A jury in Ventura County, California awarded $7.75 to Maria Arellano and her family on Friday, December 11, 2009 for an elder abuse cause of action. The lawsuit involved a videotape of Arellano being abused by an employee of the Fillmore Convalescent Center, Monica Garcia. Garcia pleaded no contest to simple battery and was attributed with 20% of the lawsuit damages. Arellano was a stroke patient who was unable to communicate her abuse; however, despite the lawsuit, she is still under the care of the same convalescent center. The family was awarded $2.75 million in actual damages and $5 million in punitive damages.

SAN FRANCISCO WOMAN ARRESTED FOR STEALING FROM ELDERLY: ELDER ABUSE LAWYERS CAN HELP IF YOU ARE A VICTIM

Last year, San Francisco District Attorney Kamala Harris developed the San Francisco Elder Abuse Forensic Center, a new partnership with San Francisco Police Department and the Department of Aging and Adult Services. Elderly citizens might be more susceptible to abuse because their care might be limited to a certain number of people. An accomplice of Mr. McVickar’s pleaded guilty to helping him cash in checks. Mr. McVickar has agreed to serve up to nine years in jail as part of his plea bargain.

Now a threesome of scammers allegedly preying on the elderly has been caught by one of their potential victims. Three LA men have been arrested in conjunction with posing as professionals to gain access into homes of seniors and then robbing them. CALIFORNIA ELDER ABUSE AND DEPENDENT ADULT CIVIL PROTECTION ACT

Elder abuse can take many forms, including domestic elder abuse, institutional abuse and self-neglect. Domestic elder abuse occurs in the home of the victim or the caregiver, and the abuser most commonly in these situations are a family member, friend or paid caregiver. Institutional abuse occurs in a nursing home or other such assisted living facility. Lastly, there is self neglect in which the elderly person’s own actions endanger his/her life, such as depriving oneself of food and water. However, this last category of self neglect is not a crime. Institutional abuse was the basis of a recent lawsuit filed in Alameda County.

A Northern California resident filed a civil lawsuit against the High Street Care Center for elder abuse on Monday, November 3, 2008. The patient, Grover Brown, suffered from paraplegia and multiple sclerosis. The lawsuit filed on behalf of Mr. Brown alleged that the nursing home neglected to protect him from bed sores, and as a result, it led to such severe infection of his bone and bone marrow that he had to have his coccyx removed. Although Mr. Brown is only 39 years old, he is protected under the California Elder Abuse and Dependent Adult Civil Protection Act. This Act protects the elderly and dependent adults from willful actions of their caretakers.

In the scam, the travel agent took money for trips, reservations and tour packages to China for senior clients, but while providing a receipt, she never actually booked plane tickets or made reservations or arrangements. ELDER ABUSE CLAIMS IN SAN MATEO COUNTY. WATCHDOG ORGANIZATION LOSES FUNDING.

San Mateo County's ombudsman program for elder abuse lost 20% of its budget due to Governor Schwarzenegger's state service cuts. The ombudsman program investigates claims of elder abuse in the area, servicing about 500 elder-care facilities and over 9,000 senior citizens.
