In Cotati on December 21, 2009, Vicente Zaragoza was killed by a front loaded at the Sonoma County dump. He was employed by Sonoma Compost and had worked there 10 years this month. Playground injury cases can fall under the category of premises liability or product liability issues. The Centers for Disease Control and Prevention have noted that the major risk factors of death by drowning include: lack of barriers and supervision, age and recreation in natural settings, alcohol use and seizure disorders. Although many children drown in swimming pools or lakes and rivers, a significant amount of children also drown in buckets, toilets and bathtubs. There may be a lack of awareness that children are able to drown in such areas, but a simple child lock on toilet seats can be an effective preventative measure.

In December 2007, there was a federal law called the Virginia Graeme Baker Pool and Spa Safety Act which requires that public swimming pools update the drains in their pools to prevent swimmers from being trapped, injured or disemboweled in the drains. The new law requires these drains to be dome shaped, rather than flat, to decrease the amount of surface area that a swimmer can get sucked into. Although the law was put into effect in 2007, the government allowed a grace period of one year for public pools to comply. The deadline is approaching for these new drains to be installed. Approximately eighty percent of the public pools in the country still have not complied with the regulation.

Backyard swimming pools are extremely dangerous, especially for young children. Drowning is one of the leading accidental death causes in the United States and may occur in the blink of an eye. Black Friday, the day after Thanksgiving, is notorious for large mobs of shoppers looking for good deals. A recent occurrence on November 28, 2008 showed the danger of some workplaces, but was also an unusual incident that may not happen often. Jdimytai Damour, a Wal-Mart employee, was trampled to death early Friday morning as he and other employees prepared to open the doors to anxious shoppers.

She was riding on Superman Tower of Power, which lifted the riders off the ground and then dropped them at high speeds, when one of the cables broke and severed her feet. Katilyn’s medical bills have totaled more than $500,000 since the accident; she has undergone four different amputation surgeries. State officials investigated the incident and determined that the incident may have been avoided if the park operators had followed the ride manual’s instructions for detecting if there was deterioration in the cables. Additionally, the officials determined that if the ride operator had pressed the emergency button immediately, Kaitlyn would have been able to escape with only cuts and scrapes.

In the case where someone gets injured on someone else’s property, victims may sue the individuals who own the property which they were injured upon. However, there are several restrictions on who may sue, and on what basis. There are three different categories to determine if the victim has any right to sue the landowner: trespassers, licensees and invitees. A trespasser is someone who enters the land without the express or implied permission of the owner. In many cases, the owner does not owe a duty to the trespasser, and may not need to warn him about different dangers, or to maintain the property in a special way.

Licensees are those people who may be expressly or impliedly invited by the landowner. Contrary to what the name may imply, this category includes friends who are visiting as well as salesmen who are going door-to-door. The landowner in this case is not required to make efforts to make the property safe for the licensees, but must warn the licensee of any dangers on the land that is known to the landowner. For example, Paul the paintbrush salesman would not succeed in a lawsuit against Debbie the houseowner if he tripped and fell in a hole that Debbie did not know about. A local newspaper reports that a large crater-like hole exists on a 19th Avenue sidewalk in San Francisco. Per complaints from residents, the paper investigated and found the treacherous opening on a busy stretch of road. A man was killed while driving a hay-filled tractor trailer at a dairy in Petaluma in Sonoma County, CA. The worker was reversing up a dirt road when the trailer fell of the road and rolled over. In two separate SF incidents, families of men who were killed sued the city for wrongful death. San Fran's Board of Supervisors approved compensation to the families totaling over $1.8 million. The financial settlements are awaiting final approval from the Mayor. While the city of SF admits no liability in either case, $1,695,000 was awarded to the family of a man who died in a taxi cab accident after being treated at SF General, and $150,000 was awarded to the estate of a man who died during a botched fire rescue attempt. In the larger settlement, a Michigan man died a month after he was in a taxi crash in 2006. The most recent SF Collision report, compiled by the San Francisco Municipal Transportation Agency from CHP statistics, shows a disturbingly high rise in traffic-related injuries and deaths. In 2007 pedestrian accidents were up more than 50%, composing more than half of all traffic deaths. Bicycle-related crashes rose over 30%. Muni bus and street car crashes with bicyclists, pedestrians and other vehicles have increased sharply in the past year. Two men who were attacked by a tiger at San Francisco Zoo last year are suing the Zoo and city officials for negligence. The incident received international attention, and a third man was killed in the Siberian tiger attack. The suit will claim that the animal was not appropriately or safely kept in the park.
