LOS GATOS DRIVER ARRESTED FOR DEATH OF BICYCLIST, AND COULD BE RESPONSIBLE TO FAMILY OF VICTIM IN CIVIL CASE (Part 2 of 2)

Even though the criminal civil court systems are completely separate, there may still be some overlap in certain cases. For example, a person facing a criminal case for murder could also be sued by the victim’s family for wrongful death. The evidence that is used in the criminal case may be used in the civil case, and vice versa. However, just because someone is found not guilty in criminal court does not mean that they will be free from liability in a civil court. The two courts differ because of the degree of proof that they require—criminal court requires that the jury or judge finds the defendant guilty beyond a reasonable doubt, and the civil court only depends on whether the court finds that there is liability with a preponderance of evidence (over 50%).

On February 2, 2010, Joshua West was killed as he rode his bicycle through the intersection of Lark Avenue and Garden Hill Drive in Los Gatos. The SUV driver was Kevin Derr, who allegedly sped through the intersection and lost control. Witnesses have told police that they watched as Derr sped into the right turn lane, went up onto the sidewalk and hit West, then continued through the intersection where he hit the base of a traffic light. After investigating the accident, police determined that Derr’s driving was grossly negligent because of the weather conditions and the fact that he did not intend to make a right hand turn.

Los%20Gatos2.jpg Derr was injured and taken to a hospital; West was the single father to a 7 year old girl. Derr now faces charges of vehicular manslaughter, and may also face a civil lawsuit by West’s daughter and other family members. Even though West’s daughter is still a minor, she can still file the lawsuit, likely through a legal guardian or a family member. If you have been in a similar situation in which you were injured in a car accident, or you had a family member killed by a motor vehicle, then you should call the lawyers of Greenberg & Rudman LLP for a free consultation of your case. We work on a contingency fee basis, which means that you do not pay costs or fees unless we win the case for you. You can reach us now at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation. OVERVIEW OF COURT SYSTEM AND PROCESS—CONSULT WITH SAN FRANCISCO CIVIL PERSONAL INJURY LAWYER (Part 1 of 2)

There are many different court systems in the United States. One of the main differences is whether the court is located in the federal or the state system. A large percentage of lawsuits and criminal cases are located in the state system, but the federal system deals with a large number of cases as well. The case may end up in federal court if the parties are located in different states, if the injury occurred across state lines, or if federal laws were broken. These are only a few of the possibilities in reaching a conclusion on which court system a case should be in.

Within the state system, there are several different types of courts—civil, criminal, family, probate and juvenile. There may also be municipal or administrative courts that deal with citations or smaller issues. Probate court handles legal issues after people have passed away, for example, wills and trusts. Juvenile courts deal with minors and their criminal or abuse issues. Criminal courts address criminal matters, both misdemeanor and felony types. Civil court is one of the largest divisions, and handles cases ranging from personal injury to contractual disputes to constitutional violations. These cases may be decided by a jury or just a judge. The parties in civil cases are usually two private parties and sometimes involve a government entity (like in constitutional violation cases).

Filing a lawsuit in a civil court can be incredibly daunting because of the different rules and paperwork that is involved. Hiring an attorney to be on your side may be your best chance at success. Experienced attorneys will know deadlines to filing documents, the court process and how to gather evidence. The lawyers of Greenberg & Rudman LLP have over 50 years of combined experience and may be able to help you in your personal injury case. DRIVER KILLED IN OAKLAND CRASH; MOTORCYCLIST CRITICALLY INJURED IN PITTSBURG

Driving in general is a dangerous activity that can put a person at risk at any given moment. However, if the driver is negligent by going at high speeds, or driving under the influence, then it puts more people in the path of that danger. Drivers are required to have insurance in California so that if an accident does occur, he/she may be able to compensate the other person for property damage or injuries that occurred during the crash. If you have been involved in a car accident and think that you are entitled to compensation, then call the law firm of Greenberg & Rudman LLP at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation.

On January 15, 2010, a driver was killed in Oakland near San Leandro Street after he crashed into a pole or a parked vehicle. The accident happened around midnight, and after the car hit the object, it burst into flames. The driver was the sole occupant of the vehicle and died at the scene of the crash. Police are still investigating the details surrounding the incident. In an unrelated accident on January 14, a motorcyclist lost control of his motorcycle and crashed into the center divide on Power Avenue in Pittsburg. The accident happened in the early hours of the morning, and it was determined that the motorcyclist was intoxicated at the time of the incident. He was wearing his helmet, but he remains on life support.

Motorcycle11.jpg Thankfully these accidents did not involve another party because the damage could have been exponential. Driving under the influence is likely viewed as negligent behavior in civil court, and has serious consequences. Would you like to learn about your rights in an accident that you were recently involved in? Then call Greenberg & Rudman LLP at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation. We have won over $150 million in verdicts and settlements for our clients. We take on large insurance companies and corporations and are not afraid to fight in court. DUI DRIVERS MAY BE RESPONSIBLE IN NEGLIGENT CAR ACCIDENT LAWSUIT—CONTACT SAN FRANCISCO ATTORNEYS FOR FREE CONSULTATION OF YOUR INJURIES

Did you know that driving under the influence of alcohol could be considered to be negligent behavior, and if someone causes injuries to you in a car accident, they could be responsible for your injuries? With New Year’s Eve around the corner, police will have DUI checkpoints placed all around the Bay Area, but that doesn’t mean that all DUI drivers will be caught, and it certainly doesn’t mean that they couldn’t cause damage on the roadway before being caught. The lawyers of Greenberg & Rudman LLP may be able to help you in your situation, so call us now at 1-800-252-9776 (1-800-ALAWPRO).

According to the California Highway Patrol, 12 people have already died in accidents over the Christmas holiday weekend. Approximately half of those victims were not wearing seatbelts. The CHP also reports that drunk driving arrests are up to 549 this year, as compared to 409 in 2008. Drinking and driving can be considered to be negligent behavior in a court of law because a reasonable person in that drunk driver’s position would likely understand that it is not safe to get behind the wheel of a car while under the influence of alcohol. If the drunk driver is found liable, then he could face significant damages to the victim or the victim’s family.

Drunk%20Driving2.jpg The damages that the drunk driver could face include property damages to the victim’s car, or other belongings, medical bills, and even wrongful death damages. The lawyers of Greenberg & Rudman LLP have had over 50 years of combined experience and may be able to help you in your case. MAN WINS LAWSUIT WORTH MILLIONS AGAINST COUNTY AND STATE GOVERNMENTS FOR INJURIES CAUSED BY TREE LIMB FALLING—ANTIOCH LAWYERS CAN HELP YOU NOW

Federal, state and local governments have responsibility in maintaining parts of the United States, so if something happens on federal or state land, the proper authorities are responsible for it. This not only applies to where lawsuits are held, but also to who may be responsible for the injury. State and local governments are responsible for most of the roads and pathways, and if accidents occur as a result of that maintenance, then they would likely have responsibility. For example, if the signs on a certain road are inaccurate and cause an accident, the city or state may be responsible for a part of the accident, and maybe even the entire thing.

In Delaware on October 30, 2009, Kenneth Matlock won $6 million for the injuries that he sustained when a tree limb fell on his car and broke his neck. The incident happened in 2006 when he was driving in the car with his wife and three children. The tree limb fell on top of their SUV, and the car continued until it hit a guardrail on the opposite side of the road. Matlock’s wife’s neck was broken as well, and he lost use of his right hand. It was determined that the tree was the responsibility of the Department of Transportation of Delaware, and because of the flooding that had happened there, the tree was rotted out.

Antioch.png A tree expert and registered arborist testified for Matlock and stated that the state should have known about the condition of the tree and should have corrected it before the accident occurred. The jury unanimously awarded the damages to the Matlocks. Have you or a family member been injured in a car accident or any other incident that involved the negligence of the state government? If so, you should contact the attorneys of Greenberg & Rudman LLP right away for a free consultation of your case. Pick up the phone and call us now at 1-800-252-9776 (1-800-ALAWPRO). ELEMENTS OF NEGLIGENCE COULD DETERMINE IF YOU HAVE A SUCCESSFUL LAWSUIT ON YOUR HANDS—CONSULT WITH DANVILLE LAWYERS NOW

It is a common misconception that just because someone injures you, you will be able to win a lawsuit against them. There are many legal standards that you would have to meet before you are able to succeed in a lawsuit, and it may be very hard if you don’t have an experienced attorney on your side. Personal injury lawsuits can be divided into two major sections: intentional and negligent. Intentional torts are lawsuits in which the wrongdoer intended to do what he did, and it caused injury. Prime examples of these types of lawsuits are assault and battery (which differs from the criminal version) and intentional infliction of emotional distress.

Negligent torts are more common because they include incidents that are not intentional, and may include a greater variety of incidents. In order to win a negligence lawsuit, the plaintiff (the person bringing the lawsuit) must meet six elements: duty, standard of care, breach of duty, cause in fact, proximate cause and damages. Under duty, the defendant must have an obligation to the plaintiff to conform to a certain standard of conduct. For example, there is no general duty to act, and particularly if the state (like California) does not have a Good Samaritan Law. So, people are not legally bound to stop by the side of the road to help someone who has been injured. Similarly, the person injured will not be able to win a lawsuit against people who have passed them on the road, but who did not cause the injury.

Under the element of duty, there are specific individuals who have a duty to you. For instance, your doctor would have a duty to treat your injuries, or at the very least keep you informed of your condition. There are additional professionals who also owe a duty to their clients. The law firm of Greenberg & Rudman LLP has won over $150 million in verdicts and settlements for their clients. We may be able to help you in your case, so don’t go into a lawsuit alone. FAMILY OF GIRL KILLED IN CAR ACCIDENT AWARDED $5.25 MILLION AGAINST BIG RIG TRUCK DRIVER AND COMPANY—CONTACT WALNUT CREEK ATTORNEYS NOW (Part 1 of 2)

Are you aware that if you get into an accident with a big rig truck, you may be able to obtain compensation for your injuries from the owner of the truck, the driver’s employer and the owner of the cargo that the truck is carrying? Of course, there are certain limitations in these types of cases and the outcome depends on the different circumstances in each case. In these types of cases, the owner of the truck is likely responsible for the condition of the truck. For example, the company would have to perform inspections on the vehicle to make sure that it was safe on the road. The driver’s employer is also responsible for the driver, whether it’s properly training him/her or making sure that their licenses are up to date.

A Albemarle County, Virginia jury awarded the Aichs family $5.25 million for the death of their 16 year old daughter in 2008. The accident happened with a big rig truck, driven by Kenneth Barbour and owned by the Don B. Swisher Trucking Corp. It was alleged in the lawsuit that Barbour was not properly trained and supervised and that the company allowed him to drive the big rig truck with defective parts. The accident occurred when Barbour ran a red light at the intersection of U.S. 29 and Ashwood Boulevard. The jury awarded $1.75 million to each of the three family members but did not award any punitive damages because Barbour’s actions did not meet all the required thresholds of negligence.

Barbour also pleaded guilty to involuntary manslaughter and reckless driving earlier this year. He was sentenced to two years in prison. If you have had a family member who was killed or injured in a big rig truck accident, or any other car accident, then you need to call an experienced attorney for a free consultation of your case. WOMAN WINS $8.5 MILLION IN SPORT UTILITY VEHICLE ROLLOVER ACCIDENT CASE—CALL BAY AREA ATTORNEYS NOW (Part 2 of 2)

Product liability cases address problems that consumers face with the products that they buy. The product can be food, furniture and vehicles. These lawsuits are implemented to protect the consumer in case the product that they buy poses great unexpected dangers. Product liability lawsuits include defective products, and products that are inherently dangerous. These lawsuits do not include the improper use of these products. For example, crayons are meant to be drawn with and not eaten—if your child eats crayons and suffers medical problems as a result, then it will likely be attributed to the lack of supervision and not to the manufacture or design of the crayon.

A woman, Latoya Duckett, in Alabama won an $8.5 million lawsuit on Wednesday, October 14, 2009 for injuries that she suffered in a rollover accident. The lawsuit was filed against the Ford Motor Company in 2005 over an accident involving a Mercury Mountaineer; Duckett claimed that the vehicle was unstable and rolled over too easily. There were two fatalities and two injuries in the car accident. Duckett had to have her right leg amputated below the knee and has lost the use of her left arm. According to court testimony, another car had drifted to the SUV’s lane, and when the SUV went to the left lane to avoid the vehicle, it flipped and rolled over four and a half times.

The $8.5 million damage amount was entirely for compensatory damages and not for punitive damages. This means that the money is used to reimburse Duckett for the wages that she lost, or to pay for medical bills and not for issues like pain and suffering. If you or someone you know has been injured in an accident, call Greenberg & Rudman LLP now. THOUSANDS OF ROLLOVER ACCIDENTS HAPPEN EVERY YEAR—CALL SAN MATEO PERSONAL INJURY LAWYERS NOW FOR FREE CONSULT (Part 1 of 2)

The National Highway Traffic Safety Administration released a report in 2002 about the characteristics of fatal rollover crashes. These were their findings:

  • There were approximately 42,000 fatalities annually between 1991 and 2002;
  • About 75% of the occupants of fatal rollover crashes were not wearing seatbelts or other restraints;
  • Rollover crashes constitute about 20% of all fatal crashes;
  • SUV rollover crashes doubled between 1991 and 2002, growing more than any other class of light trucks;
  • Speed is considered to be an important factor in rollover crashes—most crashes occurred while the vehicle was going 55 miles per hour or faster;
  • Through the statistics, the drivers of the rollover vehicles seem to be men under 40 years of age who were driving on two way roads with no dividing barriers;
  • Rollover crashes are more likely to result in fatalities than are non-rollover crashes;
  • In 2000, approximately 36% of sport utility vehicles involved in a crash experienced a rollover;
  • In most cases where the passengers were restrained during a rollover accident, they were not ejected from the car;
  • Most rollover fatalities were single vehicle accidents.

Car%20Accident23.jpg The increase in SUV rollover crashes can be correlated to the increase in popularity of the vehicles. Rollover crashes may be more common in light trucks and SUVs because of their high center of gravity. Passenger weight makes rollover accidents less likely in passenger cars but the weight actually increases the likelihood of a rollover accident in SUVs. TOYOTA AND LEXUS RECALL MILLIONS OF CARS BECAUSE OF FLOOR MATS THAT CAN CAUSE ACCIDENTS—OAKLAND LAW FIRM MAY BE ABLE TO HELP

When there are problems with products, companies will issue a recall to warn the public about the safety issues in the product, or as a notice that those consumers should bring in their product to be fixed or exchanged. These issues are addressed in court primarily as product liability cases because the issue usually goes to the design or manufacture of the product. For example, if a blow dryer short circuits because of a design flaw and electrocutes you, then it would be a product liability case. But, if you put the blow dryer in a bucket of water and are killed by that, then it would probably not be a product liability case because you misused the blow dryer.

On September 29, 2009, Toyota Motor Corporation recalled 3.8 million cars in the United States because of a safety hazard involving the car’s floor mats. Improperly secured or ill-fitting floor mats in the cars may cause the accelerator pedal to get stuck and ultimately cause a car crash. The recall involves the Toyota Camry, Avalon, Prius, Tacoma and Tundra, as well as several Lexus models. The recall follows the August, 2009 crash of a family’s vehicle in San Diego when their floor mat caused the accelerator to get stuck and crash into another car as it was going 120 miles per hour.

Even though Toyota has issued a warning about the floor mats, if you have been injured because of these improperly secured or ill-fitting floor mats, then you may still be able to obtain compensation for your injuries. DISCOVERY IN CIVIL LAWSUIT PLAYS BIG ROLE IN PERSONAL INJURY CASE—CONTACT SAN FRANCISCO LAW FIRM NOW

Many people may think that a lawsuit is all about the trial. However, that is a very common misperception. In fact, most of the lawsuit occurs outside of the courtroom and usually between the two parties and their attorneys. The first part of a lawsuit revolves around papers and motions being filed in court and the essential facts laid out by both sides. The second part of the lawsuit is a process called “discovery” in which the two sides of the case can find out different information from each other. For example, if this is a car accident case, then the person who alleges damage can “discover” car insurance information from the alleged wrongdoer.

Other parts of discovery may include interrogatories (questions), requests for production of documents or things and depositions. The parties can object to interrogatories or the production of documents, but may still have to answer the questions before being heard by a judge. A deposition is the questioning of a certain individual. In essence, anyone in the United States can be deposed without being involved in a lawsuit, but that may be a significant waste of the parties’ time. In a deposition, the person being deposed can bring along an attorney but would have to answer the questions that the deposing party asks. These questions can all be argued before a judge about their relevance, or other objects.

To efficiently and quickly address the issues in your lawsuit, you need to consult with an experienced and knowledgeable attorney who can help you with your case. At Greenberg & Rudman LLP, you speak directly to an experienced California personal injury lawyer. STUDENT PEDESTRIANS HIT IN CROSSWALKS IN PLEASANT HILL, SAN MATEO AND PETALUMA

Pedestrians need to be particularly careful crossing the street and walking on the road because of the dangers that cars, motorcycles and other large vehicles may pose. People walking do not have the added protection of a vehicle around them, and do not even have a helmet, as a bicycle rider would have. If people are hit by cars and other motor vehicles without any protection, then the result could be fatal. Have you or a loved one been involved in a car accident and were critically injured as a result of that? Then you should call Greenberg & Rudman LLP now at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation.

On October 1, 2009, a 14 year old boy going to school in San Mateo was hit by an SUV as he crossed the street on the way to school. The driver was not cited or arrested for the incident because she had the right of way. It appeared that the boy was running to school when he encountered the vehicle. He is still in the hospital, and the crash is still under investigation. In another accident on September 30, 2009, two 13 year old children were hit when they were walking to school. One of the girls was thrown onto the windshield, but both are expected to survive. The driver cooperated with police in the incident. In yet another accident on October 2, a 15 year old boy in Petaluma was hit while he was riding his skateboard to school.

TEXTING AND USING CELL PHONE WHILE DRIVING INCREASES CHANCES OF CAR ACCIDENT—CALL MILLBRAE MOTOR VEHICLE ACCIDENT LAWYERS

Recently in California, talking on the cell phone without an earpiece or texting on a cell phone has been outlawed while driving. Lawmakers have made these strict driving laws in response to the increasing accidents caused by cell phones. A recent study by the Virginia Tech Transportation Institute showed that texting while driving increases the chance of crashing 23-fold. If your car accident was caused by someone who was texting or talking illegally on their cell phone while they drove, then you may be able to obtain compensation for your damages if you were injured. Call Greenberg & Rudman LLP at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation.

The Institute conducted its research by observing light vehicle and truck drivers for more than six million miles. What the study revealed was that when the drivers of heavy trucks texted while they were driving, their collision rate was 23 times greater than if they were not texting. The study also found that reaching for a cell phone, using it or dialing a number actually increases the chance of a collision approximately six times in cars and trucks. In collisions involving cell phones, it was found that drivers spent approximately five seconds looking down at their phones. This means that if the driver was going at 55 miles per hour, it would be enough time to cover the length of a football field.

Texting2.jpg In civil lawsuits, being able to show that someone else was negligent and at fault is very important to the success of your case. If you have been injured by someone who was on their cell phone, and did not follow the laws of the state, then you may be compensated for your injury and your property damage. The attorneys at Greenberg & Rudman LLP are committed to obtaining compensation for victims who have been injured by the negligence of others. ROLLOVER ACCIDENTS MAY OCCUR MORE OFTEN IN SPORT UTILITY VEHICLES CALL BAY AREA ATTORNEYS NOW (Part 1 of 2)

In recent years, the sport utility vehicle (SUV) has gained popularity with consumers because of its efficiency and roomy cargo area. However, SUVs pose an unexpected danger that sedans may not. The National Highway Traffic Safety Administration releases reports about the safety of various cars and uses different tests and information to determine the scores of the cars. A vehicle’s stability is dependent on its height, width between the tires, its suspension system, tire grip and location of its engine mount. Although the weight of extra passengers in sedans may keep it more grounded and less likely to roll over, it is actually the opposite for SUVs. The extra weight may actually make it more likely for a SUV to flip over. Have you been injured in a rollover accident as a result of the vehicle’s design? If so, you should call Greenberg & Rudman LLP immediately at 1-800-252-9776 (1-800-ALAWPRO).

In Los Angeles on May 29, 2009, a civil court judge awarded Sukhsagar Pannu $21.1 million for injuries that he sustained when his Land Rover Discovery SUV flipped over several times after a collision. Pannu sustained permanent injury and lost use of his arms and legs, and requires around the clock care. The judge granted him the damages based on the fact that the vehicle’s high center of gravity made it more susceptible to rolling over, and that the roof collapsed too easily, which caused Pannu’s spinal injury. The damages that were awarded to Pannu will help with his care for the rest of his life.

SUV.jpg Being severely injured in a car accident can put everything on hold, and may destroy your life before you know it. Being injured can take a toll on a person and his/her family financially and emotionally. Many families may not be able to live on a single income, or even pay for their medical bills as they come. These are all things that you may recover if you were wrongfully injured in a car accident. Large insurance companies may be intimidating and may not fully cooperate with you if you are without an experienced attorney. That’s why you should call Greenberg & Rudman LLP immediately at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation, and learn about your rights. MOTORCYCLIST KILLS CHILD UNDER INFLUENCE OF ALCOHOL—CALL OAKLAND PERSONAL INJURY WRONGFUL DEATH LAWYERS NOW

Although many of today’s television shows and movies may explain the details of the court process, there are still some issues that are fuzzy to the general public. Take for example the concept of double jeopardy. In criminal cases, this means that if a defendant is convicted or acquitted (found not guilty) of a certain crime, then it means that the original prosecutorial agency in the case will not be able to bring the charge against him again. However, just because a person has faced criminal charges on a certain matter does not mean that he will be free of civil lawsuits. A defendant who is charged with criminal acts may be sued in civil court for damages, rather than time in jail or other forms of punishment. In fact, the plaintiffs bringing the lawsuit in civil court may use the evidence used in criminal court in their case.

On May 27, 2009, Edward John Schaefer hit and killed Melody Osheroff, a fourth grader in San Ramon, and severely injured her father, Aaron Osheroff, in Marin County while the two people were crossing the street. Police found that Schaefer’s blood alcohol level was .16, which is double the legal limit. Melody died the following day, and her father is in serious condition and has had his leg amputated. In an unrelated car accident on Monday, May 25, four people died in an alcohol related accident in Oakland. The driver of the vehicle, Tiffany Reynolds, suffered a broken neck and has been charged with four counts of vehicular manslaughter. The four people who died in the crash included her domestic partner, her brother and the couple’s three year old twins. The twins were not in car seats, and one boy was ejected from his seat while the other was found pinned under the steering column. Both Schaefer and Reynolds could face time in jail, as well as civil lawsuits from the family members of the people that they injured while they drove under the influence.

The attorneys at Greenberg & Rudman LLP represent people who have been seriously injured as well as the families of those who have been killed under wrongful death circumstances. FAMILY WINS LAWSUIT IN WRONGFUL DEATH OF CAR SALESMAN. BAY AREA CAR ACCIDENT INJURY LAWYERS ARE HERE FOR YOU

Depending on different state laws, wrongful death lawsuits can be brought by only certain people that usually include the victim’s parents, spouse or children. So, if the person bringing the suit is the victim’s distant cousin, the law will likely prohibit them from filing the lawsuit. Often times the laws in different jurisdictions only provide certain damages that the family may recover from the lawsuit. For example, the damages in a lawsuit may recover money for the victim’s medical care or funeral expenses but would not cover for the family’s pain and suffering. All of these details are different in different states, so the best option would be to call and get a free consultation from Greenberg & Rudman LLP so that you know your rights. We can be reached at 1-800-252-9776 (1-800-ALAWPRO).

A jury in Cook County, Illinois, found in favor of a car salesman’s family in a wrongful death lawsuit on Monday, April 20, 2009. The victim, Roger Czapski, was killed in 2004 when he was taking a customer, Christopher Maher, out for a test drive in a BMW. Maher, driving the BMW, clipped a Saturn and the car swerved and hit a light pole. The driver and the two other passengers were ejected from the car, but Czapski died at a hospital approximately ninety minutes later. The evidence during trial showed that Maher was driving the car at about ninety-five miles per hour when the crash occurred. Maher pled guilty to aggravated speeding in 2005 in relation to the crash, and was sentenced to one year of probation and 30 days of community service.

CAR AND BIG RIG TRUCK ACCIDENTS RESULT IN DEATH IN SF BAY AREA AND CENTRAL VALLEY

Hundreds of car accidents occur around the Bay Area on each given day. Unfortunately, many of these accidents result in death, and likely could have been prevented. Many drivers may underestimate the importance of following certain laws, such as using the turn blinker to change lanes, or just following common sense principles, like not driving when you’re tired. There were several vehicle accidents around the Bay Area this week, one of which included a big rig truck and a pedestrian on the side of the road. If you have been injured in a car, or truck accident, you should contact the attorneys at Greenberg & Rudman LLP immediately for a free consultation. We can be reached at 1-800-252-9776 (1-800-ALAWPRO).

In the early hours of Friday, April 17, 2009, three men in a BMW were killed in St. Helena on Pratt Avenue. The police are still investigating the accident and have not indicated the cause of the deaths. On April 18, 2009 on Highway 99 near Merced in the Central Valley, a bus driver was killed by a big rig. The bus driver was driving a bus containing forty one people when the bus ran out of fuel. The driver, John Haen, had walked to Merced for fuel, and then was escorted back to the bus by a CHP officer. Haen was struck as he was filling the empty gas tank, and was thrown 70 feet. The big rig truck also hit the bus, and the CHP officer’s vehicle, which was parked in front of the bus. In another unrelated accident on Saturday, the driver of a car involved in a single vehicle crash was killed on Highway 280 in Los Altos Hills. There was no report of injury to the passenger in the car, and the cause of the crash is still under investigation.

ACCIDENTS IN BAY AREA LEAD TO SERIOUS INJURY, DEATH—INJURED IN A CAR OR TRUCK ACCIDENT? CALL NOW

There may be an increased number of drivers on the road for a big holiday weekend, such as Easter, especially when kids are off from school for several days. Although driving (instead of flying or taking a train) can have its benefits, it is also inherently dangerous because a person is in charge of his vehicle and may not be able to prevent certain conditions from happening. In the Bay Area this week, there have been several accidents resulting in serious injury or death. If you or a family member has been seriously injured or killed in a car accident in the San Francisco Bay Area, then you should call an experienced attorney as soon as possible. The attorneys at Greenberg & Rudman LLP can be reached at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation.

At approximately 3:30 a.m. on April 11, 2009, there was a collision between two cars at the intersection of Industrial Parkway and Huntwood Avenue in Hayward. There were four teenagers in one of the cars, and an adult in the other car. All five people were transported to local hospitals because of their injuries. The cause of the accident is still under investigation. In an unrelated accident on the same day, a California Highway Patrol officer located a van in a ditch near Locke Road and McEathron Lane in Solano County. Officers have reported that they believe that high speed was the reason that the driver of the van ran off of the road and ultimately died.

Truck%20Accident3.jpg In a third unrelated crash on April 11, a pedestrian was killed on a San Francisco highway. The accident occurred at the connector ramp between northbound Interstate Highway 280 and southbound state Highway 1. The cause of the accident has not yet been determined. To make sure that you have proper representation in cases like these, you should contact an experienced attorney and get an evaluation of your case. LAWSUITS MAY BE TOO COMPLICATED FOR AVERAGE PERSON—CONSULT AN EXPERIENCED SAN FRANCISCO ATTORNEY FOR HELP IN YOUR CASE (Part 2 of 2)

After the complaint has been filed and the lawsuit is well on its way, the parties will then encounter different obstacles and deadlines in which they have to meet. The complaint that the plaintiff filed may need to be edited by adding in new defendants, or new information, and it all depends on how the case develops and what the parties find out along the way. The defendant may make different motions to try to get rid of the case, such as a motion to dismiss, or a motion for summary judgment in the hopes that the case will end there instead of going any further. Knowledgeable attorneys know how to deal with these kinds of issues effectively, and have the resources to file the documents and do the research. The attorneys at Greenberg & Rudman LLP have won over $150 million in settlements and verdicts. Call us now at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation.

After the lawsuit has been started, there is the discovery process in which both parties answer each other’s questions (called interrogatories) about the incident that led to the lawsuit, and give each other important documents. The discovery process was created as a way to reduce animosity in the lawsuit process and to make it a less adversarial process. In this way, the parties on each side will not be surprised during the trial with new information and can fully prepare their own cases. After the discovery process comes a point in which the parties may discuss settlement options or go to trial. If the parties cannot settle the case and go to trial, it may be before a judge, or a jury. The parties are encouraged to settle during the entire process as this is a more efficient way to provide the parties with what they each want. However, if the issue is given to the jury to decide, the decision is binding, although depending on the case, either party may appeal the judgment.

When you are faced with an injury or legal issue in which you have been damaged in some way, filing a lawsuit may be the best way to recover for your injuries. However, filing a lawsuit is not an easy matter, and should be handled with a great deal of care. To make sure that you know your rights and that your case is handled properly, you should call an experienced attorney at Greenberg & Rudman LLP for a free and confidential consultation. TWO PEOPLE IN WHEELCHAIRS STRUCK BY CARS IN SANTA ROSA, SAN FRANCISCO

Drivers have an incredible responsibility on the road—not only do they have to be sure that they are following the laws but they also have to make sure that they defend themselves and others when obstacles are before them. If an accident occurs and there are people injured in the accident, it may depend on the circumstances of the incident to determine who is responsible for the accident. This is especially important in situations when certain parties don’t have car or health insurance, and want to obtain compensation from the party at fault.

On Friday, March 20, 2009, Richard Trenam was in his wheelchair, crossing the intersection of Range Avenue and Guerneville Road in Santa Rosa when he was hit and struck by a 2003 Mitsubishi Eclipse. The driver of the Eclipse was 24 year old Antonio Salano Villa, who left the scene of the accident after he hit Trenam. A passing truck driver saw Trenam in the roadway. Police found one of the license plates belonging to the Eclipse at the scene of the accident, but Villa actually returned to the scene with his father. He voluntarily gave a blood sample to police at headquarters.

A week later, on Friday, March 27, 2009, in an unrelated accident, Abella Lastimosa died in a crash at the intersection of Geneva Avenue and Stoneridge Lane in San Francisco. Lastimosa was a San Francisco resident, and was in a wheelchair. The driver of the car was headed west on Geneva Lane and struck Lastimosa, who was headed south on Stoneridge lane. The driver of the car stopped at the scene of the accident, but the cause is still being investigated.

Santa%20Rosa.jpg Fleeing the scene of an accident, regardless of how much property and physical damage has been done, can be cause for criminal charges, and may result in a hefty civil lawsuit. If you or someone you know has been injured in an accident, call us now. VICTIM SETTLES WITH CITY AND POLICE OVER HIGH SPEED CHASE GONE WRONG—NEGLIGENTLY INJURED ON THE ROAD? CALL SAN FRANCISCO PERSONAL INJURY LAWYERS NOW

Generally, there are very few incidents in which individuals can sue police officials for wrongdoing in the line of duty. In order to do their job effectively, police officers may not be civilly liable for causing damage to property or people because if they were, then they may not be able to act speedily in emergency situations. For example, if there is a burning house, police officers and firemen may destroy property in order to reach someone inside, but they would not be civilly liable in a lawsuit if the property owner decided to sue them for damaging the house. However, there are different standards that must be met in different situations, even for emergency officials. If, for instance, a police officer was pursuing a suspect, and shot into a crowd of people, this would likely be outside of his standard of duty and would probably be considered negligent if he shot and killed an innocent bystander.

The Indiana Supreme Court held that law enforcement immunity did not protect police officers from negligent lawsuits arising from car chases gone wrong. This unanimous ruling in 2006 led to the lawsuit settlement for Richard Garman on March 23, 2009. There was a high speed car chase in 1999 in which police officers were wrongly informed that a car had a stolen license plate. When they pursued the car, the driver, Jessie L. Smith, fled and crashed into Garmen’s car, severely injuring Garmen and killing his fiancée. The lawsuit settled for $75,000 for Garmen’s injuries, his emotional distress and the depression that resulted from his fiancée’s death. The lawsuit was not aimed at Smith, who was sentenced to three years in prison, but rather at police officials in Indiana who, Garmen claims, have too much leeway in their car chases. The city of Indianapolis likely settled the lawsuit in hopes of avoiding a costly trial without having to admit liability.

PEDESTRIAN ACCIDENTS RESULT IN DEATH IN SAN FRANCISCO PENINSULA, BAY AREA—HAVE YOU BEEN INJURED? CALL A PERSONAL INJURY ATTORNEY NOW

Drivers have to be especially cautious on the road and respect other motorists as well as pedestrians. There have been a number of accidents in the Bay Area over the last week in which pedestrians have been seriously injured or killed as a result of being hit by cars.

  • On March 13, 2009, a pedestrian was hit and killed on southbound I-280 in San Mateo County. The California Highway Patrol reported that the 45 year old victim walked into the path of a BMW and was struck. The driver of the BMW immediately pulled over, but it is reported that several other vehicles struck the victim but failed to pull over. The victim was a resident of Gilroy, but his identity has not yet been released. It is also reported that shortly before the accident, a tour bus pulled over in the area, and later passengers reported that there was a passenger missing. The CHP is still investigating the incident and closed down the lanes on I-280 for several hours.
  • Another victim was struck in El Cerrito while walking in the crosswalk of Blake Street near Kearney Street, in front of the BART station. The pedestrian was blind and was walking with his white cane in the crosswalk when a Toyota Camry struck him and fled the scene. Police are still looking for the driver of the vehicle for hit and run.

Although there might not have been negligence in the initial accident that caused the damage to the victim, it is negligent and reckless to leave a victim on the road without stopping. Hit and run accidents can result in criminal prosecution and a hefty lawsuit from the victim or his family. The attorneys at Greenberg & Rudman LLP are experienced in wrongful death and personal injury lawsuits. PEDESTRIAN HIT & RUN, BODY DRAGGED IN SAN JOSE, CA

Hitting a pedestrian might be a result of an accident, or even because of the pedestrian’s negligence. However, it is illegal and reckless to fail to stop after you have hit a pedestrian. On Monday, March 2, 2009 a body was found near Highway 680 in San Jose at the McKee Road off-ramp. Police believe that the person was actually struck approximately a quarter mile away near the intersection of McKee Road and Capitol Avenue. Several other cars had run over the body before police found it. Police have not determined whether the victim is a man or a woman.

It is a crime to not stop at the scene of an accident, even if you hit an inanimate object, such as a car, and could bring liability in a civil lawsuit. It is an even more serious crime and considered even more reckless to fail to stop after you have hit a person. It is unlikely that a person would not know that they have hit and dragged a person for a quarter of a mile. Once caught, the driver could face criminal charges and wrongful death lawsuits from the victim’s family. If the incident was truly an accident, for example if the pedestrian were walking in the middle of the street and the car failed to see him/her in the dark morning hours, and the driver had stopped, then there might be no liability, or limited liability. Additionally, there is also a chance that the victim would not have died and only suffered minor injuries had he/she not been dragged the distance.

San%20Jose.jpg Suffering through such an accident, or having a family member in such a situation can take a toll on your life. We may not be able to ease the pain of losing a loved one, but we can help you file a wrongful death lawsuit efficiently and take care of the legal aspect of the case for you.
