MAN WINS LAWSUIT WORTH MILLIONS AGAINST COUNTY AND STATE GOVERNMENTS FOR INJURIES CAUSED BY TREE LIMB FALLING—ANTIOCH LAWYERS CAN HELP YOU NOW

Federal, state and local governments have responsibility in maintaining parts of the United States, so if something happens on federal or state land, the proper authorities are responsible for it. This not only applies to where lawsuits are held, but also to who may be responsible for the injury. State and local governments are responsible for most of the roads and pathways, and if accidents occur as a result of that maintenance, then they would likely have responsibility. For example, if the signs on a certain road are inaccurate and cause an accident, the city or state may be responsible for a part of the accident, and maybe even the entire thing.

In Delaware on October 30, 2009, Kenneth Matlock won $6 million for the injuries that he sustained when a tree limb fell on his car and broke his neck. The incident happened in 2006 when he was driving in the car with his wife and three children. The tree limb fell on top of their SUV, and the car continued until it hit a guardrail on the opposite side of the road. Matlock’s wife’s neck was broken as well, and he lost use of his right hand. It was determined that the tree was the responsibility of the Department of Transportation of Delaware, and because of the flooding that had happened there, the tree was rotted out.

Antioch.png A tree expert and registered arborist testified for Matlock and stated that the state should have known about the condition of the tree and should have corrected it before the accident occurred. The jury unanimously awarded the damages to the Matlocks. Have you or a family member been injured in a car accident or any other incident that involved the negligence of the state government? If so, you should contact the attorneys of Greenberg & Rudman LLP right away for a free consultation of your case. Pick up the phone and call us now at 1-800-252-9776 (1-800-ALAWPRO). It is located near San Francisco and Oakland, which allows its residents to commute to the cities during the day, but reside in Hercules. The city is also surrounded by Pinole, Rodeo and Martinez. In 2000, Hercules made a big push to become a transit-oriented, pedestrian-friendly and mixed-use town. PROPERTY OWNERS MAY BE LIABLE FOR INJURIES THAT OCCUR ON THEIR LAND—HAVE YOU BEEN INJURED? CALL OAKLAND PERSONAL INJURY LAW FIRM

Part of owning a property or business is the liability of injury, whether it’s with employees, deliverymen or the general public. Depending on the circumstances of how a person gets injured, the property owner may be held accountable for their injuries. For example, if a customer is shopping in a grocery store and slips and falls on a patch of juice that an employee spilled, and the store failed to clean it up or put a caution marker near it, then the grocery store may be liable for the person’s injuries. However, if the customer is acting reckless himself, such as riding on a shopping cart through the store, and injures himself in that way, then the grocery store may not be liable for his injuries. Since each case is dependent on their circumstances whether they will be successful in court, you should call Greenberg & Rudman LLP for a free and confidential consultation as soon as possible. We can be reached at 1-800-252-9776 (1-800-ALAWPRO)—call us now!

On April 8, 2009 in Lafayette, Indiana, a woman won a lawsuit against the Lafayette Family YMCA for improperly supervising the sauna in which her husband was found unconscious in. The man, James Johnson, was 61 years old when he was found unconscious in the sauna and died in the hospital two days later. The YMCA and Johnson’s wife, Berma Johnson, settled the lawsuit out of court, so the amount agreed to was not disclosed, but both parties are happy that the lawsuit was resolved. During the lawsuit, the YMCA conducted its own safety evaluation of the facility. Although there were no changes recommended and no critical findings made, the facility will continue to monitor the sauna several times a day.

HOMEOWNERS MAY BE LIABLE FOR ACCIDENTS ON PROPERTY—CALL OAKLAND PERSONAL INJURY ATTORNEYS NOW

Homeowners and their insurance companies may be responsible for injuries or deaths of certain visitors to their property. There is different liability for homeowners when the visitor is a trespasser, or is on the property to provide service (such as a salesman, or gardener) or if the visitor is an invited guest. Depending on the circumstances of the injury, and the status of the visitor, it poses a different responsibility to the owner.

For example, if Terry the trespasser comes onto Harry the homeowner’s property, and Terry trips over a hole that is marked with a caution sign, then Harry owes no responsibility to Terry. But if Terry is an invited guest, and if the hole was not marked with a caution sign, then Harry would probably be responsible for his injuries. On January 10, 2009, a balcony collapsed in Oakland, which sent three people to the hospital. INJURED ON SOMEONE ELSE’S PROPERTY? CALL A BAY AREA ATTORNEY TO FIND OUT ABOUT YOUR RIGHTS

In the case where someone gets injured on someone else’s property, victims may sue the individuals who own the property which they were injured upon. However, there are several restrictions on who may sue, and on what basis. There are three different categories to determine if the victim has any right to sue the landowner: trespassers, licensees and invitees. A trespasser is someone who enters the land without the express or implied permission of the owner. In many cases, the owner does not owe a duty to the trespasser, and may not need to warn him about different dangers, or to maintain the property in a special way.

Licensees are those people who may be expressly or impliedly invited by the landowner. Contrary to what the name may imply, this category includes friends who are visiting as well as salesmen who are going door-to-door. The landowner in this case is not required to make efforts to make the property safe for the licensees, but must warn the licensee of any dangers on the land that is known to the landowner. For example, Paul the paintbrush salesman would not succeed in a lawsuit against Debbie the houseowner if he tripped and fell in a hole that Debbie did not know about. However, he may be able to recover damages if he fell into a trench that Debbie was digging for a new water pipe, and did not rope the area off, or put a sign to warn him about the trench.

SLIP, FALL, TRIP HAZARD ON SAN FRANCISCO SIDEWALK

A local newspaper reports that a large crater-like hole exists on a 19th Avenue sidewalk in San Francisco. Per complaints from residents, the paper investigated and found the treacherous opening on a busy stretch of road. Such public side walk hazards can result in broken legs, broken ankles, lacerations or worse, should a passerby trip or fall into the hole. If you have been injured by slipping, tripping or falling on a Bay Area sidewalk, you may be entitled to financial compensation for your injuries. To learn more please visit www.alawpro.com. To speak with a lawyer for free, please call 1-800-ALAWPRO now.

The dangerous road hole is located on a busy area of 19th Ave between Mercy High and Winston Drive. The paper reports that in addition to uneven sidewalks, pedestrians must also deal with a gaping hole in the walkway. Apparently, a slab of concrete was once used to cover the crater, but it has since “broken and collapsed inward.” Overgrown bushes in the area have been recently cut back to eliminate that additional danger. While it's not immediately apparent whose responsibility the pothole is, clearly there is a danger to children and adults who use the side walk. Should some one trip or fall over the hole, injuries such as broken arms, legs or ankles could result. Injuries incurred from poor maintenance of roads and sidewalks could mean that the victim is entitled to monetary compensation.

ARE YOU ENTITLED TO MONEY AS A RESULT OF AN INJURY OR ACCIDENT? CONTACT A BAY AREA LAWYER NOW

If you have been involved in a car accident, or have a personal injury claim such as a slip and fall, then you may be entitled to monetary compensation, or according to the legal term “damages”. The purpose of awarding damages to the injured party is to make him/her whole again, by compensating him/her for his/her injuries caused by the action of the defendant. There are two main categories of damages: compensatory and punitive. Under compensatory damages, there are both pecuniary and non-pecuniary damages. Pecuniary damages may include the cost of repair or replacement of property, medical treatment, or lost wages. Non-pecuniary damages include non-economic harm, such as pain and suffering. Punitive damages are used by the courts to award damages to the plaintiff if the defendant committed the injury maliciously.

For example, if Daniel the Defendant crashed his car into Patty the Plaintiff and broke her leg as a result of the accident, she may be able to sue him for both compensatory and punitive damages. Patty’s compensatory damages might include any damage to her car, any costs for medical treatment that she paid out of pocket, and the wages that she was unable to earn because she was recovering from the broken leg. She may also be able to recover punitive damages if Daniel crashed into her car on purpose, or maliciously wanted to cause her harm.
