MAN KILLED BY CALTRAIN ON TRACKS IN MOUNTAIN VIEW

Trains can be particularly dangerous to pedestrians and vehicles stopped on the tracks. These large vehicles usually have several railway cars attached, which makes it incredibly hard for the train to stop in a short amount of time. There is also additional danger to the passengers riding on the train. In 2009, there were 17 fatalities on the Caltrain railroad tracks, which service a large portion of the San Francisco Bay Area.

There were two separate accidents on Caltrains this December. The first incident occurred on December 21, 2009 when Caltrain hit an unoccupied vehicle. The driver of the vehicle was able to escape right before the crash; the incident resulted in no injuries, but there was damage to the railroad tracks. The second incident occurred on December 23 when a man stepped onto the tracks in Mountain View. The man was killed at the San Antonio Station around 5:10 p.m. but there were no injuries to the passengers on the train. Since the accident happened during peak commuting hours, the passengers were boarded onto another train.

Mountain%20View2.png Unfortunately, many of these Caltrain accidents occur as a result of intentional suicides. However, there may be accidents in which the deaths were unintentional and may be attributed to the negligence of the train conductor or because of the poor maintenance of Caltrain or its railroad tracks. Have you or a loved one been injured by Caltrain and want to obtain compensation for your injuries? If so, then call the attorneys of Greenberg & Rudman LLP now for your free consultation. CALTRAIN FATALITY IS TWELFTH ACCIDENT THIS YEAR IN BAY AREA

Caltrain provides service to commuters and residents from San Francisco to Gilroy and stops in major cities like San Jose, Millbrae and Burlingame. Between May and September 2009, there have been twelve fatalities involving Caltrain all across the Bay Area. Many of the fatalities were apparent suicides by high school students who attended the same school. Other reasons for the fatalities might be the high speed of trains as it passes residential areas, or the train’s inability to stop on short notice. Have you been involved in a train accident? Then call Greenberg & Rudman LLP at 1-800-252-9776 (1-800-ALAWPRO), or visit our website www.alawpro.com for more information.

On September 21, 2009, the twelfth fatal accident involving Caltrain occurred in San Mateo. The commuter train had just left the San Mateo station around 4:45 p.m. and had not gained full speed when it hit the man. Witnesses have reported that the man, later identified as Peter Manion, was holding two parrots when he was struck by the train. It appeared that Manion froze on the train tracks as Caltrain approached. The trains traveling through the area after the incident were single-tracked and service was delayed for hours after. The cause of the incident is still under investigation.

Some of the major train accidents that have made the news have been a result of the conductor’s negligence. For example, the Metrolink crash in Los Angeles last year was caused because the conductor was texting on his cell phone. This kind of action can be considered to be negligence in a court of law, and may be attributable to the government entity responsible for the train and the conductor. The attorneys of Greenberg & Rudman LLP have represented people injured by train accidents, so call us now at 1-800-252-9776 (1-800-ALAWPRO) to find out your rights in your case. You can also find us at www.alawpro.com to read more about train accidents and the injuries that may occur.

CALTRAIN STRIKES CAR AND KILLS DRIVER IN REDWOOD CITY

Caltrain, Amtrak and Bay Area Rapid Transit (BART) all provide Bay Area residents with efficient public transportation. However, as many people know, just getting into a motor vehicle means that you are exposing yourself to a certain level of danger. Although the number of people who are injured or killed by the trains is still relatively low compared to the number of people who take the trains, it is still heartbreaking to hear reports of fatalities on the train tracks. Have you or a loved one been injured by a train in the Bay Area? Then you should call Greenberg & Rudman LLP now at 1-800-252-9776 (1-800-ALAWPRO) for your free consultation, or visit our website www.alawpro.com for more information.

In Redwood City on September 15, 2009, a man in his Honda was pronounced dead at the scene after he was struck by Caltrain. The incident happened around 5 p.m. when a San Carlos fire truck was traveling on El Camino Real to a structure fire. The traffic on the road had stopped to make way for the fire truck. Unfortunately, the driver of the Honda pulled onto the railroad tracks and was trapped by other cars when the guard rails lowered. The Caltrain was traveling at 75 miles an hour when it struck the car; the vehicle was destroyed and the victim was pronounced dead at the scene.

Redwood%20City2.jpg Caltrain officials have warned drivers to use extreme caution when stopping for emergency vehicles and to make sure that drivers never stop on railroad tracks. Personal injury lawsuits focus on the wrongdoing of a certain party. Each case depends on its special set of circumstances, so call the attorneys of Greenberg & Rudman LLP now for a free consultation of your case. You can reach us at 1-800-252-9776 (1-800-ALAWPRO). We work on a contingency fee basis, which means that you will not pay any costs or fees unless we win the case for you. SIX PASSENGERS HURT IN SECOND SAN FRANCISCO MUNI ACCIDENT IN THREE WEEKS

In yet another San Francisco Municipal Railway accident, two MUNI trains crushed a sport utility vehicle between them on Market Street in San Francisco on August 4, 2009. This accident followed another MUNI accident that occurred on July 18, 2009, and which injured 47 people. The August 4 accident occurred on Market and Noe Streets around 5:45 p.m., and appears to be caused by the second train hitting the SUV, and causing it to hit the train in front of it. Although there were only six people injured and there were no serious injuries, there is still increasing concern about the cause of the incident and the future of MUNI.

Officials are still investigating the cause of the accident, but according to the passengers on the train, it appears as though the driver was distracted by another passenger right before the accident occurred. The director of the San Francisco Municipal Transportation Agency expressed his frustration and concern at this recent MUNI accident. There have been accusations that MUNI has concentrated on timely service more so than the safety of the trains. However, statistics show that MUNI has actually had a double digit decline in traffic incidents. There are new safety measures to be carried out, such as a new camera monitoring system on all trains.

MUNI%20Accident2.jpg If you have suffered injuries in a train accident because of someone else’s negligence, you may be able to recover for your injuries. For example, the driver of the MUNI train may be held by a judge or a jury to be negligent in his job because he was not performing his duties properly, which ultimately resulted in the accident. To find out your rights in this kind of situation, call Greenberg & Rudman LLP now at 1-800-252-9776 (1-800-ALAWPRO) for your free consultation. Or, you can go to www.alawpro.com to read more about train accidents and the injuries that may occur.

ALTAMONT COMMUTER EXPRESS AND AMTRAK TRAIN ACCIDENTS KILL VICTIMS IN BAY AREA

Last week in San Francisco, there was a multiple injury train accident involving the MUNI light-rail system. Luckily in that accident, there were only injuries and no fatalities. In several places along railroad tracks in the Bay Area, there is inadequate protection from trains, or a lack of signs warning pedestrians from the danger. Conductors operating the trains may not be able to stop the train in time, or may not even realize that there is danger on the tracks. Another danger that may occur on railroads is when drivers in other vehicles break the law by stopping on the tracks when the train is coming, or by leaving their vehicle too close to the tracks.

A crash in Lathrop on July 27, 2009 between an Altamont Commuter Express train and a pickup truck resulted in one fatality. The train left from the Stockton station and was headed to San Jose. The pickup truck was parked on the railroad tracks when the train struck it, killing the driver. In another train accident on July 28, 2009, a pedestrian was killed by an Amtrak train in Fairfield. The victim was struck around 4:45 p.m. near East Tabor Avenue. Officials are still investigating the circumstances of the crash, but there were no passengers or crew members injured in the crash. Amtrak service was also delayed two and a half hours as a result of the incident.

VICTIM STRUCK AND KILLED BY SAN JOSE LIGHT RAIL TRAIN

Light rails and trains have become our answer to a faster commute. The Santa Clara Valley Transportation Authority has a light rail that passes through downtown San Jose and other parts of Santa Clara County. The train is fast and efficient, but also carries with it the dangers of a large vehicle. Many pedestrians or drivers may underestimate the speed of these light rails, or may overestimate the amount of time that they have to cross the tracks. Like larger trains, these light rails are hard to stop because of their size.

On June 18, 2009, at the intersection of Leigh Avenue and Southwest Expressway, a victim was struck and killed by the VTA light rail train. Investigators have stated that the victim was riding a razor-scooter and had gone under the crossing arm right before he was struck by the train. There were no injuries to any of the passengers on the train. The police are still investigating the cause of the accident.

Depending on who was negligent in the case, the boy’s family may be able to file a wrongful death lawsuit against Santa Clara County. For example, if the family can prove negligence on the part of the driver, if he was going too fast in the area, or wasn’t paying attention, then the court may award them a certain compensatory judgment. However, if the case did make it to court, there may be a chance that the jury or the judge finds that the boy and the train were both negligent and award damages based on that; or the court may find that the county is not negligent at all and dismiss the case. Although we cannot tell you or promise you the result of a lawsuit, we can help you file it successfully. There are many deadlines and details that normal people may not know about, but an experienced attorney has practice in. The attorneys at Greenberg & Rudman LLP can help you—call us now at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation. FOUR FATAL TRAIN ACCIDENTS OCCUR IN BAY AREA OVER THREE DAYS—HAVE YOU BEEN INJURED BY A TRAIN? CALL OAKLAND PERSONAL INJURY FIRM NOW (PART 2 OF 2)

Train accidents can be deadly, and sometimes cannot be prevented. Often times, the conductor may fail to see the vehicle or person on the tracks, or sees them too late to hit the brakes. Other times, trespassers or pedestrians may cross the tracks in an attempt to get to the other side before the train reaches them, but are unsuccessful. There were five fatal accidents occurring in the Bay Area between Wednesday, June 3, 2009 and Saturday, June 6, 2009 involving Caltrain and Amtrack trains. If you have been injured by a train, you need to contact Greenberg & Rudman LLP immediately for a free consultation at 1-800-252-9776 (1-800-ALAWPRO).

On Wednesday, a seventeen year old girl, Sonya Raymakers from Gunn High School in Palo Alto was fatally struck at the East Meadow Drive crossing. Then, on Thursday morning, a man was killed by an Amtrak train in Berkeley. Investigators are reporting that it was an apparent suicide. Later on Thursday, Vida Silver was killed when her 100 pound pit bull pulled her by his leash across the tracks in Hayward. She and the dog were hit and killed by the Amtrak Capitol Corridor train. On Friday afternoon near San Jose’s Diridon station, a bicyclist was fatally struck on the tracks. The unidentified bicyclist went under the lowered crossing gates after the northbound Caltrain had passed, but was struck by the southbound train. Then on Saturday, Richard Steven Collins of Richmond was hit and killed by the Capital Corridor Caltrain at 10:45 a.m. Investigators have reported that he likely thought the train was a slow moving freight train and failed to move out of the way even though the conductor blew the horn. The accident happened at the Gilman Street crossing in Berkeley.

Although many of these accidents may have been preventable, if there is negligence or recklessness found on the part of the parties, the victims’ families may be able to sue for wrongful death. The details of each case are very important to the success of the case. The attorneys at Greenberg & Rudman LLP handle cases on a contingency fee basis, which means that you will pay no costs unless we win the case for you. CALTRAIN AND OTHER TRAIN ACCIDENTS MAY RESULT IN DEATH, OR SERIOUS INJURY—CALL SAN FRANCISCO PERSONAL INJURY LAWYERS NOW (Part 1 of 2)

As evidenced by the traumatic injuries and deaths which occurred in the LA Metrolink train accident, which occurred last year, train accidents can be deadly, and are becoming increasingly common. Train accidents may result in a greater number of deaths or injuries because of the number of passengers present on the train, as well as the power and size of the train. It may be much easier to stop a passenger car than it is to stop a train. Additionally, in order to operate a train, the conductor must have had sufficient training and must pay attention to what is going on at all times.

In 2009, there have already been 2,485 incidents/accidents in the federal railroad system, according to the Federal Railroad Administration Office of Safety Analysis. This is compared to 3,184 accidents/incidents that occurred in 2008. There have been 150 fatalities in 2009, 318 derailments, 94 trespasser fatalities and 7 employee fatalities. There were 49 highway-rail incident deaths. It is reported that 137 accidents/incidents were caused by the tracks, whether it was a malfunction or problem. There were 95 accidents/incidents that occurred in 2009 in which there was reportable damage of above $200,000.

Train%20Crash2.jpg There may be many people or companies who may be liable for deaths or serious injuries in train accidents. For example, in a lawsuit, the court or a jury might find that the conductor was liable because he was negligent, but may also find his employer, the owner of the train and the owner of the cargo responsible for the lawsuit as well. In order to find out what you may be compensated for in a train accident, you should contact Greenberg & Rudman LLP now at 1-800-252-9776 (1-800-ALAWPRO) to obtain a free and confidential consultation. TRAIN HITS CAR IN NORTH RICHMOND—CALL SF TRAIN INJURY ACCIDENT LAWYERS NOW

Over recent months, there have been several train accidents involving Caltrain, and Amtrak. One of the main reasons that train accidents may occur is because of conductor error, as well as excessive speed, or because of objects blocking the tracks. It is incredibly difficult for a train to come to a stop quickly because of its size and weight of its load. Some of these accidents may occur because of carelessness on the part of drivers in cars, buses or trucks. These drivers may think that they have more time to cross the tracks before the train arrives, but underestimate the speed of the train. Other times, vehicles may get stuck on the tracks and the train fails to stop in time.

On May 18, 2009, an Amtrak train collided with a vehicle in North Richmond around 5 p.m. The crash occurred near Market Avenue and Sixth Street. The driver of the vehicle was taken to the hospital with injuries, but no one on the train was injured. California Highway Patrol is still investigating the cause of the accident. The train was delayed for approximately an hour and a half, and caused delays to other trains as well.

Injuries from train accidents can be horrific, but you don’t have to go through it alone. FREIGHT TRAIN CRASHES INTO MOTOR HOME IN BURLINGAME, CA.—? CALL TRAIN ACCIDENT INJURY LAWYERS IF YOU’VE BEEN INJURED.

Many may remember the deadly train accident in Southern California a couple of years ago in which dozens of people were killed when the train engineer failed to stop in time. Train accidents may occur more frequently than many people think. The size and weight of its cargo makes the train incredibly difficult to stop in a short period of time. Often, trains will travel at a reduced speed through towns or cities, but accidents still may happen as a result of negligence, or some other event. If you have been injured in a train accident, you need to call an experienced attorney now for a free and confidential consultation. Call Greenberg & Rudman LLP now at 1-800-252-9776 (1-800-ALAWPRO).

On April 25, 2009 in Burlingame, a city south of San Francisco, a freight train struck a motor home that was stalled on the tracks. The motor home belonged to a couple from Oregon, and was stuck on the tracks near Broadway Avenue. The RV’s driver and other good Samaritans were attempting to push the RV over the tracks when they saw the train approaching quickly. The train was unable to stop and slammed into the RV just seconds after the people ran to safety. No one was injured by buildings and vehicles in the area reported minor to moderate damage from the flying debris. There is no report whether the engine of the train suffered any damage. Caltrain, which shares the same railroad tracks, was delayed for hours after the accident.

MANY INJURED IN SAN FRANCISCO MUNI AND BIG RIG TRUCK ACCIDENT (Part 1 of 2)

Truck and train accidents may be more likely to occur because of the size of the vehicles. In truck accidents, the owner of the truck, the owner of the cargo, the driver, and his employer could all potentially be liable for the accident. In train accidents, the time that it takes to stop a train could be very limited and be a significant cause in accidents. In both of these types of accidents, the number of victims involved may be greater than those involved in car or pedestrian accidents.

A collision between an 18-wheel truck and a San Francisco Municipal Railway train occurred on Monday, March 16, 2009 in San Francisco’s Dogpatch neighborhood. The accident occurred at the intersection of 22nd and 3rd Streets; the truck and the train were running parallel to each other when the truck made a left turn in front of the train. There is a sign indicating that there are no left turns at the intersection where the accident occurred. Fortunately, the train was only traveling at about three miles an hour. Approximately a dozen people were evaluated by the paramedics and eight were transported to hospitals. Police report that the accident did not cause significant damage to the train, but the cause is still under investigation. The 18-wheel truck is owned by John Christner Trucking. The accident disrupted Muni service until approximately 6 p.m. Monday night and required shuttle buses to run in place of the train. As part of standard procedure, the Muni train driver was tested for drugs and alcohol and placed on non-driving status.

MUNI.jpg Those injured in the accident could potentially have claims against the San Francisco Municipal Railway, the owner of the 18-wheeler truck, the driver, employer of the driver, or the owner of the cargo. If you have been injured in an accident involving a train or big rig truck, you need to speak to an attorney at Greenberg & Rudman LLP immediately. We can help you every step of the way and make sure that all of the paperwork is filed correctly and on time. We advance all costs and expenses related to your case and we do not recoup these costs unless we collect money for you. FATAL TRAIN ACCIDENT OCCURS NEAR SACRAMENTO—CALL ACCIDENT INJURY LAW FIRM NOW

Train accidents may happen in a split second and could potentially injure hundreds of people at one time. Train accidents may happen because the conductor does not react quickly enough to a foreign object on the tracks, or potentially because there is a defect in the train itself. The injury would not just be to the victim hit by the train, but the passengers on the train could also suffer injuries. The accident may also happen as a result of the conductor’s negligence, much like the major train accident which happened in Southern California last year in which the conductor was text messaging on his cell phone when the accident happened.

On March 10, 2009, an Amtrak train hit a vehicle with two passengers in it in Davis near the intersection of L and 2nd Streets. The driver of the vehicle, Aaron Singerenglar, took the turn onto the railroad tracks too sharply and ended up flipping the BMW. He and a passenger were able to escape the BMW before the Amtrak train completely destroyed it. The two men suffered minor injuries from the crash. Police are still investigating the accident.

Being involved in a train accident can be incredibly traumatic to the victim and to his family. The attorneys at Greenberg & Rudman LLP have had a lot of experience making sure that families of the victim and the victim are well taken care of. We are committed to obtaining compensation for victims injured by the negligence of others. We do not have the power to undo an injury or bring back a loved one, but we can help you seek compensation. Give us a call at 1-800-252-9776 (1-800-ALAWPRO) to get a free consultation. TWO BAY AREA RESIDENTS KILLED IN AMTRAK TRAIN CRASHES

Train accidents have become increasingly more common in the United States. Last year, there was a tragic accident in Chatsworth, California in which a Metrolink train crashed and killed more than 25 people, and left hundreds injured. Train accidents may occur because of the sheer size of the trains, its heavy cargo or lack of conductor control. All over the United States, and in the Bay Area, there are train tracks that run through residential areas, which may pose an even greater danger to pedestrians and others.

On Wednesday, February 18, 2009, two separate accidents involving Amtrak trains occurred in the Bay Area. The first accident occurred at 6:10 a.m. in Richmond near Chelsey Avenue. The Amtrak train hit a car parked on the tracks in what is reported to be an apparent suicide. The second accident occurred near the Hayward station at Paseo Grande and St. John Avenue at 3:30 p.m. It is reported that there was a pedestrian walking along the tracks, with his back to the train. The conductor sounded the horn on the train but the pedestrian failed to move and the train failed to stop in time. Both accidents caused delays of up to two hours. No one on the trains was hurt in the accidents.

OAKLAND MAN HIT AND INJURED BY SAN FRANCISCO MUNI TRAIN

As efficient as public transportation can be in San Francisco, it also poses several dangers to passengers and pedestrians. As evidenced by the BART and MUNI train accidents last week, these accidents are unpredictable and could occur at any time. The sheer size of BART and MUNI trains may contribute to the accidents, as well as conductor error and excessive speed. Passengers in the trains at the time of the accident may be better off than pedestrians who are struck by the trains.

On Sunday, February 8, 2009, Bill Brand, an Oakland resident, was hit by the MUNI N-Judah train. The accident occurred at 9:10 p.m. near Second and King Streets, by AT&T Park. The train was headed towards the Caltrain station. Service on MUNI was disrupted for about two hours after the accident. Officials are still investigating the accident and are unsure what caused the accident. Mr. Brand, who used to be a reporter for the Oakland Tribune, is listed in critical condition.

MUNI%20Accident2.jpg Accidents such as these can be devastating to families. BART CARS COLLIDE IN OAKLAND, INJURES PASSENGERS. IF YOU ARE INJURED, CALL A SAN FRANCISCO ACCIDENT ATTORNEY.

Bay Area Rapid Transit (BART) is an efficient way to get around the Bay Area and is an important part of many East Bay residents’ commute. However, as efficient and environmentally savvy as BART may be, there are sometimes incidents which result in injury. Train accidents have been a frequent occurrence in the United States and are a result of conductor error, excess speed or foreign material on the tracks.

On Tuesday, February 3, 2009, two BART cars derailed and collided with each other in Oakland at the 12th Street station. Both cars were the lead cars in two trains that were traveling in the same direction. One of the trains was on automatic and the other was being driven manually. There were thirteen people injured in the collision and all of the passengers made it out of the cars through a catwalk. By 7 p.m. that night, there were no significant delays on BART and crews worked all night to clear the trains from the tracks. The cause of the incident is still under investigation.

BART3.jpg If you were a passenger injured in this incident, or any other train collision, you should call Greenberg & Rudman LLP for a free consultation at 1-800-252-9776 (1-800-ALAWPRO). CAR CRASHES INTO MUNI TRAINS IN SAN FRANCISCO

Accidents involving trains may be especially hard to prevent because of the sheer size of trains and the split second timing in which these accidents occur. The trains may also carry large amounts of cargo that are not completely secure and may make the accident worse in the long run. The San Francisco Muni, short for the Municipal Railway, consists of bus lines, trolley lines light rail lines, cable car lines and a heritage street car. All of their routes operate year round and many operate 24 hours a day.

On Wednesday, January 28, 2009, the Muni’s N-Judah trains traveling in opposite directions collided with a vehicle in the Inner Sunset neighborhood. The accident occurred near the 10th Avenue and Judah Street intersection around 4:10 p.m. No serious injuries were reported, but the trains were still delayed at 5 p.m. on that day.

BART SHOOTING LEAVES HAYWARD MAN DEAD (Part 2 of 2)

Although trains themselves may be deadly and play a role in fatalities, there may be other incidents that occur near a train or station that may result in injury or death. The Bay Area Rapid Transit system (BART) faced two different incidents in the past week at the Oakland station and between the Walnut Creek and Lafayette stations.

On Monday, December 29, 2008, a fire broke out on the tracks between the Walnut Creek and Lafayette BART stations. The fire disrupted and slowed the service for the rest of the night. No one was reported to be injured in the incident. A 22 year old victim, Oscar Grant, was shot and killed by a BART officer on Thursday, January 1, 2009. According to official reports, there were two groups of people fighting on the train, and the BART officers were called to break up the fight. There were no weapons recovered at the scene and Mr. Grant was not armed.

CALTRAIN ACCIDENT RESULTS IN ANOTHER DEATH IN MOUNTAIN VIEW (Part 1 of 2)

Train crashes are a common occurrence in the United States, and other incidents involving the train system may also be increasing. Northern California has seen several different incidents resulting in fatalities involving Caltrain in the last few months. Caltrain has reported that there have been sixteen fatalities on their train tracks in 2008 and eight of those fatalities have been ruled suicides. Two of these deaths were unintentional and the rest have not been determined. The number of Caltrain deaths in 2008 doubled from those reported in 2007.

On Wednesday, December 31, 2008, there was another fatal injury in Mountain View that involved Caltrain and a pedestrian. A Caltrain, traveling southbound at around 6:15 p.m. on Wednesday night struck a pedestrian just north of Castro Street. Officials have reported that the pedestrian was standing on the tracks and even though the train engineer activated the emergency brakes, he was still unable to stop the train.
