On January 15, 2010, a driver was killed in Oakland near San Leandro Street after he crashed into a pole or a parked vehicle. The four people who died in the crash included her domestic partner, her brother and the couple’s three year old twins. The twins were not in car seats, and one boy was ejected from his seat while the other was found pinned under the steering column. Both Schaefer and Reynolds could face time in jail, as well as civil lawsuits from the family members of the people that they injured while they drove under the influence.

MOTORCYCLE AND BIG RIG TRUCK CRASH RESULTS IN DEATH IN SF EAST BAY, CA

  • There were 72 fatal collisions in which the driver was under the influence of alcohol or another drug, and 112 fatal collisions in which unsafe speed was the cause of the accident.
  • Other causes of fatal collisions included: driving on the wrong side of the road (34); improper turning (40); traffic signals and signs (13); other hazardous violations (11).
  • There were 2,776 injury collisions in which the motorcycle driver was going at an unsafe speed, and 1,201 collisions as a result of improper turning.
  • Other causes of injury collisions in motorcycle accidents include: driver was under the influence of alcohol or other drug (443); wrong side of the road (275); improper passing (175); unsafe lane change (167); automobile right-of-way (206); traffic signals and signs (136).

  • A California Highway Patrol officer was struck and suffered injuries in an accident on Tuesday, February 10, 2009 on Highway 880. The officer was on his motorcycle traveling in the left lane when a woman driving a Buick LeSabre veered into his lane. The officer tried to slam on his brakes, but could not avoid hitting the back of the Buick. He was taken to the hospital with a broken ankle; investigators stated that alcohol was likely not a factor in the collision.

ALCOHOL PLAYS ROLE IN CAR CRASHES AND MOTORCYCLE ACCIDENTS AROUND BAY AREA

  • Two vehicles collided in San Mateo County and sent one car over a cliff on Sunday, December 28, 2008. After the collision, one car dove off of Devil’s Slide, which is south of Pacifica on Highway 1. Five people were injured in the crash. Officials arrested one person on drunk driving charges after it was determined that alcohol was a factor in the car crash.
  • On Saturday, December 27, 2008, a motorcyclist who had been involved in a crash the previous day died at the hospital. The motorcyclist was 53 year old Bobby Walker, who was riding his Harley Davidson on Highway 80 near American Canyon Road. California Highway Patrol has reported that Mr. Walker had approached stopped traffic at a speed of 65 miles per hour. He lost control of the bike and was ejected from his seat. Officials have also reported that alcohol may be a factor in the incident.

CAR AND MOTORCYCLE ACCIDENTS IN THE EAST BAY ON THE RISE

As the holiday season rolls around, the highways and public transportation systems are busy with travelers. Five people were killed in various motorcycle and car accidents in the Bay Area, between Friday, November 21, 2008 and Sunday, November 23, 2008. According to the California Highway Patrol, all of the accidents remain under investigation.

  • A fatal motorcycle accident occurred in Contra Costa County at 11:30 a.m. on Sunday, near the Willow Pass on-ramp on Highway 4.A man was killed as he was traveling eastbound on Interstate 580 and drifted onto the shoulder, then overcorrected to the left and lost control of his car. The accident happened around 3 a.m. on Sunday near Keller Avenue in Oakland.
  • Two people died in a multi-vehicle hit and run on westbound Interstate 80 in Richmond on Saturday at about 3:50 a.m. According to police, the initial crash involved four different cars but the fatalities occurred when the victims of one of those cars exited their car, and were struck by a fifth car that fled the scene.
  • A pedestrian was hit and killed as he ran across Interstate 880 near Hegenberger Road in Oakland at around 11:15 p.m. on Friday.

If the police are able to locate the driver of the fifth car who hit and killed the two people in the multi-vehicle hit and run, then he/she may be liable for both criminal charges and civil lawsuits. Assuming that the driver has insurance (and hopefully he/she does!), then the insurance company would have a duty to defend the driver in a lawsuit, and possibly to pay the injured party if the act is covered by the insurance policy. If the insurance company fails to do so, then it will be acting in bad faith.

The study also found that in most of the accidents, the vehicles were either traveling straight forward, or were trying to maneuver a curve. Additionally, more than one-fourth of fatal rollover crash drivers did not attempt any kind of avoidance maneuver.

The most recent SF Collision report, compiled by the San Francisco Municipal Transportation Agency from CHP statistics, shows a disturbingly high rise in traffic-related injuries and deaths. In 2007 pedestrian accidents were up more than 50%, composing more than half of all traffic deaths. Bicycle-related crashes rose over 30%. Vehicle-related deaths are also up over 50%, while injuries from accidents involving motor vehicles are also on the rise. The report also showed that certain SF intersections are particularly dangerous for walkers. Additionally, as previously blogged, Muni buses are posing a growing threat to SF residents with two deaths already this year.
