LARGE VEHICLES AND HEAVY EQUIPMENT KILL TWO MEN IN SEPARATE ACCIDENTS IN COTATI AND REDWOOD CITY

There are many hazardous and dangerous professions, including construction and other jobs involving large vehicles and equipment. Although there might be safety precautions put in place, accidents still may occur because of equipment malfunction or human error. Employees who are injured during work may be entitled to worker’s compensation for their injuries, but if they file for worker’s compensation, they may not be able to file third party personal injury lawsuits against their employers. If you are unsure about whether you have a legal cause of action, then you should contact the lawyers of Greenberg & Rudman LLP for a free consultation of your case at 1-800-252-9776 (1-800-ALAWPRO).

In Cotati on December 21, 2009, Vicente Zaragoza was killed by a front loaded at the Sonoma County dump. He was employed by Sonoma Compost and had worked there 10 years this month. Zaragoza was wearing a safety vest and hat and was sorting through plastics and metal from a pile when he was run over by a front loader while it was backing up. The front loader generally emits a beeping sound when it backs up—Cal/OSHA will be investigating the incident and the equipment for the next couple of months. The driver stated that he simply did not see Zaragoza because he was in a blind spot. In an unrelated accident on December 22, Jose Villaneuva was struck and killed by a dump truck in Redwood City. The accident happened around Marine Parkway and Twin Dolphin Drive when Villaneuva was helping the truck driver back up.

Cotati.jpg The incident is still under investigation and the cause of the accident is still unknown. Villaneuva was taken to a local hospital and pronounced dead. These accidents are very unfortunate and not only affect the victims’ families but also the other employees. If the investigations show that there was equipment malfunction or if there was negligence, then the victims’ families may be able to pursue a lawsuit to be compensated for their injuries. Greenberg & Rudman LLP represents people who have been seriously injured as well as the families of those who have been killed under wrongful death circumstances. We have won over $150 million for our clients in verdicts and settlements. Call us now at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation. MAN WINS LAWSUIT WORTH MILLIONS AGAINST COUNTY AND STATE GOVERNMENTS FOR INJURIES CAUSED BY TREE LIMB FALLING—ANTIOCH LAWYERS CAN HELP YOU NOW

Federal, state and local governments have responsibility in maintaining parts of the United States, so if something happens on federal or state land, the proper authorities are responsible for it. This not only applies to where lawsuits are held, but also to who may be responsible for the injury. State and local governments are responsible for most of the roads and pathways, and if accidents occur as a result of that maintenance, then they would likely have responsibility. For example, if the signs on a certain road are inaccurate and cause an accident, the city or state may be responsible for a part of the accident, and maybe even the entire thing.

In Delaware on October 30, 2009, Kenneth Matlock won $6 million for the injuries that he sustained when a tree limb fell on his car and broke his neck. The incident happened in 2006 when he was driving in the car with his wife and three children. The tree limb fell on top of their SUV, and the car continued until it hit a guardrail on the opposite side of the road. Matlock’s wife’s neck was broken as well, and he lost use of his right hand. It was determined that the tree was the responsibility of the Department of Transportation of Delaware, and because of the flooding that had happened there, the tree was rotted out.

Antioch.png A tree expert and registered arborist testified for Matlock and stated that the state should have known about the condition of the tree and should have corrected it before the accident occurred. The jury unanimously awarded the damages to the Matlocks. Have you or a family member been injured in a car accident or any other incident that involved the negligence of the state government? If so, you should contact the attorneys of Greenberg & Rudman LLP right away for a free consultation of your case. Pick up the phone and call us now at 1-800-252-9776 (1-800-ALAWPRO). GIRL AND FAMILY SETTLE FOR $2.2 MILLION IN PLAYGROUND CHOKING ACCIDENT—CALL SAN FRANCISCO PREMISES LIABILITY AND PRODUCT LIABILITY ATTORNEYS NOW (Part 2 of 2)

Playground injury cases can fall under the category of premises liability or product liability issues. If the injury occurred because the area was not properly maintained or posed other safety issues, then it would likely fall under a premises liability case, where the owner of the premises would be responsible for the damages. However, in a product liability case, there would have to be a defect in the design or the manufacturing of the playground equipment. The family of Tanayia Blanchard was awarded $2.2 million in addition to another $7 million settlement they received a couple of years ago for the injuries that the girl suffered at a playground.

The incident occurred in 2006 when Tanayia was found unconscious hanging from a rope off of a playground structure. The lawsuit was against the housing authority where the playground was located and against a city police officer for failing to resuscitate her when he reached the scene of the incident. The police officer, Kendrick Wong, determined that the girl did not have a pulse and began to treat the playground as a crime scene. It turned out that the girl was still alive, and remains in a vegetative state to this day. The rope was placed on the playground structure as a part of the “zip line” equipment so that the younger children could reach the handle.

Playground.jpg The damages awarded to the family will mostly go to the care of the girl, who requires 24 hour medical care at a skilled nursing facility. Has your child been injured in a playground or pool incident and you want to recover compensation for your damages? If so, you need to contact the law firm of Greenberg & Rudman LLP immediately for a free and confidential consultation of your case at 1-800-252-9776 (1-800-ALAWPRO), or visit our website www.alawpro.com for more information on premises liability and product liability lawsuits.

SWIMMING POOL AND PLAYGROUND ACCIDENTS CAN END IN COMPENSATION OF DAMAGES FOR FAMILY MEMBERS—CONTACT VALLEJO LAWYERS FOR FREE CONSULTATION (Part 1 of 2)

Although places like the playground and swimming pools are great for entertaining children and adults alike, they still have tremendous risk and danger involved. Children can easily drown in swimming pools if they are not properly supervised, or if they are not taught about safety precautions around the pool. It may seem as though playgrounds only pose a limited amount of danger, like falling from the monkey bars or the swings, there are a lot of hidden dangers that parents don’t think about. For example, children can fall down a slide and sustain brain injuries.

A Vallejo boy was pulled from the water in Contra Loma Regional Park near Antioch on September 27, 2009. The boy, Brian Vargas, had arrived at the park with his family and immediately went into the water. Seconds later, the lifeguards found him floating in the water. They made attempts to revive him but he later died at the hospital. According to the Centers for Disease Control and Prevention, there are approximately 3,582 fatal unintentional drowning each year. More than one in four of these fatalities are children under the age of 14. Males are also four times more likely to drown than females.

Swimming%20Pool4.jpg In order to be successful in a personal injury lawsuit involving swimming pools, the person who sustained the damage (or his family if he passed away as a result of the accident) will have to show that the person who owns the pool was negligent in some way. For example, the owner failed to put warning signs around the pool, or improperly maintained life guards on the premises. CLAYTON, CA PUBLIC PARK AND SLIP & FALL INJURY LAW FIRM

Clayton, California is located in Contra Costa County near Danville, San Ramon, Concord and Walnut Creek. As of the 2000 census, it had a population of 10,762 residents. The Oakhurst Country Club is located near Clayton, along with other naturally scenic areas. There are also bicycle, pedestrian and equestrian paths throughout the city, which makes the area a nice place to visit as well as to live. FAMILY SETTLES IN SAN FRANCISCO ZOO PERSONAL INJURY CASE

Civil lawsuits and criminal cases are very different cases—criminal cases are usually tried in front of a jury and the defendants must be found guilty beyond a reasonable doubt. However, in most civil lawsuits, the jury or the judge may find that there was only negligence, which means that the defendant does not even need to have the intent to commit the wrongdoing. For example, in a medical malpractice lawsuit, the doctors who caused the death of a patient because they failed to do something, or did something wrong, do not need to have intended the wrongful act to be liable for the lawsuit. The doctor only needs to meet a certain level of negligence, which is a standard that most other doctors in the field would have met. Whereas if the doctor were being convicted in criminal court, then it would have to be shown that he had intended the harm, or purposely caused the injury.

On Christmas day in 2007, a Siberian tiger in the San Francisco zoo leapt out of its cage and attacked Carlos Sousa, Amritpal Dhaliwal and Kulbir Dhaliwal. Carlos Sousa died as a result of the mauling, but the Dhaliwal brothers survived the attack. The Sousa family filed their own lawsuit, and has settled out of court with undisclosed details. The Dhaliwal brothers sued the San Francisco Zoological Society, the city of San Francisco and the zoo spokesman Sam Singer last November. The lawsuit claimed that the brothers’ civil rights had been violated, that the zoo was negligent and accused Singer of libel and slander. The Zoo is insured and its insurance company handled its legal defense. The brothers settled with the defendants for $900,000. Both parties considered this to be a win even though the amount is relatively modest in personal injury settlements.

AMUSEMENT PARK RIDES POSE DANGER TO VISITORS—CALL SF BAY AREA LAWYERS NOW

As summer quickly approaches, many families are headed to amusement parks, water parks and county fairs for easy entertainment. However, there are often reports in the news about injuries sustained at amusement parks because of ride failure, or improperly taken safety precautions. Amusement park owners and operators are responsible for the safety of the rides, and for maintaining those rides. They are likely responsible for most defects that occur on the rides, except for rider recklessness, or natural disasters that may have caused the incident. However, even with rider recklessness, a jury may still find responsibility on the part of the ride operator/owner.

In 2006, the Consumer Product safety Commission’s National Electronic Information Surveillance System reported that there were 8,800 ER-treated injuries in amusement park rides. Of those injuries, 3,700 were in fixed site rides, or amusement parks, 2800 were in mobile rides, such as fairs and carnivals and 2,300 in unknown site rides. There were also 3,600 injuries on inflatable amusement rides, and 3,100 injuries on public water slides. The highest number of injuries occurred in go-kart riding accidents, which also included home and street racing, as well as in amusement parks.

Being in a lawsuit against a giant entity like an amusement park can be extremely difficult to maneuver. Large law firms representing the amusement parks may try to get you to settle for much less than you have been injured, or may create unnecessary hassle for you during the court process. Your best option would be to consult with an experienced attorney immediately. Call Greenberg & Rudman LLP now at 1-800-252-9776 (1-800-ALAWPRO) for a free and confidential consultation. We handle cases on contingency basis, which means that you will pay no fees or costs unless we win the case for you. Visit our website, www.alawpro.com to read more about personal injury lawsuits and the different injuries that can occur on amusement park rides.

Males are four times more likely than females to die from unintentional drowning, and 30% of all children between the ages of one and four who died in 2005 died from drowning. A jury in Santa Barbara, California, on April 27, 2009, awarded $14 million in compensatory damages to the parents of a four year old boy who drowned in a Cathedral Oaks Athletic Club swimming pool in 2005. The boy, Yoni Gottesman, was attending a summer camp at the Club, which was unlicensed to run the summer camp. During the trial, there was a surveillance video showing the boy playing in the water with camp counselors, and then floating in the pool shortly thereafter. The surveillance also showed the counselors sitting around the pool, and the lifeguard getting out of his chair to buy a soda. The jury found that there was clear and convincing evidence that the employees there acted with malice, oppression and fraud, which allows punitive damages to be discussed in a second part to the trial. The compensatory damages included an amount for negligence, funeral and burial expenses and medical expenses.

Losing a child in a preventable accident is a devastating situation. The attorneys at Greenberg & Rudman LLP may not be able to bring your child back, but we may be able to obtain compensation for your child’s injuries. HERCULES, CA SLIP AND FALL, PERSONAL INJURY ATTORNEYS

Hercules was previously a very small bedroom community in Contra Costa County, but has grown rapidly over the years. It has a population of 24,776 as of the 2006 estimated census and is located along the I-80 in Contra Costa County. It is located near San Francisco and Oakland, which allows its residents to commute to the cities during the day, but reside in Hercules. The city is also surrounded by Pinole, Rodeo and Martinez. In 2000, Hercules made a big push to become a transit-oriented, pedestrian-friendly and mixed-use town. This means that there are more transit options, such as Amtrak or ferry service, and more of a centralized feel in which residents may have the benefits of big city living while in a smaller homey town.

Hercules.png With so much construction occurring since 2000, there might be risks to pedestrians along the road or the sidewalk. Depending on the circumstances in each case, people injured in city construction zones may be able to obtain compensation from the city for not keeping the area safe, or being negligent in their duties. Have you or a loved one been injured in a construction area, or in the city of Hercules? It is located at the southern part of the San Francisco Peninsula and is within driving distance to Mountain View, Sunnyvale, Menlo Park, and Cupertino. These residential communities might be attractive to those who are looking for a larger lot, or who desire a more rural atmosphere. However, these homes have also ranked in Forbes’ “Most Expensive Zip Codes in America” list.

Los%20Altos2.jpg The semi-rural atmosphere in Los Altos means that there is few sidewalks in the city and the roads have broad dirt shoulders, and limited street lighting. PROPERTY OWNERS MAY BE LIABLE FOR INJURIES THAT OCCUR ON THEIR LAND—HAVE YOU BEEN INJURED? CALL OAKLAND PERSONAL INJURY LAW FIRM

Part of owning a property or business is the liability of injury, whether it’s with employees, deliverymen or the general public. Depending on the circumstances of how a person gets injured, the property owner may be held accountable for their injuries. For example, if a customer is shopping in a grocery store and slips and falls on a patch of juice that an employee spilled, and the store failed to clean it up or put a caution marker near it, then the grocery store may be liable for the person’s injuries. However, if the customer is acting reckless himself, such as riding on a shopping cart through the store, and injures himself in that way, then the grocery store may not be liable for his injuries. Since each case is dependent on their circumstances whether they will be successful in court, you should call Greenberg & Rudman LLP for a free and confidential consultation as soon as possible. We can be reached at 1-800-252-9776 (1-800-ALAWPRO)—call us now!

The man, James Johnson, was 61 years old when he was found unconscious in the sauna and died in the hospital two days later. The YMCA and Johnson’s wife, Berma Johnson, settled the lawsuit out of court, so the amount agreed to was not disclosed, but both parties are happy that the lawsuit was resolved. During the lawsuit, the YMCA conducted its own safety evaluation of the facility. Although there were no changes recommended and no critical findings made, the facility will continue to monitor the sauna several times a day.

ACCIDENTAL DROWNING ACCIDENT DEATH? CALL SAN JOSE PERSONAL INJURY ATTORNEYS NOW

Drowning is a very common occurrence in the United States and in the San Francisco Bay Area, especially with children. It is common for adults and children to drown in swimming pools or local lakes and oceans, but it is also common for children to drown in very obscure areas. For example, children can drown in toilets, buckets or anything else with water that may cause the child to fall in and that would be difficult for the child to get out on his own. Children may see toys or certain objects that attract them in a sedentary pool of water and the incident may occur in the blink of an eye. Teenagers and adults may be more prone to drowning when they are intoxicated, or under medication, or because of a medical condition.

Drowning occurs when there is liquid in the lungs, which prevents oxygen from being absorbed into the blood and results in death. Near drowning occurs when a person survives the drowning, but inhales water or becomes unconscious as a result of the accident. Consequences of near drowning include anxiety, drowsiness and even coma. The victim’s skin may turn blue as a result of lack of oxygen in the blood stream, and some respiratory problems may not surface until hours after the incident. The damage to the victim is dependent on how long he was submerged in the water, how cold the water was and if there was attempted resuscitation after he was rescued. Victims may be able to walk out of the hospital the same day, or may suffer brain damage.

Swimming%20Pool3.jpg Do you believe that your child suffered a near drowning or a drowning as a result of someone else’s negligence? For example, was your child at a child care provider’s house and the swimming pool was inadequately fenced in and your child was inadequately supervised, resulting in a drowning? BOY HIT AND KILLED BY WORK TRUCK IN BERKELEY, CALIFORNIA

Depending on the nature of the employment, a person may be injured on the job site or by equipment used in the course of employment. In these cases, the employee would likely be able to seek out compensation through worker’s compensation benefits, or a lawsuit against their employer for negligence. However, those injured by the employee during the course of employment or by the employer’s property may also obtain damages from the employer.

On January 27, 2009, a five year old boy was hit and killed by a work truck at the intersection of Derby and Waring in Berkeley, California. The boy was walking or riding his bike with his classmates from a nearby school when he was struck. A bystander tried to perform CPR but was unsuccessful. The driver of the work truck stopped the truck immediately following the accident and police determined that there were no indications that drugs or alcohol were involved in the accident.

Depending on exactly where the incident occurred, the boy’s family may be able to sue the owner of the work truck for damages in a wrongful death lawsuit. For example, if the work truck was in the area because the employee was doing work in the usual course of employment (i.e. delivering goods, or working on a construction project), then the family may be able to hold the employers liable. However, if the work truck was on private property and the boy trespassed, then there is a different standard that would be applied in a negligence lawsuit against the employer. The success of the lawsuit would depend on the circumstances in each case, and would be up to the judge or jury in each matter.

Berkeley.jpg Times like these are incredibly trying and difficult, but having a knowledgeable attorney by your side may make the ordeal more bearable. The attorneys at Greenberg & Rudman LLP have had years of experience in wrongful death, and premises liability lawsuits, among others. DROWNING DEATHS MAY BE PREVENTED—CALL SAN FRANCISCO WRONGFUL DEATH ATTORNEY NOW (Part 2 of 2)

The Centers for Disease Control and Prevention have noted that the major risk factors of death by drowning include: lack of barriers and supervision, age and recreation in natural settings, alcohol use and seizure disorders. Although many children drown in swimming pools or lakes and rivers, a significant amount of children also drown in buckets, toilets and bathtubs. There may be a lack of awareness that children are able to drown in such areas, but a simple child lock on toilet seats can be an effective preventative measure.

In December 2007, there was a federal law called the Virginia Graeme Baker Pool and Spa Safety Act which requires that public swimming pools update the drains in their pools to prevent swimmers from being trapped, injured or disemboweled in the drains. The new law requires these drains to be dome shaped, rather than flat, to decrease the amount of surface area that a swimmer can get sucked into. Although the law was put into effect in 2007, the government allowed a grace period of one year for public pools to comply. The deadline is approaching for these new drains to be installed. Approximately eighty percent of the public pools in the country still have not complied with the regulation.

Have you or a member of your family been injured by a public pool drain? Greenberg & Rudman LLP has had years of experience in lawsuits against major insurance companies. We have won millions in verdicts and settlements and can help you in your lawsuit. Call us now at 1-800-252-9776 (1-800-ALAWPRO) to get a free consultation and to find out more about your rights. FAMILY SETTLES CASE OVER DEATH OF TEEN AT AMUSEMENT PARK—CALL BAY AREA WRONGFUL DEATH ATTORNEY NOW

Owners and operators of amusement parks owe a special duty, or responsibility, to those people who buy tickets to visit the park. The owners/operators are responsible to maintain the park to a certain standard, such as general repair on the rides, or testing for safety. The owners/operators may not be responsible for unforeseeable things such as a spontaneous break in one of the cables that passed inspection the previous day. However, the circumstances vary from case to case and from court to court. One court may decide that an incident was foreseeable and thus the owner was responsible while another court may look at a very similar situation and rule that the owner was not responsible in that case.

On January 23, 2009, the family of Elizabeth Mohl, who died on July 14, 2007, settled their lawsuit with Life Promotions and Air Glory Inc. in their wrongful death lawsuit. Life Promotions and Air Glory, Inc. were the operators of the rides at the Sunnyview Expo Center in Oshkosh, Wisconsin. Elizabeth’s family settled the suit for $1 million. After an investigation of the incident, officials found that the fastener attaching to Elizabeth’s harness was not properly locked and that a safety rope was not properly attached to the harness. Air Glory has been suspended from operating any rides in Wisconsin for one year.

CHILD REVIVED AFTER NEAR DROWNING IN FREMONT, CA

Backyard swimming pools are extremely dangerous, especially for young children. Drowning is one of the leading accidental death causes in the United States and may occur in the blink of an eye. Even if there is adult supervision, or proper protection around the swimming pool, it can still pose as a danger to children who live at the property, but also to those who accidentally wander into the yard. Depending on the circumstances, the owners of the swimming pool in which the child drowned may be responsible to the child’s family.

In Fremont on Monday, January 12, 2009, firefighters received a call about a possible drowning of a child at about 1:00 p.m. Family members found the child in the pool of a single family home. Police officers on the scene gave the child CPR and administered life support. The child regained a pulse and was rushed to the hospital. It is reported that the child is stabilized and is expected to survive.

HOMEOWNERS MAY BE LIABLE FOR ACCIDENTS ON PROPERTY—CALL OAKLAND PERSONAL INJURY ATTORNEYS NOW

Homeowners and their insurance companies may be responsible for injuries or deaths of certain visitors to their property. There is different liability for homeowners when the visitor is a trespasser, or is on the property to provide service (such as a salesman, or gardener) or if the visitor is an invited guest. Depending on the circumstances of the injury, and the status of the visitor, it poses a different responsibility to the owner.

For example, if Terry the trespasser comes onto Harry the homeowner’s property, and Terry trips over a hole that is marked with a caution sign, then Harry owes no responsibility to Terry. But if Terry is an invited guest, and if the hole was not marked with a caution sign, then Harry would probably be responsible for his injuries. On January 10, 2009, a balcony collapsed in Oakland, which sent three people to the hospital. According to official reports, the cause of the collapse is not yet known, and up to five people were injured in the incident.

CONSTRUCTION WORK PLACE INJURIES AMONG THE HIGHEST IN US AND CALIFORNIA JOBS

Each job has its own risks and dangers, ranging from psychological to physical. However, there are a few jobs at the top of the list that are much more dangerous than others. According to the United States Department of Labor, there were 5,488 fatal work injuries in 2007. Although injuries in construction jobs showed a decrease in 2007, it still remains the industry in the private sector to have the most fatalities.

According to the Department’s reports, the number of fatalities in construction totaled 1,178. The highest number of deaths occurred in the contractor group, with 680 deaths, followed by construction of buildings at 244, and 216 deaths in heavy and civil engineering construction. Many of these fatalities occurred on the highway or in falls. Although at a lower percentage, there were also deaths which occurred as a result of being struck by an object, or homicide. In California, there were 407 fatalities in 2007, with the majority of them occurring in transportation related incidents.

WHAT IF I HAVE BEEN INJURED AT SOMEONE ELSE’S HOUSE?

Property owners may be liable to those people on their premises if they are killed or injured. There are different categories of people who may be on the property, and the landowner may be responsible for them in different ways. The three categories are: invited guests and visitors, licensed individuals (repairmen or gardeners), and trespassers. Some injuries may include falling or slipping, construction accidents, and exposure to hazardous materials. If the landowner is found responsible for the victim’s injuries, then they may be able to compensate them through their Homeowners or Property Insurance.

An example of this was a gas explosion that occurred in a home located in Rancho Cordova, a Sacramento suburb, on Thursday, December 25, 2008. The explosion injured five people and killed one. The fatality was 70 year old Wilbert Paana, who suffered severe abdominal injury and died at the hospital. Two of the victims remain in critical condition. Officials have reported that the explosion likely occurred because of a natural gas leak.

Experienced personal injury attorneys can help you determine what your rights are, or to seek compensation from an insurance company for your injuries. FAMILY OF TIGER ATTACK VICTIM FILE WRONGFUL DEATH SUIT AGAINST SAN FRANCISCO CITY AND SF ZOO

Wrongful death lawsuits are claims by the families of the victim against someone (the defendant) which allege that the defendant’s actions or conduct caused the victim’s death in whole or in part. The damages that families are able to seek through wrongful death lawsuits may be wages that the victim had the potential of earning in his lifetime, or any property that was damaged at the time of the death. One example is a an accident that recently occurred in San Francisco, CA. Marilza and Carlos Sousa filed the lawsuit against San Francisco and the San Francisco Zoo for the death of their son after a Siberian tiger escaped from its enclosure and attacked him.

Mr. and Mrs. Sousa claim that the enclosure walls were lower than the recommended national standard and that the officials did not heed warnings that the walls were not high enough. There were two others boys involved in the incident, which occurred about a year ago. There was much controversy involved in the incident as it was unclear what role the boys had in the tiger’s escape. The other two victims were injured, but recovered quickly. The mother of the other two victims filed a federal lawsuit against the police department, and the zoo claiming that the zoo planned a smear campaign against them.

VALLEJO, CA ACCIDENT INJURY ATTORNEYS

Vallejo, California, is the largest city in Solano County, with a population of 116,898 people. Located across the bay from San Francisco, and north of San Jose, California, Vallejo was twice the site of the California state capitol. Vallejo was also the home to Mare Island Shipyard, which was the West Coast’s first shipyard. It has become a commuter hub for the North Bay with its Ferry Terminal and ferry service to San Francisco. The city also attracts adults and children alike with the Six Flags Discovery Kingdom (formerly Marine World).

Its prime location across the San Francisco Bay and many restaurants, colleges and theme park attracts tourists and commuters. Since it is such a high traffic area, there may be an increased chance of accidents on the road, on the ferry, or at the theme park. On December 25, 2008, 48 year old Vallejo resident Dana Burket was struck and killed by a car on the corner of Springs Road and Oakwood Avenue. Officials report that the driver of the car, Scott Abeyta, was turning onto Springs Road and failed to see the woman. TOXIC EXPOSURE MAY LEAD TO LIABILITY IN LIVERMORE, CALIFORNIA: CHRONIC BERYLLIUM DISEASE A RISK

Even though Livermore Labs knew that its building contained beryllium, and that many of their projects involved the metal dust, its workers did not originally wear the correct protective material. However, those workers are required to wear the correct protective material now. Direct contact with the metal dust can result in immediate injury to the injured areas, such as the eyes and the skin. It can cause itching of the skin, rashes, and blisters. If the workers are desensitized to the metal dust, they could potentially develop Chronic Beryllium Disease.

Chronic Beryllium Disease develops after a long exposure to beryllium and may not surface for decades. It primarily affects the lungs, but may also have an impact on other organs as the metal travels through the blood. Granulomas, a formation of tissues, are a key sign to Chronic Beryllium Disease and can be found in the lungs, skin, liver, spleen, and kidney, among other organs. This disease varies among different people and manifests in different ways.

If you believe that you have been injured at Livermore Labs as a result of your employment, please contact us now at 1-800-252-9776 (1-800-ALAWPRO) to speak to one of our experienced attorneys. Greenberg & Rudman LLP cares about your case, and will help you obtain justice. Our attorneys are experienced trial attorneys who have gone against major insurance companies and corporations. LIVERMORE LABS WORKERS POSSIBLY EXPOSED TO TOXIC METAL DUST: CALL AN ATTORNEY

For those people who have been injured on the job, they are eligible to receive workers’ compensation benefits, or possibly damages in a negligence case (although in many cases in order to file a worker’s compensation claim, you are signing away your rights to file a separate suit). However, if an employee has been injured on the job because of exposure to a toxic substance, then he/she may have a worker’s compensation claim as well as a third party negligence case. In this specific case, filing a worker’s compensation claim does not stop you from filing a negligence case against your employer.

Livermore Labs, located in Livermore, California, has been investigating whether hundreds of its workers has been exposed to a toxic metal dust, metal beryllium. There have been approximately five different incidents involving the metal dust since 2000. The most significant of which occurred in a four year period between 2002 and 2006 when 178 construction workers were exposed to beryllium as they were retrofitting one of the buildings. These construction workers were not notified of the exposure to the metal dust for more than a year after the building was completed, and many have yet to see the official lab report on the incident.

Our attorneys at Greenberg & Rudman LLP can help you obtain workers’ compensation benefits, and help you determine if you are entitled to damages in a civil lawsuit. We only represent clients and the families of wrongful death victims whose injury or loss occurred in the state of California. Please call us now at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation. Visit our website www.alawpro.com to read more on workers’ compensation.
