Even though the criminal civil court systems are completely separate, there may still be some overlap in certain cases. For example, a person facing a criminal case for murder could also be sued by the victim’s family for wrongful death. On February 2, 2010, Joshua West was killed as he rode his bicycle through the intersection of Lark Avenue and Garden Hill Drive in Los Gatos. The SUV driver was Kevin Derr, who allegedly sped through the intersection and lost control. Witnesses have told police that they watched as Derr sped into the right turn lane, went up onto the sidewalk and hit West, then continued through the intersection where he hit the base of a traffic light. After investigating the accident, police determined that Derr’s driving was grossly negligent because of the weather conditions and the fact that he did not intend to make a right hand turn.

Derr was injured and taken to a hospital; West was the single father to a 7 year old girl. Derr now faces charges of vehicular manslaughter, and may also face a civil lawsuit by West’s daughter and other family members. On January 15, 2010, a driver was killed in Oakland near San Leandro Street after he crashed into a pole or a parked vehicle. It is a common misconception that just because someone injures you, you will be able to win a lawsuit against them. Barbour also pleaded guilty to involuntary manslaughter and reckless driving earlier this year. He was sentenced to two years in prison. According to court testimony, another car had drifted to the SUV’s lane, and when the SUV went to the left lane to avoid the vehicle, it flipped and rolled over four and a half times.

The National Highway Traffic Safety Administration released a report in 2002 about the characteristics of fatal rollover crashes. These were their findings:

• There were approximately 42,000 fatalities annually between 1991 and 2002;
• About 75% of the occupants of fatal rollover crashes were not wearing seatbelts or other restraints;
• Rollover crashes constitute about 20% of all fatal crashes;
• SUV rollover crashes doubled between 1991 and 2002, growing more than any other class of light trucks;
• Speed is considered to be an important factor in rollover crashes—most crashes occurred while the vehicle was going 55 miles per hour or faster;
• Through the statistics, the drivers of the rollover vehicles seem to be men under 40 years of age who were driving on two way roads with no dividing barriers;
• Rollover crashes are more likely to result in fatalities than are non-rollover crashes;
• In 2000, approximately 36% of sport utility vehicles involved in a crash experienced a rollover;
• In most cases where the passengers were restrained during a rollover accident, they were not ejected from the car;
• Most rollover fatalities were single vehicle accidents.

The increase in SUV rollover crashes can be correlated to the increase in popularity of the vehicles. Rollover crashes may be more common in light trucks and SUVs because of their high center of gravity. When there are problems with products, companies will issue a recall to warn the public about the safety issues in the product, or as a notice that those consumers should bring in their product to be fixed or exchanged. These issues are addressed in court primarily as product liability cases because the issue usually goes to the design or manufacture of the product. For example, if a blow dryer short circuits because of a design flaw and electrocutes you, then it would be a product liability case. On September 29, 2009, Toyota Motor Corporation recalled 3.8 million cars in the United States because of a safety hazard involving the car’s floor mats. The recall involves the Toyota Camry, Avalon, Prius, Tacoma and Tundra, as well as several Lexus models. A jury in Cook County, Illinois, found in favor of a car salesman’s family in a wrongful death lawsuit on Monday, April 20, 2009. A week later, on Friday, March 27, 2009, in an unrelated accident, Abella Lastimosa died in a crash at the intersection of Geneva Avenue and Stoneridge Lane in San Francisco. Lastimosa was a San Francisco resident, and was in a wheelchair. The driver of the car was headed west on Geneva Lane and struck Lastimosa, who was headed south on Stoneridge lane. The driver of the car stopped at the scene of the accident, but the cause is still being investigated.

Generally, there are very few incidents in which individuals can sue police officials for wrongdoing in the line of duty. In order to do their job effectively, police officers may not be civilly liable for causing damage to property or people because if they were, then they may not be able to act speedily in emergency situations. For example, if there is a burning house, police officers and firemen may destroy property in order to reach someone inside, but they would not be civilly liable in a lawsuit if the property owner decided to sue them for damaging the house. However, there are different standards that must be met in different situations, even for emergency officials. If, for instance, a police officer was pursuing a suspect, and shot into a crowd of people, this would likely be outside of his standard of duty and would probably be considered negligent if he shot and killed an innocent bystander.

The Indiana Supreme Court held that law enforcement immunity did not protect police officers from negligent lawsuits arising from car chases gone wrong. This unanimous ruling in 2006 led to the lawsuit settlement for Richard Garman on March 23, 2009. There was a high speed car chase in 1999 in which police officers were wrongly informed that a car had a stolen license plate. When they pursued the car, the driver, Jessie L. Smith, fled and crashed into Garmen’s car, severely injuring Garmen and killing his fiancée. The lawsuit settled for $75,000 for Garmen’s injuries, his emotional distress and the depression that resulted from his fiancée’s death. The lawsuit was not aimed at Smith, who was sentenced to three years in prison, but rather at police officials in Indiana who, Garmen claims, have too much leeway in their car chases. The city of Indianapolis likely settled the lawsuit in hopes of avoiding a costly trial without having to admit liability.

• On March 13, 2009, a pedestrian was hit and killed on southbound I-280 in San Mateo County. The California Highway Patrol reported that the 45 year old victim walked into the path of a BMW and was struck. The driver of the BMW immediately pulled over, but it is reported that several other vehicles struck the victim but failed to pull over. The victim was a resident of Gilroy, but his identity has not yet been released. It is also reported that shortly before the accident, a tour bus pulled over in the area, and later passengers reported that there was a passenger missing. The CHP is still investigating the incident and closed down the lanes on I-280 for several hours.
• Another victim was struck in El Cerrito while walking in the crosswalk of Blake Street near Kearney Street, in front of the BART station. The pedestrian was blind and was walking with his white cane in the crosswalk when a Toyota Camry struck him and fled the scene. Police are still looking for the driver of the vehicle for hit and run.

According to the National Highway Traffic Safety Administration research note on alcohol-impaired driving fatalities:

• There was an estimated 12,998 people killed in 2007 as a result of an alcohol-impaired driving crashes.
• There was a 3.7% decrease from the fatalities in 2006. Twenty five states and the District of Columbia had an increase in the number of impaired motorcycle riders.
• The highest number of drunk driving fatalities was in the 25-34 age group and the second highest number was in the 45-64 age range.
• Fifty-six percent of the total number of drivers in fatalities had a blood alcohol content of above .08%.
• Males comprised of 83% of drivers in fatal crashes with a blood alcohol content of over .08% and women comprised of 15%, with an unknown 2%.
• Fifty-five percent of drivers involved in fatal crashes with a blood alcohol content of .08% and above were not wearing seat belts or helmets, while 34% used them and it is unknown for 11% of them.
• The highest number of drunk driving fatal accidents occurred in passenger cars, and then light trucks, and then motorcycles.
• Fifty-seven percent of the drunk driving accidents occurred on the weekends, and most occurred between midnight and 3 a.m.
• Most of the drunk driving accidents (68%) were single vehicle accidents while 32% were multiple vehicle accidents.

Hitting a pedestrian might be a result of an accident, or even because of the pedestrian’s negligence. However, it is illegal and reckless to fail to stop after you have hit a pedestrian. On Monday, March 2, 2009 a body was found near Highway 680 in San Jose at the McKee Road off-ramp.
