LARGE VEHICLES CAUSE DAMAGE ON ROADWAYS IN SACRAMENTO AND LIVERMORE

Large vehicles like big rigs and trucks are ever present on our roadways, and even though the drivers are specially trained, there are still accidents that can cause a lot of damage. These large trucks and vans may be harder to control in bad weather, and may not be susceptible to a quick change of course in case of an emergency. These vehicles may also hold dangerous cargo, like gasoline or toxic materials that can be extremely dangerous if involved in a crash. Have you or a loved one been injured by a truck or a bus, and want to obtain compensation for your injuries? Then you should contact the lawyers of Greenberg & Rudman LLP for a free consultation of your case at 1-800-252-9776 (1-800-ALAWPRO).

On February 4, 2010, a garbage truck and van were involved in an accident in Sacramento. The collision caused the truck to crash into a child day care center. Both drivers had to be extricated from the vehicles, and the driver of the van died, but no children were harmed. In another unrelated accident on the same day, a driver of a BMW, Beiru Chen, was driving the wrong way on Highway 580 and caused a major collision. Chen was driving the wrong way in the left lane, and lost control of her car. The car crashed into two big rigs, one carrying contaminated soil, and the other diesel fuel. Chen was injured and airlifted to a hospital, but the drivers of the big rigs were not injured.

Livermore.jpg Investigators have indicated that alcohol does not seem to be a factor in the second accident, and are still investigating why Chen was driving the wrong way on the freeway. The highway was blocked for several hours while crews cleaned up the scene. Being involved in a car accident can have detrimental effects on your health, career and family, but you’re not alone in this ordeal. The lawyers of Greenberg & Rudman LLP may be able to help you. We may not be able to undo your injury or bring back a loved one, but we can help you file your lawsuit and possibly obtain compensation for your injuries. LARGE VEHICLES AND HEAVY EQUIPMENT KILL TWO MEN IN SEPARATE ACCIDENTS IN COTATI AND REDWOOD CITY

There are many hazardous and dangerous professions, including construction and other jobs involving large vehicles and equipment. Although there might be safety precautions put in place, accidents still may occur because of equipment malfunction or human error. Employees who are injured during work may be entitled to worker’s compensation for their injuries, but if they file for worker’s compensation, they may not be able to file third party personal injury lawsuits against their employers. If you are unsure about whether you have a legal cause of action, then you should contact the lawyers of Greenberg & Rudman LLP for a free consultation of your case at 1-800-252-9776 (1-800-ALAWPRO).

In Cotati on December 21, 2009, Vicente Zaragoza was killed by a front loaded at the Sonoma County dump. He was employed by Sonoma Compost and had worked there 10 years this month. Zaragoza was wearing a safety vest and hat and was sorting through plastics and metal from a pile when he was run over by a front loader while it was backing up. The front loader generally emits a beeping sound when it backs up—Cal/OSHA will be investigating the incident and the equipment for the next couple of months. The driver stated that he simply did not see Zaragoza because he was in a blind spot. In an unrelated accident on December 22, Jose Villaneuva was struck and killed by a dump truck in Redwood City. The accident happened around Marine Parkway and Twin Dolphin Drive when Villaneuva was helping the truck driver back up.

Cotati.jpg The incident is still under investigation and the cause of the accident is still unknown. Villaneuva was taken to a local hospital and pronounced dead. These accidents are very unfortunate and not only affect the victims’ families but also the other employees. If the investigations show that there was equipment malfunction or if there was negligence, then the victims’ families may be able to pursue a lawsuit to be compensated for their injuries. Greenberg & Rudman LLP represents people who have been seriously injured as well as the families of those who have been killed under wrongful death circumstances. We have won over $150 million for our clients in verdicts and settlements. Call us now at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation. TRUCKING ACCIDENTS ACCOUNTED FOR SEVERAL DEATHS IN ALAMEDA COUNTY—FIND OUT YOUR RIGHTS FROM AN EXPERIENCED LAWYER (Part 2 of 2)

Big rig trucks can be very dangerous on the road, particularly if the driver is inexperienced or if the load is improperly distributed or carried. There may also be problems with the road that can cause trucking accidents, such as pot holes or uneven pavement. The California Highway Patrol compiled statistical information on accidents involving trucks in their SWITRS system.

  • In 2007, there were 365 people killed in truck collisions and 10,024 people injured by trucking accidents;
  • The highest number of injuries in 2007 occurred in August, while the highest number of fatalities occurred in October;
  • In four fatal collisions in 2007, the primary collision factor was that the truck driver was intoxicated at the time of the accident;
  • The majority of cases in 2007 where the truck driver was at fault occurred when the driver was driving at an unsafe speed;
  • Out of 3,557 fatal vehicle collisions in 2007, 320 of those were truck collisions;
  • Out of 184,994 injury collisions in 2007, there were 6,942 truck collisions.

Driving a big rig truck can be dangerous, particularly on narrow roads or high speed areas. The cargo on the trucks may also contribute to their dangerousness, as it may alter the operation of the vehicle. Smaller cars and bicycle riders must also be cautious around big rigs because they fit perfectly into the truck’s blind spot and may get stuck under the vehicle. The lawyers of Greenberg & Rudman LLP have over 50 years of combined experience and may be able to help you in your case. Pick up the phone and call us now at 1-800-252-9776 (1-800-ALAWPRO) for your free and confidential consultation with one of our knowledgeable attorneys. Check out our website at www.alawpro.com to find out more about trucking accidents and what rights you may have in your accident.

FAMILY OF GIRL KILLED IN CAR ACCIDENT AWARDED $5.25 MILLION AGAINST BIG RIG TRUCK DRIVER AND COMPANY—CONTACT WALNUT CREEK ATTORNEYS NOW (Part 1 of 2)

Are you aware that if you get into an accident with a big rig truck, you may be able to obtain compensation for your injuries from the owner of the truck, the driver’s employer and the owner of the cargo that the truck is carrying? Of course, there are certain limitations in these types of cases and the outcome depends on the different circumstances in each case. In these types of cases, the owner of the truck is likely responsible for the condition of the truck. For example, the company would have to perform inspections on the vehicle to make sure that it was safe on the road. The driver’s employer is also responsible for the driver, whether it’s properly training him/her or making sure that their licenses are up to date.

A Albemarle County, Virginia jury awarded the Aichs family $5.25 million for the death of their 16 year old daughter in 2008. The accident happened with a big rig truck, driven by Kenneth Barbour and owned by the Don B. Swisher Trucking Corp. It was alleged in the lawsuit that Barbour was not properly trained and supervised and that the company allowed him to drive the big rig truck with defective parts. The accident occurred when Barbour ran a red light at the intersection of U.S. 29 and Ashwood Boulevard. The jury awarded $1.75 million to each of the three family members but did not award any punitive damages because Barbour’s actions did not meet all the required thresholds of negligence.

Barbour also pleaded guilty to involuntary manslaughter and reckless driving earlier this year. He was sentenced to two years in prison. If you have had a family member who was killed or injured in a big rig truck accident, or any other car accident, then you need to call an experienced attorney for a free consultation of your case. TRUCK HITS AND KILLS BICYCLIST IN REDWOOD CITY; SCHOOL BUS HITS CHILD ON BIKE IN OAKLAND

Driving large vehicles takes special skill and practice because of the dangers that accompany the task. Vehicles like big rig trucks and buses have large blind spots where the driver cannot see other vehicles or people in certain areas. Additionally, these vehicles may turn differently than smaller vehicles and may not be able to stop very quickly or avoid hitting another vehicle. If trucks and buses are involved in personal injury lawsuits because of the negligence of the driver, then the owner of the truck and bus may be liable for the accident, as well as the driver.

In an incident on October 12, 2009, a bicyclist was hit and killed by a dump truck in Redwood City. The incident occurred at 7:51 a.m. in the intersection of Shoreway Road and Holly Street. The woman on the bike tried to pass the dump truck as it turned onto Holly Street but was hit instead. A part of the dump truck rolled over her and killed her. The driver of the truck left the scene of the accident, and when authorities found him, he stated that he did not know that he had hit a person. On October 16, a boy was hit in Oakland by a school bus as he rode his bike to school. The boy suffered injuries to his leg.

Trucks and buses can do incredible damage to the passengers onboard as well as the vehicles or people that they hit. These injuries may range from cuts and scrapes to brain injuries to deaths. Have you or a family member been involved in a car accident with a bus or truck? Then you need to pick up the phone and call the law firm of Greenberg & Rudman LLP at 1-800-252-9776 (1-800-ALAWPRO) for your free and confidential consultation. SANTA CLARA JURY AWARDS MAN $49 MILLION IN PERSONAL INJURY DAMAGES FOR ACCIDENT ON PACHECO PASS WITH TWO TRUCKS

It takes an experienced individual to drive a big rig truck because of the large size of the vehicle, the length of time that the drivers are required to drive, and the lack of maneuverability of the vehicle. Drivers go through training and testing in order to drive these vehicles, but may be on the road for upwards of 12 hours a day. Although there are regulations on the number of hours drivers may spend on the road at each time, there is still considerable pressure on the drivers to arrive at their destination on time. Sometimes these types of pressures and restraints cause the drivers to act negligently and may result in injury to someone else.

A Santa Clara County jury awarded Drew Bianchi $49 million in damages after an accident in 2007 on Pacheco Pass. The stretch of the road on which the accident occurred is known as “blood alley” because of the conditions of the road and the number of accidents that occur there. Bianchi was in a car with three other people when two trucks collided into each other in the center lane of the highway. One of the trucks struck the back of Bianchi’s vehicle; the accident left him permanently brain damaged. The lawsuit was against the two truck drivers and their employers. One of the employers settled with Bianchi for $2 million, which left its driver alone at trial.

Santa%20Clara.png The jury also found Caltrans (the state transportation agency) 5% responsible for the accident because of its failure to improve conditions on the road. One of the drivers also acted negligently in part because he was talking on a cell phone at the time of the accident. Although Bianchi’s future health care will be taken care of by the damages awarded to him in this lawsuit, he will never be able to accomplish his dream of becoming a doctor. We may not be able to reverse your injury, but the attorneys of Greenberg & Rudman LLP may be able to represent you and help protect your rights. FAMILY OF VICTIM WINS $16 MILLION IN TRACTOR-TRAILER TRUCKING ACCIDENT—CALL SAN LEANDRO TRUCK ACCIDENT LAWYERS

Drivers of tractor-trailer trucks are required to get a special license and extensive training on the operation of the vehicle. A truck of that size may be particularly dangerous on the road because of its weight, inability to stop quickly, inability to see other vehicles in certain spots and the possibility of an “underride.” Since a big rig truck is higher off the ground than an average sedan, an “underride” occurs when part of the smaller vehicle is crushed under the truck, which may cause more damage to the passengers inside. Accidents may also occur if the cargo on the truck is not properly secured, which may hurt passengers in other vehicles.

On July 16, 2009, a settlement was reached between the family of Rhonda Henson and the Pioneer Drilling Company for $16 million in Texas. The lawsuit was filed as a result of a truck accident on September 11, 2008, when a spreader bar flew off of the Pioneer truck and crushed Henson’s vehicle, killing her. The family sued the company, and the driver of the truck, Daniel Armstrong. During the trial, it was discovered that Armstrong was not legally qualified to operate the truck and that he and his employer had falsified his papers. It was also discovered that he had several driving violations, license suspensions and an incident of driving under the influence. The Federal Motor Carrier Safety Regulations state that any person with a recover of driving under the influence cannot qualify for a commercial driver’s license.

The attorneys at Greenberg & Rudman LLP have a significant record of $150 million obtained in settlements and verdicts, including $6.1 million settlement for an improperly loaded pallet on the back of a big rig. MOTORCYCLE AND BIG RIG TRUCK CRASH RESULTS IN DEATH IN SF EAST BAY, CA

Motorcycles may be more dangerous on the road because they are smaller in size, are not as stable because of their two wheels and may be harder for other motorists to see. On the other hand, although big rig trucks might be more stable driving on the road, they have dangerous blind spots in which they cannot see if a vehicle is in a certain area. Big rig trucks might also be dangerous when they are making turns at a high speed, or trying to maneuver the large truck in a busy area. Motorcyclists may protect themselves by wearing leather shields along their body, and making sure that they are always wearing a helmet. However, there are times when a motorcycle may face a larger vehicle and result in a deadly crash.

On April 20, 2009, a motorcyclist was killed on Highway 580 on the border of Alameda and San Joaquin counties. The motorcycle collided with a big rig truck, and the rider was pronounced dead at the scene. The police are still investigating the cause of the accident, and had to close down one lane of the road in order for emergency crews to respond. In another accident on April 22, 2009, Lajuane Singleton, the driver of a disabled car, was killed when a tow truck rear ended his car. Singleton’s vehicle was stalled out on the shoulder of the road when the tow truck struck it from behind. Police have reported that the tow truck was driving through the area, and was not on its way to help Singleton.

Motorcycle2.jpg Being in such a deadly accident would be a tremendous blow to the victim and his family and loved ones. We may not be able to bring the victim back, but the attorneys at Greenberg & Rudman LLP are committed to obtaining compensation for victims injured by the negligence of others. CAR AND BIG RIG TRUCK ACCIDENTS RESULT IN DEATH IN SF BAY AREA AND CENTRAL VALLEY

Hundreds of car accidents occur around the Bay Area on each given day. Unfortunately, many of these accidents result in death, and likely could have been prevented. Many drivers may underestimate the importance of following certain laws, such as using the turn blinker to change lanes, or just following common sense principles, like not driving when you’re tired. There were several vehicle accidents around the Bay Area this week, one of which included a big rig truck and a pedestrian on the side of the road. If you have been injured in a car, or truck accident, you should contact the attorneys at Greenberg & Rudman LLP immediately for a free consultation. We can be reached at 1-800-252-9776 (1-800-ALAWPRO).

In the early hours of Friday, April 17, 2009, three men in a BMW were killed in St. Helena on Pratt Avenue. The police are still investigating the accident and have not indicated the cause of the deaths. On April 18, 2009 on Highway 99 near Merced in the Central Valley, a bus driver was killed by a big rig. The bus driver was driving a bus containing forty one people when the bus ran out of fuel. The driver, John Haen, had walked to Merced for fuel, and then was escorted back to the bus by a CHP officer. Haen was struck as he was filling the empty gas tank, and was thrown 70 feet. The big rig truck also hit the bus, and the CHP officer’s vehicle, which was parked in front of the bus. In another unrelated accident on Saturday, the driver of a car involved in a single vehicle crash was killed on Highway 280 in Los Altos Hills. There was no report of injury to the passenger in the car, and the cause of the crash is still under investigation.

ACCIDENTS IN BAY AREA LEAD TO SERIOUS INJURY, DEATH—INJURED IN A CAR OR TRUCK ACCIDENT? CALL NOW

There may be an increased number of drivers on the road for a big holiday weekend, such as Easter, especially when kids are off from school for several days. In the Bay Area this week, there have been several accidents resulting in serious injury or death. If you or a family member has been seriously injured or killed in a car accident in the San Francisco Bay Area, then you should call an experienced attorney as soon as possible. There were four teenagers in one of the cars, and an adult in the other car. All five people were transported to local hospitals because of their injuries. The cause of the accident is still under investigation. In an unrelated accident on the same day, a California Highway Patrol officer located a van in a ditch near Locke Road and McEathron Lane in Solano County. Officers have reported that they believe that high speed was the reason that the driver of the van ran off of the road and ultimately died.

Truck%20Accident3.jpg In a third unrelated crash on April 11, a pedestrian was killed on a San Francisco highway. The accident occurred at the connector ramp between northbound Interstate Highway 280 and southbound state Highway 1. The cause of the accident has not yet been determined. CARGO TRUCK CRASHES ON I-880 OFFRAMP IN OAKLAND—CALL TRUCK ACCIDENT INJURY LAWYERS NOW (Part 2 of 2)

According to California Highway Patrol’s System Wide Integrated Traffic Reports, in 2007 there were 365 people killed in big rig accidents, and 10,024 injured in truck crashes. The highest number of deaths occurred in October, and the highest number of injuries was in August. A high percentage of accidents, in which the truck driver was at fault, occurred when the driver was going at an unsafe speed. Fatal truck accidents account for approximately 9% of all fatal collisions and 3.8% of all injury collisions. For the majority of fatality and injury cases, the truck was proceeding straight immediately before the collision occurred.

A big-rig driver was injured on Tuesday, March 17, 2009 when he crashed the big-rig on an off-ramp on Highway 880. The accident occurred at 7:47 a.m.; the end of the truck was straddling the barrier on the side of the off-ramp, but was not in danger of falling over the side. The truck was carrying rice, which also had to be cleaned up. The CHP has reported that the driver was injured and was transported to a hospital, but the cause of the accident was unknown. The accident delayed traffic for about five hours after the accident occurred.

Lawsuits against big rig trucks might be difficult to deal with because the truck, cargo and the employer of the driver may all be large corporations or be insured by large insurance companies that might give you the run around. MANY INJURED IN SAN FRANCISCO MUNI AND BIG RIG TRUCK ACCIDENT (Part 1 of 2)

Truck and train accidents may be more likely to occur because of the size of the vehicles. In truck accidents, the owner of the truck, the owner of the cargo, the driver, and his employer could all potentially be liable for the accident. In train accidents, the time that it takes to stop a train could be very limited and be a significant cause in accidents. In both of these types of accidents, the number of victims involved may be greater than those involved in car or pedestrian accidents.

A collision between an 18-wheel truck and a San Francisco Municipal Railway train occurred on Monday, March 16, 2009 in San Francisco’s Dogpatch neighborhood. The accident occurred at the intersection of 22nd and 3rd Streets; the truck and the train were running parallel to each other when the truck made a left turn in front of the train. There is a sign indicating that there are no left turns at the intersection where the accident occurred. Fortunately, the train was only traveling at about three miles an hour. Approximately a dozen people were evaluated by the paramedics and eight were transported to hospitals. Police report that the accident did not cause significant damage to the train, but the cause is still under investigation. The 18-wheel truck is owned by John Christner Trucking. The accident disrupted Muni service until approximately 6 p.m. Monday night and required shuttle buses to run in place of the train. As part of standard procedure, the Muni train driver was tested for drugs and alcohol and placed on non-driving status.

MUNI.jpg Those injured in the accident could potentially have claims against the San Francisco Municipal Railway, the owner of the 18-wheeler truck, the driver, employer of the driver, or the owner of the cargo. If you have been injured in an accident involving a train or big rig truck, you need to speak to an attorney at Greenberg & Rudman LLP immediately. TRUCK ACCIDENTS MAY RESULT IN SERIOUS INJURY CALL A SAN JOSE PERSONAL INJURY ATTORNEY NOW

Truck accidents occur frequently in the United States, whether because of the size of the roads in rural areas, or the lack of training for the drivers. When trucks are involved in accidents, victims may be able to sue a variety of people for his injuries. Those liable may include the truck driver, the driver’s employer, the owner of the truck, and the owner of the cargo on the truck. Many accidents involving trucks and smaller vehicles usually results in more damages to the person in the smaller car. According to the California Highway Patrol, in 2006:

  • There were only four people killed in truck collisions in San Francisco County and 78 injured.
  • The highest number of fatal collisions (31) occurred in accidents in which the truck driver was going at an unsafe speed. Truck%20Accident4.jpg Trucks are normally covered by large insurance companies, which means that if there is a lawsuit, the insurance company likely hires attorneys to represent the driver, or the owner of the truck. This may make it difficult for the victim to recover damages for his injuries because the large insurance companies may just run you in circles. To make sure that you recover damages for your injuries and to have someone fighting for you, call Greenberg & Rudman LLP now at 1-800-252-9776 (1-800-ALAWPRO) for a free consultation. TRUCK STRIKES SCHOOL BUS IN SONOMA- BAY AREA ACCIDENT ATTORNEY CAN HELP

Subprime road conditions are often made even worse by winter weather, such as fog, rain and ice. Accidents may occur because of weather, pavement conditions or driver negligence. Based on a memorandum provided by the California Highway Patrol, 106 people in California last year were killed in collisions that occurred in rainy, snowy or foggy weather. The CHP has recommended some of the following tips for safe driving in such weather: reduce your speed, and slow down significantly when you encounter fog; make sure that your windshield wipers are in good condition; make sure that your headlights are on when your windshield wipers are on; be sure that you have emergency supplies in your car at all times.

In Sonoma County on Thursday, January 15, 2009, a Toyota Tundra struck a school bus at the intersection of Llano Road and Highway 116. Fortunately, there were no students aboard the school bus at the time of the collision. The bus driver, Rian Studebaker, failed to stop at a stop sign and overturned when it was struck by the Tundra. In another crash on the same day, Nicole Gibbs crashed her car into a tree near Bohemian Highway near Tyrone Road. She was taken to the hospital and is in stable condition.

MOVING TRUCK ACCIDENTS INJURE PASSENGERS IN OAKLAND, CA

Large truck accidents may occur because of the load in the truck, an unbalanced center of gravity, or may be caused by an inexperienced driver. There are different types of trucks, ranging from eighteen wheel big rigs to personally rented and driven moving trucks. In these accidents, there may be more liability than just the driver. The liability could extend to the owner of the truck, the owner of the load in the truck and the driver’s employer.

There was an accident on Highway 24 in Oakland on Wednesday, January 7, 2009 at approximately 1 a.m. A driver and his passenger were in a rented Penske moving truck when it overturned on the right hand shoulder. The passenger was thrown from the truck, and landed in the BART parking lot below the overpass where the accident occurred. Both victims are expected to recover. Two lands of the highway were closed in order to clean up the accident and Highway 24 reopened approximately two hours after the accident.

LOS ALTOS, SANTA CLARA AND DUBLIN AMONG CITIES WITH BEST ROAD CONDITIONS IN NORTHERN CALIFORNIA

There are several different factors that contribute to car, bus and big rig truck accidents. One of these factors is the condition of the road on which the accident occurred. Road design and maintenance is an important part of driver safety, and the government conducts reports from time to time in order to monitor road safety. On Monday, January 5, 2009, the Metropolitan Transportation Commission released a report which stated that Bay Area roads remained in fair condition, similar to their report in 2006. It also reported that the worst pavement conditions were in Sonoma and Marin counties, Suisun City and Rio Vista in Solano County, Orinda, Richmond and El Cerrito.

The best pavement conditions were in Los Altos, Brentwood, Foster City, Santa Clara, Contra Costa County, Gilroy, Dublin, Oakley and the city of Sonoma. San Mateo has increased its PCI average of six percent, which is the most improved among the different Bay Area cities. Foster City’s PCI are consistently in the 80 or higher range. Road conditions play a variety of roles in car accidents, ranging from being the cause of an accident to preventing an accident from getting any worse.

Los%20Altos.jpg Greenberg & Rudman LLP is an experienced law firm and has won over $150 million in personal injury verdicts and settlements. BIG RIG TRUCK CRASH ON NAPA HIGHWAY CAUSES MULTIPLE INJURIES

A Peterbilt big rig carrying a load of rocks and boulders overturned while taking a turn on Highway 121 in Napa County. As the boulders spilled out of the truck, three cars attempted to avoid the oncoming rubble and crashed. The accident resulted in major and minor injuries to the car drivers. One of the cars caught fire after hitting a guardrail. Crashes involving big rig trucks, also known as tractor-trailers, can be severe and sometimes fatal. Big rig-related accidents can be the responsibility of truck drivers, trucking companies or cargo owners. To learn more about tractor trailer accidents, visit our website at www.alawpro.com. FATAL BIG RIG CRASH IN VACAVILLE, CALIFORNIA

A deadly accident involved 5 vehicles including a big rig truck in Vacaville on Saturday, November 1. The crash happened on Interstate Highway 505 near the Allendale Road exit, an unincorporated part of Solano County. The number of deaths and cause of the crash was not reported. Have you or a loved one been involved in a truck-related accident near Vacaville? Then please call 1-800-ALAWPRO now for your free interview with a lawyer.

Trucking related accidents can be especially dangerous, especially when they occur on one of California's hazardous freeways. Most cars and SUV's are no match for a tractor trailer or big rig, and truck accidents increase the likelihood of “underride.” An “under ride” crash occurs when the smaller vehicle travels under the body of the big rig, resulting in potential disaster for the passengers in the trapped or impaled vehicle. To learn more about “underrides” and trucking-related accidents and claims, please visit our website.

I-880 makes Alameda quite accessible as well with an exit a few short minutes from town. With a speed limit of 25 mph, Alameda would seem like an idyllic spot for those on foot; however, non-locals exiting the 880 into Alameda don't always obey or know about the decreased speed. If cars, buses and trucks don't slow down, the results can be dangerous and deadly for Alameda pedestrians. Have you or a loved one been injured in an Alameda accident? Then please call 1-800-ALAWPRO to speak with an attorney at no cost.

Alameda can be accessed by the U.S.’s only pedestrian and bicyclist drawbridge, as well as motor vehicle bridges at Park, High and Fruitvale Ave., tunnels at Harrison (the Posey Tube) and Webster. Public transit for Alameda residents includes two ferry services, Harbor Bay and Alameda-Oakland, as well as bus service provided by AC (Alameda County) Transit. But walkers and bikers beware! Advocate groups have had to take on the cause of protecting non-vehicular road users. Drivers exiting into Alameda from 880 can injure pedestrians. Accidents involving pedestrians are often fatal and injuries can include broken limbs, head and neck injuries, as well as severe lacerations.

SAN FRANCISCO PEDESTRIAN, BICYCLE & CAR CRASH DEATHS & INJURIES INCREASE DRAMATICALLY

The most recent SF Collision report, compiled by the San Francisco Municipal Transportation Agency from CHP statistics, shows a disturbingly high rise in traffic-related injuries and deaths. In 2007 pedestrian accidents were up more than 50%, composing more than half of all traffic deaths. Bicycle-related crashes rose over 30%. Vehicle-related deaths are also up over 50%, while injuries from accidents involving motor vehicles are also on the rise. Injuries incurred in road accidents can include brain and spinal injuries, broken limbs, burn injuries, paralysis and laceration. The report also showed that certain SF intersections are particularly dangerous for walkers. Additionally, as previously blogged, Muni buses are posing a growing threat to SF residents with two deaths already this year. To learn more about car, motorcycle, bus, bike and pedestrian accidents, please visit our website www.alawpro.com. If you or a loved one has been hurt in a SF road accident, please call 1-800-ALAWPRO to speak with a lawyer for free.

With the spike in road injuries and deaths, some city officials point to the increasing number of people choosing alternatives to car travel. Nevertheless the high number of injuries and deaths is alarming for anyone using San Francisco streets. Here are some more 2007 statistics from the report:

# of Non-fatal Pedestrian injuries: 800
# of Non-fatal Bicycling injuries: 450
# of Pedestrian deaths: 32
# of Pedestrian deaths involving Muni buses or streetcars: 8

What else may be to blame for the grim stats? Poor road design and maintenance including a lack of bike lanes, hidden traffic signs, or poorly visible crosswalks may be a factor. Drivers may also be responsible, especially those who disobey the law by speeding, running red lights and stop signs; or those drivers who are not paying enough attention on the road, distracted by cell phones or other things. There is no doubt that both SF pedestrians and drivers need to be cautious and take care on the road. Following are some of the San Francisco intersections cited as being repeatedly dangerous for walkers, bikers and drivers:

Gough & Market
Market & 6th
Oak St. & Octavia Blvd.
Bayshore Blvd. & Silver Ave.
Mission St. & Silver Ave.
19th Ave. & Junipero Serra Blvd.
19th Ave. & Sloat Blvd.
13th St. & South Van Ness

SF MUNI BUS CRASHES & CABLE CAR ACCIDENTS RISE SHARPLY IN 2008.

In startling new information released by the San Francisco Municipal Transportation Agency, pedestrian and other accidents involving Muni streetcars, cable cars, and buses are increasing dramatically. As a result, Muni is searching for safety consultants, which may be too little too late for those already devastated by loss from Muni accidents. With over 300 claims just this year, Muni has paid out millions this year to crash victims, passengers and employees. . Have you or a loved one been involved in an SF Muni bus or street car accident? Then you may be entitled to compensation for your injuries. Please call a San Francisco attorney for help at 1-800-ALAWPRO now. To learn more about public transportation and motor vehicle accidents as well as workplace injuries, go to www.alawpro.com.

The new information from SF’s Transit agency is shocking. Pedestrian accidents have nearly doubled in the past year, while bike, car, bus, and passenger crashes are also on the rise. In addition, Muni employees are also being hurt on the job at a higher rate. In the past 3 years, 18 deaths have resulted from Muni crashes, including two deaths this year, by cable car (see our blog about a fatal cable car accident this past month) and street car. Also, bicycle and passenger accidents have seen a sharp increase. Municipal authorities concede that a culture of Muni driver aggressiveness and carelessness may be a contributing factor to the high number of accidents.

Other than needless injuries and fatalities, an additional outcome from the Muni incidents has been the large number of claims and settlements to victims of Muni-related accidents. Over $4.8 million was paid out to Muni crash and passenger victims last year alone. There were more than 300 accident-related and work compensation claims filed in 2007. Worker injury has also led to large payments, more than $17 million. This is all the more reason to get legal help immediately if you have been involved in an SF bus or streetcar accident on the street or on the job.

The new statistics from the SFMTA cite injuries and deaths resulting from (1) crashes involving pedestrians, bicycles, other vehicles (cars, vans, trucks, other Muni buses) and animals; and (2) passenger boarding and on board Muni vehicles). Here is the list of the number of Muni incidents since 2005 from the San Francisco Examiner:

INJURED IN DRUNK DRIVING ACCIDENT IN DANVILLE, CA?

Drunk driving is suspected in a multi-vehicle accident that occurred mid-day on Interstate 680 in Danville leaving three people injured. The crash included two cars, a flat bed truck and a tow truck. A Subaru Forester and the tow truck were pulled over to the side of the highway when they were struck by a two-axel flatbed truck. The tow truck driver was critically injured during the crash, as he was pulled under his truck by the force of the collision. The flatbed driver, who was arrested for drunk driving, also received serious injuries. Have you or a loved one been involved in a California freeway accident? Then call 1-800-ALAWPRO for your free interview with a lawyer now.

The accident occurred on southbound Highway 680 and resulted in the brief closing of the entire freeway. In addition to the two truck drivers who were hurt, a third victim, driving an Acura was also hospitalized with minor injuries. Luckily, the Subaru driver was not in his car and was able to avoid injury. When the flatbed hit the vehicles on the roadside, he “peeled away” the side of the car before smashing into the truck. Trucking accidents on California highways are dangerous and common. Severe injuries and death can often be the result. If you have been involved in a truck-related crash in CA, please get help from a lawyer.

ACCIDENTS DUE TO FOG: FOG WARNING SYSTEMS INSTALLED NEAR FRESNO

A year ago an infamous multi-car crash happened on Highway 99 outside Fresno. Approximately 90 vehicles, cars and trucks, collided due to dense fog. Northern Californians are no strangers to foggy streets and freeways, and seasonal fog can be the catalyst for crashes on many local roads. Now CHP and the California Dept. of Transportation are installing a new fog warning system to inform drivers of fog in the area of the gargantuan pile-up. Previously roads known to be fog-prone lacked such safety measures. Have you or a loved on been involved in a Fresno car or truck accident? Then please call us at 1-800-ALAWPRO now for a free consultation with a lawyer.

The new alert system includes signs and sensors. Freeway message signs will reflect fog updates according to information received from fog sensors. Low visibility and poor driving conditions due to fog can create dangerous road scenarios. Additionally roads with high speeds, heavy traffic and no warning system for weather can lead to deadly crashes. Cars, buses and trucks are a risk on these roads. If you have been in a freeway accident, it's not always clear who is to blame, and that is why you need the help of an experienced Law Team.

SAN JOSE ACCIDENTS: MERGING ONTO A HIGHWAY

While connecting to Highway 87 from I-280, a man in a Chevy pick-up truck crashed into another car. The collision threw the 27-year-old victim from his car, and he died at the scene. Merging onto a highway from a connector or onramp is one of the most dangerous and frightening parts of Northern California driving. While Bay Area freeways are nearly a must for getting around, they can be extremely hazardous for a variety of reasons. If you have been injured in a freeway-related accident, please visit our website at www.alawpro.com or call us at 1-800-ALAWPRO to receive a free consultation with an attorney.

The victim, a San Jose man, was driving southbound on 280 attempting to merge onto southbound 87. He was headed for the left lane on the connector ramp when the accident occurred, ejecting him from the pickup truck. Authorities stated that alcohol was a likely factor. While drunk driving is a constant road danger, NoCal freeways possess many other hazards including high speeds, multiple connectors, onramps and off ramps, heavy traffic, and large vehicles such as tractor trailers and buses.

OIL TANKER TRUCK EXPLODES ON NORTHERN CALIFORNIA INTERSTATE

An oil tanker truck traveling southbound on Northern California’s Interstate 880 near Oakland was struck by a car, which caused the 8,600 gallons of gas cargo to explode and burn. Fortunately, no one was hurt in the accident. However, the busy Bay Area freeway was shut down for nearly thirteen hours. Due to their size and weight, big rig trucking accidents significantly contribute to the number of motor vehicle accidents. Also significant in big rig truck accidents is the cargo that they are transporting. Liability of accidents may extend to the driver, the employer of the driver, the owner of the tractor, the owner of the trailer, the owner of the container being transported, and the owner of the cargo. Possible results of these types of accidents range from fatal deaths, to brain and spinal injuries to severe burns.

Oil%20Tanker%20Truck.jpg The accident happened at 6:15 a.m. on October 22, 2008 on the southbound stretch of Interstate 880 near Fifth Avenue in Oakland. A sedan, in an attempt to change lanes, crashed into the median, and ricocheted into the oil tanker. The explosion and fire only damaged the surface of the interstate, and the structural integrity of the highway was not threatened, the California Department of Transportation reported after its inspection.
