LOS GATOS DRIVER ARRESTED FOR DEATH OF BICYCLIST, AND COULD BE RESPONSIBLE TO FAMILY OF VICTIM IN CIVIL CASE (Part 2 of 2)

Even though the criminal civil court systems are completely separate, there may still be some overlap in certain cases. For example, a person facing a criminal case for murder could also be sued by the victim’s family for wrongful death. On February 2, 2010, Joshua West was killed as he rode his bicycle through the intersection of Lark Avenue and Garden Hill Drive in Los Gatos. The SUV driver was Kevin Derr, who allegedly sped through the intersection and lost control. Witnesses have told police that they watched as Derr sped into the right turn lane, went up onto the sidewalk and hit West, then continued through the intersection where he hit the base of a traffic light. After investigating the accident, police determined that Derr’s driving was grossly negligent because of the weather conditions and the fact that he did not intend to make a right hand turn.

DRIVER KILLED IN OAKLAND CRASH; MOTORCYCLIST CRITICALLY INJURED IN PITTSBURG

On January 15, 2010, a driver was killed in Oakland near San Leandro Street after he crashed into a pole or a parked vehicle.   • Through the statistics, the drivers of the rollover vehicles seem to be men under 40 years of age who were driving on two way roads with no dividing barriers;
  • Rollover crashes are more likely to result in fatalities than are non-rollover crashes;
  • In 2000, approximately 36% of sport utility vehicles involved in a crash experienced a rollover;
  • In most cases where the passengers were restrained during a rollover accident, they were not ejected from the car;
  • Most rollover fatalities were single vehicle accidents.

A jury in Cook County, Illinois, found in favor of a car salesman’s family in a wrongful death lawsuit on Monday, April 20, 2009. The victim, Roger Czapski, was killed in 2004 when he was taking a customer, Christopher Maher, out for a test drive in a BMW. In the early hours of Friday, April 17, 2009, three men in a BMW were killed in St. Helena on Pratt Avenue. The police are still investigating the accident and have not indicated the cause of the deaths. On April 18, 2009 on Highway 99 near Merced in the Central Valley, a bus driver was killed by a big rig. The bus driver was driving a bus containing forty one people when the bus ran out of fuel. The driver, John Haen, had walked to Merced for fuel, and then was escorted back to the bus by a CHP officer. Haen was struck as he was filling the empty gas tank, and was thrown 70 feet. The big rig truck also hit the bus, and the CHP officer’s vehicle, which was parked in front of the bus. In another unrelated accident on Saturday, the driver of a car involved in a single vehicle crash was killed on Highway 280 in Los Altos Hills. There was no report of injury to the passenger in the car, and the cause of the crash is still under investigation.

TWO PEOPLE IN WHEELCHAIRS STRUCK BY CARS IN SANTA ROSA, SAN FRANCISCO

A week later, on Friday, March 27, 2009, in an unrelated accident, Abella Lastimosa died in a crash at the intersection of Geneva Avenue and Stoneridge Lane in San Francisco. Lastimosa was a San Francisco resident, and was in a wheelchair. The driver of the car was headed west on Geneva Lane and struck Lastimosa, who was headed south on Stoneridge lane. The driver of the car stopped at the scene of the accident, but the cause is still being investigated.

Generally, there are very few incidents in which individuals can sue police officials for wrongdoing in the line of duty. In order to do their job effectively, police officers may not be civilly liable for causing damage to property or people because if they were, then they may not be able to act speedily in emergency situations. Smith, fled and crashed into Garmen’s car, severely injuring Garmen and killing his fiancée. The lawsuit settled for $75,000 for Garmen’s injuries, his emotional distress and the depression that resulted from his fiancée’s death. The lawsuit was not aimed at Smith, who was sentenced to three years in prison, but rather at police officials in Indiana who, Garmen claims, have too much leeway in their car chases. The city of Indianapolis likely settled the lawsuit in hopes of avoiding a costly trial without having to admit liability.

The pedestrian was blind and was walking with his white cane in the crosswalk when a Toyota Camry struck him and fled the scene. Police are still looking for the driver of the vehicle for hit and run.

  • Fifty-five percent of drivers involved in fatal crashes with a blood alcohol content of .08% and above were not wearing seat belts or helmets, while 34% used them and it is unknown for 11% of them.
  • The highest number of drunk driving fatal accidents occurred in passenger cars, and then light trucks, and then motorcycles.
  • Fifty-seven percent of the drunk driving accidents occurred on the weekends, and most occurred between midnight and 3 a.m.
  • Most of the drunk driving accidents (68%) were single vehicle accidents while 32% were multiple vehicle accidents.

PEDESTRIAN HIT & RUN, BODY DRAGGED IN SAN JOSE, CA

  • A California Highway Patrol officer was struck and suffered injuries in an accident on Tuesday, February 10, 2009 on Highway 880. The officer was on his motorcycle traveling in the left lane when a woman driving a Buick LeSabre veered into his lane. The officer tried to slam on his brakes, but could not avoid hitting the back of the Buick. He was taken to the hospital with a broken ankle; investigators stated that alcohol was likely not a factor in the collision.

HIGHWAY 680 ACCIDENTS RESULT IN MAJOR INJURIES NEAR DUBLIN, CALIFORNIA

Fortunately, there were no students aboard the school bus at the time of the collision. The bus driver, Rian Studebaker, failed to stop at a stop sign and overturned when it was struck by the Tundra. In another crash on the same day, Nicole Gibbs crashed her car into a tree near Bohemian Highway near Tyrone Road. She was taken to the hospital and is in stable condition.

According to official reports, Ms. Surles’ blood alcohol level was 0.19 and 0.20 percent. In addition to the hit and run charge, Ms. Surles was also charged with child endangerment because she had her five year old son in the car with her.

In another unrelated case, Lee David Harbert was sentenced to three years in jail for a hit and run accident which killed Gurdeep Kaur in Moraga approximately four years ago. Mr. Harbert hit Ms. Kaur with such force that her body shattered the windshield, the hood was crumpled and the hood’s ornament was snapped off.

MTC REPORT FINDS SAN FRANCISCO BAY AREA ROADS IN FAIR CONDITION- ROAD SAFETY IMPORTANT FACTOR IN ACCIDENTS

The report included an evaluation of approximately 42,000 miles of streets and roads in the Bay Area. The maximum possible score in the pavement condition index (PCI) is 100. The Bay Area rated at 65 in the 2005-2007 time period. Once the PCI reaches 60 points, then the roads and streets begin to deteriorate rapidly. The MTC has reported that roads in the 70-79 point range, which would mean that the pavement is in “good condition”, are less costly to maintain while those with a PCI of about 60 will cost more for rehabilitation or reconstruction.

A breakdown of certain Bay Area roads are as follows: twelve percent were rated “excellent”; twenty three percent were “very good”; twenty percent were “good”; twelve percent were “fair”; ten percent are “at risk of rapid deterioration”; fourteen percent were poor; eight percent failed. The Bay Area’s projected goal is to obtain a PCI of 75 by the year 2035. An approximate $7 billion has been directed to funding the maintenance of local roadways over the time period. The MTC also has reported that the Bay Area will have to double the current level of investment in maintenance of pavement.

TRAIN COLLISIONS, CAR WRECKS AND PEDESTRIAN ACCIDENTS INCREASE DURING THE HOLIDAYS IN THE BAY AREA

  • A pedestrian was killed in a hit and run accident on Friday in San Francisco, near Lake Merced. He was identified as San Francisco resident Gerardo Yambao. Police are still investigating the hit and run accident and are searching for a white SUV in connection with the incident.
  • A woman died in a car accident in San Bruno after veering across two lanes and hitting the driver’s side of a SUV. The accident happened around 11:40 p.m. on Friday night on Interstate 380, and the woman was pronounced dead at 1:05 a.m. The driver of the SUV was arrested for driving under the influence of alcohol, but was not believed to be the cause of the accident.

BIG RIG TRUCK CRASH ON NAPA HIGHWAY CAUSES MULTIPLE INJURIES

A Peterbilt big rig carrying a load of rocks and boulders overturned while taking a turn on Highway 121 in Napa County. As the boulders spilled out of the truck, three cars attempted to avoid the oncoming rubble and crashed. The accident resulted in major and minor injuries to the car drivers. One of the cars caught fire after hitting a guardrail. Crashes involving big rig trucks, also known as tractor-trailers, can be severe and sometimes fatal. CAR AND MOTORCYCLE ACCIDENTS IN THE EAST BAY ON THE RISE

As the holiday season rolls around, the highways and public transportation systems are busy with travelers. Five people were killed in various motorcycle and car accidents in the Bay Area, between Friday, November 21, 2008 and Sunday, November 23, 2008. According to the California Highway Patrol, all of the accidents remain under investigation.

  • A fatal motorcycle accident occurred in Contra Costa County at 11:30 a.m. on Sunday, near the Willow Pass on-ramp on Highway 4.A man was killed as he was traveling eastbound on Interstate 580 and drifted onto the shoulder, then overcorrected to the left and lost control of his car. The accident happened around 3 a.m. on Sunday near Keller Avenue in Oakland.
  • Two people died in a multi-vehicle hit and run on westbound Interstate 80 in Richmond on Saturday at about 3:50 a.m. According to police, the initial crash involved four different cars but the fatalities occurred when the victims of one of those cars exited their car, and were struck by a fifth car that fled the scene.
  • A pedestrian was hit and killed as he ran across Interstate 880 near Hegenberger Road in Oakland at around 11:15 p.m. on Friday.

If the police are able to locate the driver of the fifth car who hit and killed the two people in the multi-vehicle hit and run, then he/she may be liable for both criminal charges and civil lawsuits. Assuming that the driver has insurance (and hopefully he/she does!), then the insurance company would have a duty to defend the driver in a lawsuit, and possibly to pay the injured party if the act is covered by the insurance policy. SUV’S HIGH RISK IN ROLLOVER CRASHES IN CALIFORNIA- CALL A SAN FRANCISCO ACCIDENT LAWYER (PART 2 OF 2)

The National Highway Traffic Safety Administration’s (NHTSA) report on rollover accidents shows that SUV involved rollover accidents increased from 22% in 1991 to 37% in 2000. This increase is not necessarily because of design or manufacturing defect, but perhaps because of the SUV’s increasing popularity. In the report, researchers found that SUVs are the only vehicle type in which the number of fatalities resulting from rollover accidents is greater than the number of fatalities resulting from non-rollover crashes. In fact, in 2000, approximately two-thirds of fatalities in SUV accidents were in rollover crashes.

SUVs, pick-up trucks and vans all fall within the category of vehicles that have more risk of being involved in rollover accidents. These vehicles have a higher center of gravity, which makes them more top heavy and susceptible to rollovers. In addition, the expectancy that these types of vehicles will carry more weight in the form of cargo or passengers adds to the danger of rolling over.

According to a report published by the National Highway Traffic Safety Administration (NHTSA), the increasing popularity of sport utility vehicles (SUV) has contributed to the overall increase of rollover accidents. The Characteristics of Fatal Rollover Crashes, was published in 2002 by the NHTSA, and included some of the following statistics:

  • Rollover crashes make up about 20% of all fatal crashes.

The NHTSA report also looked at several causes of rollover accidents and the fatalities that occurred. In over three-fourths of the fatalities, the victims were not wearing seat belts. The study also found that in most of the accidents, the vehicles were either traveling straight forward, or were trying to maneuver a curve. Additionally, more than one-fourth of fatal rollover crash drivers did not attempt any kind of avoidance maneuver.

DEADLY THREE-CAR CRASH ON I-680 IN CONCORD, CA. MATTRESSES ON ROAD LIKELY CAUSE.

A man from Antioch, CA died in a multiple vehicle accident on Interstate 680. The crash occurred near Concord Avenue in Concord. The 31-year-old victim allegedly swerved to avoid a pair of mattresses lying on the center lanes of the Highway. That caused a chain reaction including two other cars and resulted in the man's death. While driving down the interstate, according to CHP, the victim veered left when he noticed the mattresses. Through the swerving, he made contact with a car passing on his left which sent both cars spinning into the center divide. The man's car continued spinning, now without headlights, back into traffic where he was struck by yet another car. This final crash ejected the man from his car. The collision happened shortly after midnight and resulted in multiple lane closures. The accident occurred on a Sunday evening at North First Street and State Highway 237 in San Jose. The coupe rear-ended the SUV, and the result was a deadly roll over. PEDESTRIAN KILLED BY CALTRAIN IN MOUNTAIN VIEW. THIRD SAN MATEO COUNTY CALTRAIN ACCIDENT IN EIGHT DAYS. 13 CALTRAIN DEATHS THIS YEAR.

A third person has been struck by a Caltrain in an 8 day period on the Peninsula. The two other train-related crashes (one killed a truck driver and the other hospitalized a woman with head injuries) have been addressed in previous blogs. In this latest crash, the pedestrian was hit by a Cal train while crossing railroad tracks in Mountain View. He later died. 13 people have died this year in Caltrain crashes. The three recent Caltrain collisions have all occurred in San Mateo County. WOMAN IN CRITICAL CONDITION AFTER GETTING HIT BY CALTRAIN IN SAN JOSE. NO ALERT LIGHTS, GATE OR BELLS AT RR TRACK CROSSING.

A woman driving a Toyota Camry sustained severe head injuries after getting hit by a Caltrain in San Jose. The victim was driving across train tracks south of Blossom Hill station. The place where she crossed is a “private passage,” with a crosswalk and stop sign, but no warning gates, bells or lights as most active crossings have. TWO WRONGFUL DEATH SETTLMENTS REACHED BY SAN FRANCISCO BOARD OF SUPERVISORS FOR VICTIMS OF TAXI CRASH AND NOB HILL FIRE.

In two separate SF incidents, families of men who were killed sued the city for wrongful death. San Fran's Board of Supervisors approved compensation to the families totaling over $1.8 million. The financial settlements are awaiting final approval from the Mayor. While the city of SF admits no liability in either case, $1,695,000 was awarded to the family of a man who died in a taxi cab accident after being treated at SF General, and $150,000 was awarded to the estate of a man who died during a botched fire rescue attempt. In the larger settlement, a Michigan man died a month after he was in a taxi crash in 2006. The lawsuit filed by the victim's family claimed that the man received “misdiagnosis and improper care” from San Francisco General Hospital. He died a month after the accident. The other settled case was filed on behalf of a man who died when he fell from a 4-story Nob Hill apartment building during a fire. The victim fell to his death as a fire fighter was trying to pull him to safety from a rooftop fire escape ledge. His family's lawsuit alleged that the firefighter attempting the rescue behaved inappropriately by acting recklessly, disregarding command structure and ignoring safety protocol. SAN FRANCISCO PEDESTRIAN, BICYCLE & CAR CRASH DEATHS & INJURIES INCREASE DRAMATICALLY

The most recent SF Collision report, compiled by the San Francisco Municipal Transportation Agency from CHP statistics, shows a disturbingly high rise in traffic-related injuries and deaths. In 2007 pedestrian accidents were up more than 50%, composing more than half of all traffic deaths. Bicycle-related crashes rose over 30%. Vehicle-related deaths are also up over 50%, while injuries from accidents involving motor vehicles are also on the rise. Injuries incurred in road accidents can include brain and spinal injuries, broken limbs, burn injuries, paralysis and laceration. The report also showed that certain SF intersections are particularly dangerous for walkers. Additionally, as previously blogged, Muni buses are posing a growing threat to SF residents with two deaths already this year. AMTRAK TRAIN CRASH IN RICHMOND KILLS MAN

A 27 year-old man driving a Honda Accord died when his car was hit by an Amtrak train in Richmond, CA. Apparently the driver went around the boom barrier before he was struck. DANGEROUS, RECKLESS & DRUNK DRIVING ON BAY BRIDGE A THREAT TO CITIZENS

A special report by Channel 2 (KTVU) looked into a frightening Bay Area menace: extremely dangerous driving behavior on the Bay Bridge. The Bridge connects San Francisco to the East Bay, and as discussed in an earlier blog, Bay Area Bridges pose a number of hazardous factors to drivers. In their report, the news channel brings up yet another danger: drunk drivers racing and swerving across the San Francisco – Oakland Bay Bridge on the weekends, often while under the influence. Accidents involving high speed impact can have devastating results including brain and spinal cord injuries, paralysis, burn-related injuries, broken arms or legs, and death. According to the CHP, since Jan 2007 nearly 365 people have been arrested for DUI's on the Bridge in early morning hours – from 1am to 6am, and most of these occur on Friday and Saturday mornings. In August a passenger in the back seat of a Mercedes was killed when a Subaru Impreza going over 100 mph smashed into him. The speed limit on the bridge is 50 mph; however, KTVU's investigation spotted many cars traveling at over 80 mph, some more than 90 mph. The driving which threatens law abiding bridge users is reckless, with dangerously high speeds, lack of signaling during lane changes, abrupt lane changes, and frequently influenced by drugs and/or alcohol.

SF MUNI BUS CRASHES & CABLE CAR ACCIDENTS RISE SHARPLY IN 2008.

In startling new information released by the San Francisco Municipal Transportation Agency, pedestrian and other accidents involving Muni streetcars, cable cars, and buses are increasing dramatically. The new information from SF’s Transit agency is shocking. Pedestrian accidents have nearly doubled in the past year, while bike, car, bus, and passenger crashes are also on the rise. Municipal authorities concede that a culture of Muni driver aggressiveness and carelessness may be a contributing factor to the high number of accidents.

INJURED IN DRUNK DRIVING ACCIDENT IN DANVILLE, CA?

Drunk driving is suspected in a multi-vehicle accident that occurred mid-day on Interstate 680 in Danville leaving three people injured. The crash included two cars, a flat bed truck and a tow truck. A Subaru Forester and the tow truck were pulled over to the side of the highway when they were struck by a two-axel flatbed truck. The tow truck driver was critically injured during the crash, as he was pulled under his truck by the force of the collision. The accident occurred on southbound Highway 680 and resulted in the brief closing of the entire freeway. SAN JOSE ACCIDENTS: MERGING ONTO A HIGHWAY
