or higher range. Road conditions play a variety of roles in car accidents, ranging from being the cause of an accident to preventing an accident from getting any worse.

INJURED IN A ROLLOVER ACCIDENT? CONTACT AN EXPERIENCED BAY AREA PERSONAL INJURY LAW FIRM NOW (PART 1 OF 2)

According to a report published by the National Highway Traffic Safety Administration (NHTSA), the increasing popularity of sport utility vehicles (SUV) has contributed to the overall increase of rollover accidents. The Characteristics of Fatal Rollover Crashes, was published in 2002 by the NHTSA, and included some of the following statistics:

  • Rollover crashes make up about 20% of all fatal crashes.
  • Most fatal rollover accidents are single vehicle crashes.
  • Speed is a substantial factor in rollover accidents, with most rollover accidents occurring on roads with speed limits of 55 miles per hour or higher.
  • Between 1991 and 2000, the number of rollover accidents has more than doubled.

The NHTSA report also looked at several causes of rollover accidents and the fatalities that occurred. In over three-fourths of the fatalities, the victims were not wearing seat belts. The study also found that in most of the accidents, the vehicles were either traveling straight forward, or were trying to maneuver a curve. Additionally, more than one-fourth of fatal rollover crash drivers did not attempt any kind of avoidance maneuver.

The Bay Area boasts 7 bridges used in packed daily commutes around town: the Golden Gate Bridge, San-Francisco Oakland Bay Bridge (aka The Bay Bridge), Dumbarton Bridge, Carquinez Bridge, Benicia-Martinez Bridge, San Mateo Hayward Bridge, and Richmond San Rafael Bridge. Traffic, construction, poor driving, weather, and multiple exits are all factor that can contribute to bridge-related crashes. With NoCal's high number of bridges and enormous number of commuters, bridge accidents are a weekly and sometimes daily occurrence. If you or a loved one has been injured or killed in a Bay Area bridge accident, please call 1-800-ALAWPRO to speak with an attorney at no cost, or visit our main website at www.alawpro.com for more information.

The Bay Area's bridges are a crucial piece of its transportation network. No Cal bridges are in constant use by cars, trucks, motorcycles, buses, bicycles and pedestrians. ALAMEDA, CA PEDESTRIAN CRASH LAWYERS

Alameda, a small island on the east side of the San Francisco Bay, is home to approximately 75,000 residents. Getting in and out of Alameda requires ferry, bridge or tunnel access for cars, motorcycles, pedestrians, bicycles, and all other vehicles. I-880 makes Alameda quite accessible as well with an exit a few short minutes from town. With a speed limit of 25 mph, Alameda would seem like an idyllic spot for those on foot; however, non-locals exiting the 880 into Alameda don't always obey or know about the decreased speed. If cars, buses and trucks don't slow down, the results can be dangerous and deadly for Alameda pedestrians. Have you or a loved one been injured in an Alameda accident? Then please call 1-800-ALAWPRO to speak with an attorney at no cost.

Alameda can be accessed by the U.S.’s only pedestrian and bicyclist drawbridge, as well as motor vehicle bridges at Park, High and Fruitvale Ave., tunnels at Harrison (the Posey Tube) and Webster. Public transit for Alameda residents includes two ferry services, Harbor Bay and Alameda-Oakland, as well as bus service provided by AC (Alameda County) Transit. But walkers and bikers beware! Advocate groups have had to take on the cause of protecting non-vehicular road users. Drivers exiting into Alameda from 880 can injure pedestrians. Accidents involving pedestrians are often fatal and injuries can include broken limbs, head and neck injuries, as well as severe lacerations.

SAN FRANCISCO PEDESTRIAN, BICYCLE & CAR CRASH DEATHS & INJURIES INCREASE DRAMATICALLY

The most recent SF Collision report, compiled by the San Francisco Municipal Transportation Agency from CHP statistics, shows a disturbingly high rise in traffic-related injuries and deaths. In 2007 pedestrian accidents were up more than 50%, composing more than half of all traffic deaths. Bicycle-related crashes rose over 30%. Vehicle-related deaths are also up over 50%, while injuries from accidents involving motor vehicles are also on the rise. Injuries incurred in road accidents can include brain and spinal injuries, broken limbs, burn injuries, paralysis and laceration. The report also showed that certain SF intersections are particularly dangerous for walkers. Additionally, as previously blogged, Muni buses are posing a growing threat to SF residents with two deaths already this year. To learn more about car, motorcycle, bus, bike and pedestrian accidents, please visit our website www.alawpro.com. If you or a loved one has been hurt in a SF road accident, please call 1-800-ALAWPRO to speak with a lawyer for free.

With the spike in road injuries and deaths, some city officials point to the increasing number of people choosing alternatives to car travel. Nevertheless the high number of injuries and deaths is alarming for anyone using San Francisco streets. Here are some more 2007 statistics from the report:

# of Non-fatal Pedestrian injuries: 800
# of Non-fatal Bicycling injuries: 450
# of Pedestrian deaths: 32
# of Pedestrian deaths involving Muni buses or streetcars: 8

What else may be to blame for the grim stats? Poor road design and maintenance including a lack of bike lanes, hidden traffic signs, or poorly visible crosswalks may be a factor. Drivers may also be responsible, especially those who disobey the law by speeding, running red lights and stop signs; or those drivers who are not paying enough attention on the road, distracted by cell phones or other things. There is no doubt that both SF pedestrians and drivers need to be cautious and take care on the road. Following are some of the San Francisco intersections cited as being repeatedly dangerous for walkers, bikers and drivers:

Gough & Market
Market & 6th
Oak St. & Octavia Blvd.
Bayshore Blvd. & Silver Ave.
Mission St. & Silver Ave.
19th Ave. & Junipero Serra Blvd.
19th Ave. & Sloat Blvd.
13th St. & South Van Ness

SF MUNI BUS CRASHES & CABLE CAR ACCIDENTS RISE SHARPLY IN 2008.

In startling new information released by the San Francisco Municipal Transportation Agency, pedestrian and other accidents involving Muni streetcars, cable cars, and buses are increasing dramatically. As a result, Muni is searching for safety consultants, which may be too little too late for those already devastated by loss from Muni accidents. With over 300 claims just this year, Muni has paid out millions this year to crash victims, passengers and employees. . Have you or a loved one been involved in an SF Muni bus or street car accident? Then you may be entitled to compensation for your injuries. Please call a San Francisco attorney for help at 1-800-ALAWPRO now. To learn more about public transportation and motor vehicle accidents as well as workplace injuries, go to www.alawpro.com.

The new information from SF’s Transit agency is shocking. Pedestrian accidents have nearly doubled in the past year, while bike, car, bus, and passenger crashes are also on the rise. In addition, Muni employees are also being hurt on the job at a higher rate. In the past 3 years, 18 deaths have resulted from Muni crashes, including two deaths this year, by cable car (see our blog about a fatal cable car accident this past month) and street car. Also, bicycle and passenger accidents have seen a sharp increase. Municipal authorities concede that a culture of Muni driver aggressiveness and carelessness may be a contributing factor to the high number of accidents.

Other than needless injuries and fatalities, an additional outcome from the Muni incidents has been the large number of claims and settlements to victims of Muni-related accidents. Over $4.8 million was paid out to Muni crash and passenger victims last year alone. There were more than 300 accident-related and work compensation claims filed in 2007. Worker injury has also led to large payments, more than $17 million. This is all the more reason to get legal help immediately if you have been involved in an SF bus or streetcar accident on the street or on the job.

The new statistics from the SFMTA cite injuries and deaths resulting from (1) crashes involving pedestrians, bicycles, other vehicles (cars, vans, trucks, other Muni buses) and animals; and (2) passenger boarding and on board Muni vehicles). Here is the list of the number of Muni incidents since 2005 from the San Francisco Examiner:

SAN JOSE ACCIDENTS: MERGING ONTO A HIGHWAY

While connecting to Highway 87 from I-280, a man in a Chevy pick-up truck crashed into another car. The collision threw the 27-year-old victim from his car, and he died at the scene. Merging onto a highway from a connector or onramp is one of the most dangerous and frightening parts of Northern California driving. While Bay Area freeways are nearly a must for getting around, they can be extremely hazardous for a variety of reasons. If you have been injured in a freeway-related accident, please visit our website at www.alawpro.com or call us at 1-800-ALAWPRO to receive a free consultation with an attorney.

The victim, a San Jose man, was driving southbound on 280 attempting to merge onto southbound 87. He was headed for the left lane on the connector ramp when the accident occurred, ejecting him from the pickup truck. Authorities stated that alcohol was a likely factor. While drunk driving is a constant road danger, NoCal freeways possess many other hazards including high speeds, multiple connectors, onramps and off ramps, heavy traffic, and large vehicles such as tractor trailers and buses.
